  1. Introduction
    • Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (the “Promoters”).
    • Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

    By participating in this Competition, Participants agree to the rules set out below.
  2. This Competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    • Persons under the age of 18 years.
  3. The competition commences from 05 December 2016 until 05 January 2017. No entries received after 05 January 2017 will be considered.
  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • Participants must purchase any one of the Participating products, dial *120*5676# and follow the prompts.
    • Participating Products include:
      • Nescafe Ricoffy 750g; and
      • Nescafe Ricoffy 3in1 Box.
    • Winners will be determined by random draws to be held throughout the competition.
  5. The Prize:
    Participants in this Competition stand a chance to win the following:
    • There are 100 x R500 SPAR vouchers to be won:
    • Only one prize per household
    • There are also 5 x R10 000 educational cash prizes to be won:
    • The prize is strictly a contribution to an educational facility of your choice. You will be requested to submit the details of the facility and the person you would like to contribute the money to. The agency will then investigate and once approved the money will be deposited directly to the educational facility on your behalf.
    • Again, only one prize per household
  6. How to claim your prize:
    • At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative, as well as any other documentation or information deemed necessary by the Promoters.
    • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 48 (forty eight) of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above mentioned telephonic conversation.
  7. General
    • The judges’ decision is final, and no correspondence will be entered into.
    • The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes.     • Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  2. The competition shall commence on 11 November 2016 and will end on 11 December 2016. No entries received after 11 December 2016 will be considered.
  3. Mechanics
    To participate in this competition, entrants must adhere to the following:
    1. Purchase any 1 (one) of the following Nestlé products from any store in South Africa, during the promotional period and retain your till slip as proof of purchase:
      1. NESTLE COCOA (62.5g; 125g or 250g tins)

    2. Participants must visit the Nestlé Cook With Love Facebook page and post a picture of their family’s Christmas Treats under the comments section of the Competition post, to stand a chance to win 1 of 4 Yuppiechef vouchers, to the value of R5 000 each.
    3. 4 (four) winners will be drawn on 12 December 2016. The draw will be administered by Emote Africa on behalf of Nestlé (“Promoter”), in Johannesburg. Nestlé reserves the right to screen the entrants’ submissions and select a deserving winner at their discretion. The winners will be announced on 15 December 2016 on the Facebook page.
  4. The Prize:
    Each winner will receive a Yuppiechef voucher to the value of R5 000.
  5. How to claim your prize:
    • The potential prize winners will be notified via Facebook message on the same day as the draw. Upon receipt of the message, the potential prize winner will be required to provide his / her contact number so that they can be contacted directly. Other information may be requested such as the potential prize winner’s physical address for the prize to be delivered to their home / work place, email address (if available), work telephone number (if available), proof of purchase (receipts) and a copy of his / her ID book and / or driver’s license to a representative from Promoter. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility. To stand a chance to win a Yuppiechef voucher valued at R2 500, participants must, after purchasing any one of the Nestlé products listed above, visit the Nestlé Bake With Love Stand within the relevant participating mall, produce their valid till slip and play the Nestlé Bake With Love baking game on the set. A participant will only be permitted to play the game once for every valid till slip that they produce. A total of 17 Yuppiechef vouchers valued at R2 500 each is up for grabs across participating malls (i.e. 1 voucher per participating mall).
    3. 1 (one) winner per participating mall will be drawn on 21 December 2016 at the Nestlé offices in Bryanston. The draw will be administered by . Business Venture Investments on behalf of Nestlé (“Promoter ”). Nestlé reserves the right to screen the entrants’ submissions and select a deserving winner at their discretion.

  5. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • To participate in this competition, Participants must purchase a participating products then dial *120*2676*unique code#. The unique code can be found on the participating products.
    • Entry costs 20c for 20 seconds as per USSD entry.
    • Winners will be determined by random draw using a computer based system and no human intervention will be involved when drawing the winners. Only legitimate unique codes redeemed will be added to the prize draws which will take place throughout the promotion. Grand Prize Travel draws will take place on the 1st of November, 1st of December and 1st of January and will be overseen by an auditor and Nestle staff members.
    • Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new unique code, subject to the following conditions:
      • All entries from disqualified participants’ mobile numbers will be rejected
      • Only one prize per household and per person
      • No computer-based entries will be accepted
      • Any mobile number that enters an incorrect unique code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”)
    • Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    • Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for competition entry purposes. If it is discovered that Participants have entered off a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prize to the promoter. This is to avoid fraud and to ensure compliance to the CPA.
    • The mobile number is key to all entries, if the entrant has won on a mobile number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  6. The Prize:
    Participants in this Competition stand a chance to win:
    Three (3) Travel Rewards
    • 3x travel getaways to be won valued at thirty thousand rand (R30 000) each.
    • The three (3) winners of the Grand Prizes (Travel Vouchers) can choose when to take their trips provided this is booked through the travel agent nominated by the Promoter and booked within a year of being announced winners after which, the prize shall be deemed to have been forfeited.
    • The Grand Prize winners must be one of the travellers.
    • The booking must be made through the travel agent nominated by the Promoter.
    • Any amount spent in excess of the voucher and spending money will be for the Grand Prize winners accounts. No cash will be handed over to any winner.
    • The Grand Prize winners will be required to sign a waiver of liability and indemnity before claiming their prize.
    • The Grand Prize winners must be fit to travel.
    • The Grand Prize winners must have a valid passport.
    • Should a traveller on the trip require a VISA or travel documentation this would be for their own expense and responsibility.

      • The winners will be notified via 2 x SMS's – one from TMARC confirming the fact they have won and the second one from ABSA within 48 hours of entry. The TMARC SMS will confirm the amount and contain an Authorisation PIN comprising 6 digits. The ABSA SMS will confirm the 10 digit Withdrawal Access number as well as the amount. Winners go to any ABSA ATM, push CASHSEND Option and follow the prompts. Both the Authorisation PIN and the Withdrawal Access number are required to complete the transaction.
      • Once TMARC and ABSA have confirmed the dispatch of codes to the winning number and confirmed the redemption of the cash from the ABSA ATM, the consumer will have no further claim against the Promoter or the Agency regarding the Prize. If the consumer did not personally withdraw the money, the consumer must open a case to investigate further.
      • Cash Send vouchers are valid for 90 days. If not redeemed within that period, they shall deemed to have been forfeited.
    • The following process will be followed to redeem cash prizes:
      • At the time that a potential Grand Prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.

    • Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary.   1. This competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this competition:

Nestlé KLIM 2016 Competition

Nestlé KLIM 2016 Competition  

By participating in this competition, entrants agree to these Rules.


  1. By entering into the KLIM 2016 COMPETITION, entrants agree to the rules set out below.
  2. Eligible participants stand a chance to win a share of R200 000 in prizes, including 10 000 airtime prizes to the value of R5 each, one cash prize to the value of R100 000 for the winner and one cash prize to be allocated to a community to the value of R50 000.
  3. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  4. Participants or entrants younger than 18 years must have the consent of their parents or legal guardian. The prizes will only be released to the winners’ parent or guardian.
  5. The Competition will commence on 01 October 2016 and end on 31 December 2016, both days inclusive. No entries received after midnight on 31 December 2016 will be considered.
  6. To participate in the Competition, each participant must: Purchase any pack of KLIM. Dial *120*5546# and follow the prompts for qualifying questions which will include entering a unique code found on the packaging of the purchased KLIM product, an ID number (or part thereof) and answers to simple questions about the participant or his/ her family. The participant will then be successfully entered into the competition. Do not SMS to this number.
    • The product mentioned above may be purchased at any store in South Africa. Promotional packs can be easily identified as they bear the competition mechanics on the label.
    • USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning.
    • Due to network restrictions, the USSD session will timeout after 120 seconds. If a consumer successfully enters the barcode before the session times out, their entry will be considered valid.
    • Winners may be requested to provide proof of purchase for the KLIM product purchased during the competition period, with a matching barcode to the one used when entering the competition.
  7. A random audited draw to determine the prize winner will be conducted on 06 January 2017 at the Nestle offices in Bryanston.
  8. The prize winner will be notified telephonically on the number used to enter the competition. Upon receipt of the call the potential prize winner may be required to provide his / her email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s licence to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility and may be required to provide proof of purchase. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. Potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited . In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  9. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  10. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter. This is to avoid fraud and ensure compliance to the CPA.
  11. Each entrant is expected to be the owner of that phone and no singular person can enter off another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
  12. The cell phone number is key to all entries, if the entrant has won on a cell phone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  13. Winners are only eligible to win one prize within a 12 month period following the date the winner was first contacted.
