By participating in the Nescafé RICOFFY 3-IN-1™ Competition, entrants agree to the rules set out below:

  1. This competition is limited to residents of South Africa, and with the exception of the following people: 
    1.1 directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) (Pty) Limited and organisers of the Competition.
    1.2 people who are not legal residents and legal citizens of the Republic of South Africa;
    1.3 spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above; and
    1.4 Persons under the age of 18 years.
  2. The competition commences from 09 June 2014 until 14 July 2014. No entries received after 14 July 2014 will be considered.
  3. Winning entrants can win a pre-determined surprise experience for themselves and a pre-determined number of persons at the discretion of organizers. Numbers of persons may vary depending on the specific experience, this will be confirmed with winners once selected
  4. To participate in this competition, entrants must adhere to the following:
    4.1 Visit the NESCAFÉ RICOFFY Mxit page and complete an entry form.
    4.2 Submit all required details upon acceptance of competition terms & conditions.
  5. A shortlist of potential winners is determined at the discretion of Nescafé Ricoffy 3-in-1 and promotional partners.
  6. Each shortlisted entrant will be contacted telephonically and give permission to be contacted live on commercial radio.
  7. Radio promotional staff at their own discretion will decide final winning entry.
  8. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé (South Africa) (Pty) Limited at which point he/she may be required to provide his/her ID and/or driver’s license to the Nestlé (South Africa) (Pty) Limited representative.  At the time of the telephone call, the potential prize winner may also be required to answer questions regarding his/her eligibility. Potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner - up finalist will be deemed the potential prize winner, subject to the terms and conditions herein.
  9. The judges’ decision is final, and no correspondence will be entered into.
  10. The prize is not transferrable and no substitution or cash redemption of the prize is permitted however, the organisers of the competition reserve the right to substitute the prize with one of comparable value for any reason.The prize will not be handed or awarded to a third party but only to the verified prize winner.
  11. By entering this competition you authorise Nestlé® and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes.   12. The winner or participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise.  All publicity and other materials will be the sole property of the promoter.
  13. By entering the competition and/or accepting the prize, entrants and winners and their companions hereby indemnify PSI, the organisers, their directors, employees, agents, suppliers and contractors from, and against any actions, claims and/or liability for injury, loss or damage of any kind resulting in whole or in part, directly or indirectly from participation in the competition, acceptance of the prize and/or participation (or non-participation) in prize related activity.
  14. The promoter reserves the right to withdraw or amend this promotion including prizes in the event of any unforeseen circumstances or factors outside of its control.

NESTLE BAKE WITH LOVE PROMOTION SHOPPER TERMS AND CONDITIONS

  1. By entering into the NESTLE BAKE WITH LOVE COMPETITION, entrants agree to the rules set out below.
  2. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  3. The Competition will commence on 15 June 2014 and end on 31 July 2014. No entries received after midnight on 31 July 2014 will be considered.
  4. To participate in the Competition, each participant must:
    4.1. Purchase any 2 (two) of the following Nestle products:
    4.1.1. NESTLE COCOA (62.5g; 125g or 250g tins)
    4.1.2. NESTLE KLIM (250g sachet; 400g tin; 500g sachet; 900g tin or 1.8kg tin)
    4.1.3. NESTLE SWEETENED CONDENSED MILK
    4.1.4. NESTLE GOLD CROSS SWEETENED CONDENSED MILK
    4.1.5. NESTLE IDEAL EVAPORATED MILK
    4.1.6. NESTLE LOW FAT IDEAL EVAPORATED MILK
    4.1.7. NESTLE TREAT CARAMEL
    4.1.8. NESTLE DESSERT CREAM (290g or 155g tins)
    4.2. The products mentioned above may be purchased at any store in South Africa. ,
    4.3. Participants must purchase any two of the above products and SMS the last four digits of the barcodes to 34449. For example, SMS “XXXX and YYYY” to 34449.
    4.4. Each SMS costs R1. Free SMS’s do not apply.
  5. The draw will take place on 15 August 2014 at Nestlé’s Head Office in Bryanston.
  6. The first three winners randomly selected will each win a Kenwood Mixer to the value of R4000. The remaining 47 randomly drawn winners will each win a Kenwood Hand Blender to the value of R500 each.
  7. The prize winners will be notified telephonically. Upon receipt of the call the potential prize winner may be required to provide his / her physical address for the prize to be delivered to their home / work place, email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s license to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. Potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  8. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  10. The prize is not transferable. No substitution or assignment of prize is permitted, but the organisers of the Competition reserve the right to substitute the prize with one of comparable value if required.
  11. The judges’ decision is final, and no correspondence will be entered into.
  12. When delivery is agreed, it is the responsibility of the winner to avail themselves to sign for the prize. No one other than the prize winner will be allowed to sign for the prize. The winner will need to produce valid identification.
  13. Should the winner not be available at the time of delivery, a second attempt will be made to arrange and deliver the prize. Should the winner not be available after the second attempt, the prize will be forfeited and an alternative winner will be drawn.
  14. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.

THE PROMOTION

  1. All persons ("Participants") entering the Spar and Nestlé Competition ("Promotional Competition") ") agree that the competition rules as set out in these terms and conditions ("Terms and Conditions") are binding on them.
  1. The Promotional Competition will run from 01 June 2014 to 31 July 2014, after which date the Promotional Competition will automatically lapse and no further entries will be accepted.
  2. The "Promoters" are Nestlé (South Africa) Proprietary Limited ("Nestlé"), Spar (South Africa) ("Spar"), and TLC Marketing Worldwide.
  3. To enter the Promotional Competition, Participants must purchase any two of the following Nestle products:
    I. Cremora (1kg);
    II. Ricoffy (250g); III. Ricoffy (750g);
    IV. Milo (500g);
    V. Hot Chocolate (500g); and/or
    VI. Nescafe Classic (200g)
    (“Products”)
  4. At the purchase of any two of the “Products”, the consumer must sms the bar code of each product (in one sms) to 48453.
  5. The winner of the Zanzibar Holiday will be selected by a random draw conducted by the Promoters during the month of August 2014. Winners of the 20 x R1 000 Spar Vouchers will be drawn on a weekly basis commencing 09 June 2014.
  6. The winner of the Zanzibar Holiday and the winners of the 20 x R1 000 Spar Vouchers will be contacted via email or telephone once the relevant draws have taken place. The Promoters reserve the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by TLC Marketing Worldwide as soon as reasonably practicable and shall be required to respond to TLC Marketing Worldwide in the manner set out in such correspondence. In the event that the replacement winner fails to respond to TLC Marketing Worldwide as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will take place immediately.
    THE PRIZES
    Winners will receive one of the following prizes (images in advertising material are used for promotional purposes only and may differ to the final prizes):
    i A trip to Zanzibar (“Zanzibar Holiday”) for 4 people; or
    ii 1 of 20 x R1 000 Spar vouchers,
    ("Prizes").
  7. The Zanzibar Holiday of 5 days (4 nights) entitles a group of 4 people (2 standard double rooms) to return flights from Johannesburg to Zanzibar. Winners will be responsible for the cost of the domestic flight to Johannesburg if required.
  8. An itinerary in respect of the Zanzibar Holiday will be put together by the Promoters in consultation with the winner and the Promoters shall endeavour to accommodate the winner’s preferences subject to the following conditions:
    i. the Promoters, at their discretion are entitled to amend, suspend and make determinations regarding the Zanzibar Holiday;
    ii. the Promoters decision is final and no correspondence will be accommodated on any matter relating to the awarding of the Prize, the Prize content, the winning Participant or any other related matter;
    iii. any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws;
    iv. the winner must be willing to sign all indemnities and meet all requirements to redeem the Prize;
    v. all provisional itineraries for travel arrangements are valid for 48 hours and are subject to promotional availability at the time of booking;
    vi. airline tickets are non-refundable once issued;
    vii. service fees charged remain non-refundable in the case of cancellation;
    viii. land transportation will be provided by the ground operator appointed;
    ix. all accommodation provided are based on standard rooms unless otherwise specified, however, there is no guarantee that on site facilities will be available at hotels all year round;
    x. breakfast and dinner will be provided daily. Lunch and beverage costs are for the winner’s own expense;
    xi. the winner must obtain adequate travel insurance to cover all aspects of the Zanzibar Holiday including, loss of baggage and personal items, personal injury and death (including all travelling parties.) The Promoters cannot be held liable for any failure to obtain travel insurance; and
    xii. passports must be valid for at least nine months after the due date of return to South Africa and also have at least 3 blank pages. Airport and airline standard terms and conditions apply - these are available on request. All relevant visa applications (no visa required for South African passports) and requirements are excluded from the competition. The winner must ensure that he / she has met all statutory travelling requirements. Yellow Fever inoculations are required 10 days prior to departure and are the responsibility of the winner.
  9. The Zanzibar Holiday may only be booked during September 2014 for travel between 01 September 2014 and 31st May 2015. The Promoters or agencies will not disclose the final costs of the itinerary to the winner.
  10. The winner is responsible for any damage to the apartment during their stay and the hotel may ask for a breakage deposit upon arrival.
  11. All costs incurred at a hotel under a booking are strictly for the winner’s account unless such costs fall under the agreed costs to be covered by the Promoters.
  12. The Zanzibar Holiday has no monetary value, is non-transferable, cannot be resold or used in conjunction with any other promotional competition or redeemed in whole or part for cash.
  13. The Promoters reserve the right to substitute the Prize with another of greater or equal value.
  14. Neither the Promoters, its agents or distributors will in any circumstances be responsible or liable to compensate the purchaser or other bearer, or accept any liability for (a) any non-acceptance by a hotel of this Promotional Competition or (b) any inability by the bearer to use the voucher properly or at all or (c) the contents, accuracy or use of either this voucher , nor will any of them be liable for any personal loss or injury occurring at the hotel, and (d) TLC Marketing Worldwide, its agents and distributors do not guarantee the administration, quality, performance and/or availability of the services offered by the venue and cannot be held liable for any loss resulting in personal loss, injury, damage or death.
  15. The Promoters shall not be held liable for any misrepresentation (written or verbal) or in respect of any warranties made by any person or group other than TLC Marketing Worldwide.
  16. The winner agrees to participate in a photograph opportunity for the sole purpose of Nestle/Spar marketing the results of this Promotional Competition.
  17. The Promoters reserve the right to withdraw this Promotional Competition without notice in the event of force majeure such as war, earthquakes, disasters, calamities, strikes or similar circumstances.
  18. The Promotional Competition is open to all South African residents aged 18 years or older. This Promotional Competition is not available to directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Spar, Nestle, TLC Marketing Worldwide or agencies and their immediate family members.
    EXCLUSIONS AND OTHER IMPORTANT TERMS
  19. These Terms and Conditions contain certain provisions which appear in similar text style to this clause and which:
    i may limit the risk or liability of the Promoters or a third party;
    ii may create risk or liability for the Participant;
    iii may compel the Participant to indemnify the Promoters or a third party; or
    iv serves as an acknowledgement, by the Participant, of a fact.
  20. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  21. The Participant acknowledges that by submitting his or her entry to the Promotional Competition he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.
  22. All Participants to this Promotional Competition participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, Spar (South Africa) and Nestlé; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.
  23. The Promoters reserve the right to amend these Terms and Conditions as well as terminate the Promotional Competition at any time. In the event of such termination, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
  24. By entering the Promotional Competition in accordance with its terms, Participants acknowledge that the Promotional Competition will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
  25. The names of the winners will be published on the Promoters' websites subject to the winners consent.
  26. Winners may be requested to take part in the Promoters' publicity campaigns or to allow their names to be used by the Promoters for promotional purposes. Winners are, however, entitled to decline such request.
  27. The Promoters shall conduct the Promotional Competition, and the Promoters’ decision on any matter related thereto, including the selection of winners is final and no correspondence will be accommodated in respect thereof.
  28. The Promoters reserve the right to vary these Terms and Conditions by providing notice of such change on the Spar website and Nestle. Any queries in this regard, and a copy of these Terms and Conditions can be found at the above websites or by calling TLC Marketing Worldwide on 011 676 7702 during office hours (Monday to Friday 08h30 – 16h30), throughout the period of the Promotional Competition.
  29. The Promoters reserve the right to circulate the Participant's personal information for purposes of this Promotional Competition and the Participant, by electing to participate in this Promotional Competition hereby irrevocably and unconditionally consents to the distribution of its personal information for the purposes contemplated herein.
  30. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

Nestlé Winter Warmer 2014 Smart Shopper Competition

THE PROMOTION

  1. All persons ("Participants") entering the Pick n Pay and Nestlé Smart Shopper Competition ("Promotional Competition") ") agree that the competition rules as set out in these terms and conditions ("Terms and Conditions") are binding on them.
  2. The Promotional Competition will run from 19 May 2014 to 13 July 2014, after which date the Promotional Competition will automatically lapse and no further entries will be accepted.
  3. The "Promoters" are Nestlé (South Africa) Proprietary Limited ("Nestlé"), Pick n Pay Retailers Proprietary Limited ("Pick n Pay"), and TLC Marketing Worldwide.
  4. To enter the Promotional Competition, Participants must swipe their Smart Shopper Card at Pick n Pay and purchase any two of the following Nestle products:
    i Cremora (1kg);
    ii Ricoffy (750g);
    iii Milo (500g);
    iv Hot Chocolate (500g); and/or
    v Nescafe (200g)
    (“Products”)
  5. Winners will be selected by a random draw conducted by the Promoters on 25 July 2014.
  6. Winners will be contacted via email or telephone after 1 August 2014, or such other date as the Promoters deem necessary. The Promoters reserve the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by TLC Marketing Worldwide as soon as reasonably practicable and shall be required to respond to TLC Marketing Worldwide in the manner set out in such correspondence. In the event that the replacement winner fails to respond to TLC Marketing Worldwide as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will take place immediately.
  7. THE PRIZES
    Winners will receive one of the following prizes (images in advertising material are used for promotional purposes only and may differ to the final prizes):
    i a share of 8 000 000 Smart Shopper points where 80 winners will each receive 100 000 Smart Shopper points, equivalent to R1 000; or
    ii a family holiday trip to Euro Disney Paris ("Euro Disney Holiday"),
    ("Prizes").
  8. The Euro Disney Holiday of 4 days (3 nights) entitles a group of 4 people (2 adults and 2 children, up to the age of 11 years old (subject to promotional availability)) to return flights from Johannesburg, or Cape Town or Durban to Euro Disney Paris.
  9. An itinerary in respect of the Euro Disney Holiday will be put together by the Promoters in consultation with the winner and the Promoters shall endeavour to accommodate the winners’ preferences subject to the following conditions:
    i. the Promoters, at their discretion are entitled to amend, suspend and make determinations regarding the Euro Disney Holiday;
    ii. the Promoters decision is final and no correspondence will be accommodated on any matter relating to the awarding of the Prize, the Prize content, the winning Participant or any other related matter;
    iii. any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws;
    iv. the winner must be willing to sign all indemnities and meet all requirements to redeem the Prize;
    v. all provisional itineraries for travel arrangements are valid for 48 hours and are subject to promotional availability at the time of booking;
    vi. airline tickets are non-refundable once issued;
    vii. service fees charged remain non-refundable in the case of cancellation;
    viii. land transportation will be provided by air-conditioned, non-smoking vehicles provided the winner is in possession of a valid international driver’s licence;
    ix. all accommodation provided are based on standard rooms unless otherwise specified, however, there is no guarantee that on site facilities will be available at hotels all year round;
    x. currency will be provided for meals and beverages (not accommodated for by the hotels) for 2 adults and 2 children (up to the age of 11 years old);
    xi. the winner must obtain adequate travel insurance to cover all aspects of the Euro Disney Holiday including, loss of baggage and personal items, personal injury and death (including all travelling parties.) The Promoters cannot be held liable for any failure to obtain travel insurance; and
    xii. passports must be valid for at least nine months after the due date of return to South Africa and also have at least 3 blank pages. Airport and airline standard terms and conditions apply - these are available on request. All relevant visa applications and requirements are excluded from the competition. Winners must ensure that they have met all statutory travelling requirements.
  10. The Euro Disney Holiday may only be booked between the period 1 August 2014 and 31 July 2015. The Promoters or agencies will not disclose the final costs of the itinerary to the winner.
  11. The winner is responsible for any damage to the apartment during their stay and the hotel may ask for a breakage deposit upon arrival.
  12. All costs incurred at a hotel under a booking are strictly for the winner’s account unless such costs fall under the agreed costs to be covered by the Promoters.

  16. The Promoters shall not be held liable for any misrepresentation (written or verbal) or in respect of any warranties made by any person or group other than TLC Marketing Worldwide.
  17. Winners agree to participate in a photograph opportunity for the sole purpose of Nestle/Pick n Pay marketing the results of this Promotional Competition.

  20. EXCLUSIONS AND OTHER IMPORTANT TERMS
    These Terms and Conditions contain certain provisions which appear in similar text style to this clause and which:

  21. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  22. The Participant acknowledges that by submitting his or her entry to the Promotional Competition he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.
  23. All Participants to this Promotional Competition participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, Pick n Pay Stores Limited, all entities in the Pick n Pay Group and Nestlé; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.
  24. The Promoters reserve the right to amend these Terms and Conditions as well as terminate the Promotional Competition at any time. In the event of such termination, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
  25. By entering the Promotional Competition in accordance with its terms, Participants acknowledge that the Promotional Competition will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
  26. The names of the winners will be published on the Promoters' websites subject to the winners consent.
  27. Winners may be requested to take part in the Promoters' publicity campaigns or to allow their names to be used by the Promoters for promotional purposes. Winners are, however, entitled to decline such request.
  28. The Promoters shall conduct the Promotional Competition, and the Promoters’ decision on any matter related thereto, including the selection of winners is final and no correspondence will be accommodated in respect thereof.
  29. The Promoters reserve the right to vary these Terms and Conditions by providing notice of such change on the Pick n Pay website and Nestle. Any queries in this regard, and a copy of these Terms and Conditions can be found at the above websites or by calling TLC Marketing Worldwide on 011 676 7702 during office hours (Monday to Friday 08h30 – 16h30), throughout the period of the Promotional Competition
  30. The Promoters reserve the right to circulate the Participant's personal information for purposes of this Promotional Competition and the Participant, by electing to participate in this Promotional Competition hereby irrevocably and unconditionally consents to the distribution of its personal information for the purposes contemplated herein.
    These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

ChocFest 2014 Competition Rules

AIRTIME Rules:

  1. By entering into the Nestlé Bar One®, Kit Kat®, Aero®, Tex® and Smarties® Competition, entrants agree to the rules set out below.
  2. This competition is limited to residents of South Africa, with the exception of the following people: 2.1. directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited (“Nestlé”) and organisers of the Competition;
    2.2. people who are not legal residents and / or legal citizens of the Republic of South Africa;
    2.3. spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above; and
    2.4. persons under the age of 18 years.
  3. Winning entrants can win:• One of 20 000, airtime vouchers valued at R5-00 each; or
    • One of 100 000 airtime vouchers valued at R 10-00 each; or
    • One of 18 000 airtime vouchers valued at R 20-00 each; or
    • One of 1 000 airtime vouchers valued at R 40-00 each.
  4. The competition starts: 1 May 2014 and ends on 31 August 2014. No entries received after 31 August 2014 will be considered.

  9. Winners may be required (at no fee) to be identified and have their photographs published in print media, or to appear on radio and/or television. However winners shall at all times be entitled to decline the above request. All publicity and other materials will be the sole property of Nestlé.
  10. All entrants must hold a valid South African identity document.
  11. All valid entries submitted will be eligible to win a prize.
  12. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé at which point he/she may be required to provide his/her ID and/or driver’s license to the Nestlé representative. The potential prize winner will also be required to provide his / her address details in order for the prize to be couriered to his / her address. 12.1 Potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner- up finalist will be deemed the potential prize winner, subject to the terms and conditions herein.
  13. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  14. The judges’ decision is final, and no correspondence will be entered into.
  15. The prizes are not transferable. No substitution, cash redemption or assignment of prize is permitted, but the organisers of the Competition reserve the right to substitute the prize with one of comparable value for any reason. The dates allocated for each prize are not negotiable.
  16. When delivery is agreed, it is the responsibility of the winner to avail themselves to sign for the prize. No one other than the prize winner will be allowed to sign for the prize. The winner will need to produce valid identification
  17. Should the winner not be available at the time of delivery, a second attempt will be made to arrange and deliver the prize. Should the winner not be available after the second attempt, the prize will be forfeited and an alternative winner will be drawn.
  18. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  19. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes.   20. Nestlé, its promotional and advertising agents, merchandisers and organisers shall not be responsible for any subsequent decline of acceptance of prizes for any reason.

 

  1. Ultimate Music Festival Experience Rules
    This Promotional Competition is organised by Nestlé (South Africa) Proprietary Limited (“Nestlé “or "the Promoter").
  2. The promotional competition is open to permanent residents and citizens of South Africa over the age of 18 years in possession of a valid South African identity document and Passport valid for at least 6 (six) months after the final Travel Date ("Valid Passport"), except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoters and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoters, its advertising agencies, advisers, dealers, suppliers and identified by the trademarks owned by or licensed to Nestlé, its affiliates and/or associated companies ("Disqualified Participants").
  3. By entering the promotional competition, all participants agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
  4. The promotional competition commences on 1 May 2014 and ends on 31 August 2014.
  5. The list of winners will be published on www.nestle.co.za on before the 30TH SEPTEMBER 2014.
  6. Participants stand a chance to win 1 (one) of 5 (five) nationwide tailor made festival experiences.
  7. The Grand Prize package includes the following:
    7.1 Five tickets to a festival of the winner’s choice in South Africa from the 5 options provided by Offlimit Communications as follows:
    7.1.1. One night’s accommodation for the winner and 5 (five) friends in either a 4 star hotel;

To stand a chance of winning ONE Nestlé ChocFest Ultimate Music Festival Experience for you and 5 (five) friends, all participants will be required to purchase one of the 5 participating Nestlé chocolate brands: Bar One, Aero, Kit Kat, Smarties or Tex, and visit www.nestlechocfest.co.za and follow the instructions thereafter with the unique code from inside the wrapper.
  9. By entering this competition, the participants agree to be bound by the competition rules and requests of the Promoter and its agents. The Grand Prize winner and his/her 5 (five) friends will be required to sign a document to this effect as well as an indemnity form indemnifying Nestlé from any damages which may arise as a result of the participants entering this competition.
  10. All participants undertake to arrive on time to all events as advised by the Promoters and agree to stick to the itinerary set out by the promoter.
  11. Failure by participants to adhere to all of the promotional competition rules will result in participants being disqualified and immediately removed from the promotional competition.
  12. Participants acknowledge that ownership in all material and/or content generated during the promotional competition such as mp3s, photos, biographical details, reviews, comments, data posting and all other text material, will remain and be controlled by the Promoter.
  13. Participants acknowledge and accept that all content and/or contribution produced during the promotional competition may be edited, removed and/or be prevented from being published if the Promoters consider such content and/or contribution to be: 1. defamatory or otherwise unlawful or that it violates laws regarding harassment, discrimination, privacy or contempt;
    2. intentionally false or misleading;
    3. an infringement of intellectual property rights or copyright;
    4. abusive or offensive, including obscenity, blasphemy and racial vilification;
    5. of nuisance value, inappropriate, off topic or vexatious;
    6. compromising the privacy of yourself, or containing inappropriate personal information;
    7. seeking to endorse commercial products or activities or to solicit business;
    8. deliberate provocation of other community members; or
    9. a posting on behalf of a suspended member.
  14. All participants and/or winners as the case may be acknowledge that the names, images and logos are proprietary marks of Nestlé. All copyright, trademarks and other intellectual property rights in the Website (including the design, arrangement and look and feel) and all material and/or content supplied by participants and incorporated as part of the site, other than User Generated Content shall at all times remain the exclusive property of Nestlé.
  15. Winners must sign an indemnity form before they will be allowed to claim a Grand Prize.
  16. If the Promoters are unable to reach any person, after his/her name has been drawn, for whatsoever reason, such person will be disqualified and another participant shall be chosen in the same manner as the first.
  17. The Grand Prizes are neither transferable nor redeemable for cash. Offlimit Communications reserves the right to substitute the Grand Prize with any other prize of comparable commercial value.
  18. Should any dispute arise in relation to the interpretation of these competition rules, Offlimit Communications’ decision shall be final and no correspondence shall be entered into.
  19. All participants and winners as the case may be, indemnify Offlimit Communications, its advertising agencies, advisers, nominated agents, suppliers, identified by the trademarks owned by or licensed to Nestlé, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotional competition.
  20. Offlimit Communications will require the winner to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Grand Prize and it shall revert back to Offlimit Communications.
  21. Offlimit Communications may require the winner to be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Grand Prize and/or after having received their Grand Prize. The winner will be given the opportunity to decline to the publication of their images and to participate in Offlimit Communications marketing material in so far as it relates to the Promotional Competition.
