Nestlé BAR-ONE VIP Sporting Experience Competition rules

  1. This promotional competition (“Competition”) is run by Nestlé (South Africa) (Pty) Limited (“Promoter”) and is open to all persons of 18 years or older and resident in South Africa except the employees and their immediate families of Promoter, Promoter’s advertising and promotion agencies, associated companies, and outlet owners and staff.
  2. These rules may be amended by notification at any time during the Competition, and will be interpreted by Promoter only. Participation by all entrants (“Participants”) constitutes acceptance of these rules.
  3. The Competition commences on 1 September 2015 and ends on 31 December 2015. No entries received after 31 December 2015 will be considered.
  4. Participants stand to win:
    • 1 (one) of 3 (three) BAR-ONE legendary sporting experiences for :-
    • 1 (one) Winner and 4 (four) friends to watch a soccer match in South Africa; or
    • 1 (one) Winner and 4 (four) friends to watch a rugby match in South Africa; or
    • 1 (one) Winner and 4 (four) friends to watch a cricket match in South Africa.
    Sport matches are pre-determined by Nestle of which the prize winners can choose from, up to the value of R50 000 (fifty thousand rand) each; or
    • 60 (sixty) R500 (five hundred rand) cash vouchers to the value of R30 000 in total; or
    • 200 (two hundred) R250 (two hundred and fifty) cash vouchers to the value of R50 000 in total; or
    • 700 (seven hundred) R100 (one hundred) cash vouchers to the value of R70 000 in total.
  5. To enter, Participants must purchase any 2 (two) of the following products:
    • Nestle BAR-ONE 21g;
    • Nestle BAR-ONE 55g;
    • Nestle BAR-ONE 100g;
    • Nestle BAR-ONE 250g Fun Pack; or
    • Nestle BAR-ONE 130g

    • then dial *120*548528#, and provide the correct barcode. Dialling of the aforementioned codes by Participants will serve as acceptance by Participants of all the terms and conditions hereto.
  6. Only entries with correct barcodes will be accepted.
  7. Each entry costs R 0.20 (twenty cents) per 20 seconds. No free airtime entries apply. Participants may only enter once per day.
  8. Prize Winners will be contacted telephonically between 18th January 2016 and 22nd January 2016. Should the winner not respond to a telephone call within 48 hours with all the details that need to be submitted, the winner will forfeit their winnings and the prize will go to the runner up.
  9. At the time that a potential prize Winner for the Grand Prize is identified, the potential prize Winner will receive a telephone call from a representative of Nestlé (South Africa) (Pty) Limited at which point he/she may be required to provide his/her valid ID and/or driver’s license to the Nestlé (South Africa) (Pty) Limited representative. At the time of the telephone call, the potential prize Winner may also be required to answer various questions regarding his/her eligibility. The Potential prize Winner is not an actual Winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited.
  10. Prize Winners will only qualify to receive ownership of the prize once all the prize Winner’s details have been verified and confirmed, including compliance with these rules and satisfying the qualifying criterion set by the Promoters. If a potential prize Winner does not meet the eligibility requirements, the prize will be forfeited and a runner – up finalist will be deemed the potential prize Winner, subject to the terms and conditions herein.
  11. If the Promoters are unable to reach any of the prize Winners within 48 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such Winner will be disqualified and a draw for a new Winner will take place.
  12. Prizes:
    1. If you win a cash voucher, you will receive an SMS from TMARC confirming the amount you have won, together with an Authorisation PIN of 6 digits. You will also receive an SMS from ABSA (within 48 hours) confirming the 10 digit Withdrawal Access number as well as the amount. To redeem your cash voucher, you must go to any ABSA ATM, select the CASHSEND Option and follow the prompts.
      Once TMARC and ABSA have confirmed the dispatch of the codes to the winning number and redemption of cash from an ABSA ATM, the winner will have no further claim against the Promoter or the Agency regarding the prize. If the winner did not personally withdraw the cash, the winner must report the matter to the South African Police Services to investigate further.
    2. If you win the BAR-ONE legendary sporting experience prize, within 2 weeks of the prize winner being notified, he / she must meet with Nestlé and / or the Promoters to discuss and agree on the details of the sporting experience. Once the sporting experience has booked, the winner will forfeit the prize if they do not attend the match. The prize in question must be utilized within a period of 6 months, failing which same will be forfeited and a runner up finalist will be deemed the winner.
    3. Winners may be required to sign acceptance of prizes and indemnity documents.
  13. Winners will be announced on www.Nestlè.co.za
  14. Prizes will under no circumstances be handed over or paid to a third party, and will only be handed or transferred directly to the verified prize Winner. The judges’ decision is final, and no correspondence will be entered into.
  15. No substitution or cash redemption of the prizes are permitted. Cash is not transferrable and the prizes cannot be exchanged for cash.
  16. The 3 (three) BAR-ONE legendary sporting experiences referred to in clause 4 above, include travel costs (booking of flights and car hire), accommodation costs, drinks, food costs and all other costs relating to the experience.
  17. In the event that the R50 000 (fifty thousand rand) sporting experience has not been fully utilized, the winner shall not be entitled to the remainder of the difference in prize for cash.
  18. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication by e-mailing consumer.services@za.nestle.com
  19. The Winner or participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the promoter.

Terms And Conditions

  1. By entering into the NESTLE NESPRAY BOXER PROMOTION, entrants agree to the rules set out below.
  2. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  3. The Competition will commence on 01 July 2015 and end on 30 August 2015. No entries received after midnight on 30 August 2015 will be considered.
  4. To participate in the Competition, each participant must:
    • Purchase any NESPRAY Pack: (250g, 500g, 400g, 900g, 1.8kg or NESPRAY Tummy Ease 900g) from any participating BOXER store in South Africa.
    • Dial *120*304050# and enter the barcode of their NESPRAY product.
    • USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning. Entrants are only eligible to win ONE of the 10 BOXER Vouchers and nominate ONE school for the R5000 donation.
    • The draw will take place on 15 September 2015 at the Nestlé Head Office in Bryanston.
    • The first ten qualifying entrants drawn will each win a BOXER voucher worth R5000 and R5000 towards a school of their choice. The BOXER voucher will be delivered to the winners, while prize money for chosen schools will be paid directly to the school via bank transfer.
    • Potential prize winners will be notified telephonically. Upon receipt of the call the potential prize winner may be required to provide his / her physical address for the prize to be awarded or delivered to their home / work place, email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s license to a representative from Nestlé (South Africa) (Pty) Limited. Any prizes that are not redeemed by 30 October 2015 will be forfeited.
    • Prizes will be couriered to the winner's chosen address within the Republic of South Africa within 21 (twenty one) working days from submission of the required winner documentation. Potential winners will be contacted by the courier to confirm the address for delivery of the prize on a weekday between 8am and 5pm. If the winner is uncontactable for 3 consecutive days or the courier is unable to deliver after 3 attempts, the prize will be considered forfeited and be awarded to the runner-up.
    • Cards will only be activated following written confirmation from winner of receipt of the card. The card will represent no value until it has been activated. On activation, the card will be loaded with R5,000 to be spent at Boxer stores. Winners will be advised as soon as the card has been activated.

Terms and Conditions

  1. The Nestle KLIM and Cocoa competition (“the competition”) is organized and run by Nestle South Africa (Pty) Limited. The competition is open for entry to all residents of South Africa that are aged 18 years and older, subject to the conditions below.
  2. 2. No director, member, partner, employee or agent of, or consultant to Nestle or any other person who directly or indirectly controls or is controlled by Nestle, or any spouses, life partners, business partners or immediate family members of any director, member, partner, employee, agent or consultant of or of any person who directly controls or is controlled by Nestle, may participate in the competition nor may any supplier of goods or services in connection with the competition. The competition is not open for entry by or on behalf of a company, close corporation or similar juristic person or legal entity.
  3. The competition will run from 30 June 2015 until 31 August 2015 ("the competition period"). No late entries will be accepted.
  4. R3000 is up for grabs each day. There will be 12 winners in total (one per hour from 8am – 8pm) each day of the competition period. All winners will win a R250 cash voucher competition period..
  5. To participate in this competition, and to be eligible to receive airtime and stand a chance to win cash prizes, participants are required to purchase any Klim (250g, 400g, 1.8kg or 900g) or Cocoa (125g or 62.5g) products with a promotional on-pack sticker at participating stores and retain their till slip.
  6. To enter the competition to receive airtime and stand a chance to win cash prizes participants are required to SMS their Unique Code and Name to 32111. Each entry is charged R1.00 per entry.
  7. Cash prizes will be awarded randomly. The participant with a winning unique code will, on the first working day after entry, receive an SMS auto-reply on the cell number they provided when entering the competition. If the participant cannot, for any reason, be reached after 6 attempts within a period of 3 business days, the cash prize will be forfeited and another winner will be selected in his/her place. The SMS auto-reply will request the participant's till slip for the Klim (250g, 400g, 1.8kg or 900g ) or Cocoa (125g or 62.5g) purchased and a copy of their ID or valid passport for receipt of their R250 cash prize. The till slip and copy of ID or valid passport may be emailed to callcentre@tccfusion.co.za or sent via WhatsApp to 0714704329 or faxed to 086 733 8659 as advised in the SMS. This must be done within 48 hours of the participant receiving of the SMS auto-reply. Once the participant's till slip for the Klim (250g, 400g, 1.8kg or 900g) or Cocoa (125g or 62.5g) product purchased and a copy of their ID or valid passport are received by Fusion, the participant will be contacted on their cell number and requested to verify their details and make arrangements for them to receive the prize of R250. Once the participant's details have been validated, payment of R250 will take place within 7 days. Winners will be paid via the FNB eWallet using the below method.
    Method

    You will receive an SMS advising that money has been sent to your cell phone. You will need to request an ATM PIN by following the below steps… Please ensure that you are close to an FNB ATM (less than 30 minutes away) before proceeding with the following steps as the ATM PIN will expire after approx. 30 minutes. A new ATM PIN can be requested after expiry of the first one should you not make it in time.

    • Dial *120*277# to access the eWallet
    • Select 'Withdraw cash' and then 'Get ATM PIN'
    • You will receive an SMS with an ATM PIN
    • At the FNB ATM press the green button (enter/ proceed) on the keypad OR select Cardless Services
    • Select eWallet Services
    • Key in your cell phone number and select Proceed
    • Key in the eWallet ATM PIN you requested and received via SMS
    • Choose the applicable cash amount
    • Make sure that either your transaction has ended or that you press 'cancel' before leaving the ATM.
  8. Each unique code is unique and may only be submitted once to enter the competition. If more than one entry is received with the same unique code, only the first entry will be valid and all subsequent entries will be deemed invalid.
  9. Subject to clause 8 above, each participant may enter the competition multiple times by submitting a different unique code on entry. Please note that there is a maximum entry limit per participant per week which cannot exceed 5 times within a 7 day period.
  10. Entries received after 8pm will be included in the next day's 8am-9am draw.

  12. Entries containing unclear, illegible or incorrect unique codes, which are not submitted in line with clause 6 above or which are submitted by one of the prohibited persons referred to in clauses 1 and 2 above, will be regarded as invalid entries.
  13. Nestle will not be liable for any entries or SMSs not received due to a technical or service provider error or failure and/or due to any other cause outside of Nestlé’s control.
  14. Without prejudice to Nestlé’s general amendment rights in clause 17, Nestle reserves the right to extend, shorten or suspend the competition period due to technical, commercial or operational reasons, public interest, events beyond its control or generally for any reason whatsoever within its sole discretion. In the event that the competition period is extended, shortened or suspended, participants will be notified by Nestle thereof as soon as reasonably possible through a notice on its website at www.nestle.co.za. All participants who have received confirmation of a cash prize prior to any suspension or shortening of the competition will remain eligible to receive the prizes that have been awarded to them in accordance with these terms and conditions.
  15. Nestle reserves the right to terminate/cancel the competition at any stage prior to the end of the competition period, whether as a result of changes in legislation, if required by any national, provincial or municipal authority or for any reason whatsoever. Notice of such termination shall be published on Nestlé’s website at www.nestle.co.za as soon as reasonably possible. In such event, all participants waive any rights that they may have or purport to have in terms of the competition, and acknowledge that they will have no recourse against Nestle whatsoever. However, all participants who have received communication on winning a R250 cash prize prior to the termination of the competition will remain eligible to receive the prize awarded to them in accordance with these terms and conditions.
  16. Nestle reserves the right to amend these terms and conditions at any time and for any reason and will notify participants of any such amendments as soon as reasonably possible via its website at www.nestle.co.za. It is the participant's responsibility to regularly check Nestlé’s website for any amendments. Any amendments will be applied and interpreted at the sole discretion of Nestle.
  17. In the event that the terms and conditions of the competition are amended in terms of clause 15, such amendments shall become effective immediately or on such date as may be determined by Nestle. However, all participants who have received confirmation of a cash prize prior to such will remain eligible to receive the prizes that have been awarded to them in accordance with the terms and conditions in force when they were selected as winners.
  18. No participants shall have any recourse or claim against Nestle as a result of any amendment to these terms and conditions or as a result of Nestlé’s cancellation, termination or suspension of the competition in line with these terms and conditions.
  19. Nestle may request winners to allow their images and/or name to be used or published in relevant marketing media and request a winner to participate in any marketing activity. However, winners will be given an opportunity to decline such invitation to do so.
  20. Nestle may request winners to complete and submit an information disclosure agreement and indemnification to enable Nestle to ensure compliance with these terms and conditions and the Consumer Protection Act 68 of 2008. Should a winner refuse or be unable to comply with such a request for any reason, they will be deemed to have rejected the cash prize and Nestle shall be under no obligation to pay the cash prize.
  21. By entering this competition, participants agree to receive future promotional advertising relating to Nestle and its products. However, participants may refuse to accept, block or ask that such promotional advertising be ceased at any time.

  3. This competition is limited to residents of South Africa, with the exception of the following people:
    1. directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited (“Nestlé”) and organisers of the Competition;
    2. people who are not legal residents and / or legal citizens of the Republic of South Africa;
    3. spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above; and
    4. Persons under the age of 18 years.

    At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé at which point he/she may be required to provide his/her ID and/or driver’s license to the Nestlé representative. The potential prize winner will also be required to provide his / her banking details in order for the prize to be paid via EFT into the account. The prize winner must be the owner of the bank account, if another account is chosen, written consent from the account holder and prize winner must be obtained prior to payment.

  5. The competition starts: 1 May 2015 and ends on 30 September 2015. No entries received after 30 September 2015 will be considered.

  7. Prize winners for the airtime will be notified instantly via SMS and will receive their airtime voucher pin within 60 seconds.

    2. In order to qualify to win the R5000,00 cash prize, consumers must enter 5 or more unique codes over the abovementioned 5 day promotional burst period. The list of winners will be published on www.nestle.co.za on or before 31st October 2015.
  8. Winners may be required (at no fee) to be identified and have their photographs published in print media, or to appear on radio and/or television. However winners shall at all times be entitled to decline the above request. All publicity and other materials will be the sole property of Nestlé.
  9. All entrants must hold a valid South African identity document.
  10. All valid entries submitted will be eligible to win a prize.

    1. Potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner-up finalist will be deemed the potential prize winner, subject to the terms and conditions herein.
  11. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  12. The judges’ decision is final, and no correspondence will be entered into.
  13. The prizes are not transferable. No substitution, cash redemption or assignment of prize is permitted, but the organisers of the Competition reserve the right to substitute the prize with one of comparable value for any reason. The dates allocated for each prize are not negotiable.
  14. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  15. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com.
  16. Nestlé, its promotional and advertising agents, merchandisers and organisers shall not be responsible for any subsequent decline of acceptance of prizes for any reason.
