  1. By entering into the Everyday Good Habits Promotion, entrants agree to the rules set out below.
  2. This competition is open to all South African residents or South African citizens over the age of 18 years (any persons under the age of 18 years must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestlé (South Africa) (Pty) Ltd (Nestlé), its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestlé, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  3. Participants or entrants younger than 18 years must have the consent of their parents or legal guardian to enter the competition. Where a winner is younger than 18 years, that winner’s prize will only be released to their parent or guardian.
  4. The competition will commence on 16 January 2017 and end on 9 April 2017, both days inclusive. No entries received after midnight on 9 April 2017 will be considered.
  5. Prizes
  6. Eligible participant stands a chance to win:
    • one of 50 Samsung “School in a Box” prizes, plus a free 20GB data bundle valid for a year (each “School in a Box” prize will include a:
      • Samsung Galaxy Tab 3 Lite;
      • 16GB micro SD card;
      • a keyboard cover;
      • in-ear headphones;
      • screen protector;
      • diamond world solar panel;
      • tablet carry case); OR
    • a share of R500 000, made up of 50 cash prizes to the value of R10 000 each; OR
    • a share of R50 000 in airtime prizes.
  7. Each of the first 50 randomly selected participants will each be eligible to win a Samsung “School in a Box” prize plus a free 20GB data bundle, and the subsequent randomly selected 50 participants will be eligible to win cash prizes. All entries made via the USSD mechanic will be eligible for airtime prizes.

  8. Mechanics
  9. To participate in the competition, each participant must purchase any pack of NESPRAY or NESPRAY Tummy Ease during the promotional period set out in paragraph 4 above, dial *120*304050# and follow the prompts for qualifying questions which will include entering the last four digits of the barcode found on the product packaging, an ID number (or part thereof) and answers to simple questions about the participant or his/her family. The participant will then be successfully entered into the competition. Please do not send SMSes to the number set out above.
  10. The products mentioned above may be purchased at any store that stocks NESPRAY in South Africa.
  11. USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The promoter shall not be responsible for telecommunication failure on the part of the participant’s service provider.
  12. Each participants must enter on a phone that is owned and registered to that person. No person can use another person’s phone for competition entry purposes. If it is discovered that a participant has entered the competition using a phone that is not registered to him/her, then he/she will be disqualified and the participant will be requested to return their prize to promoter. This is to avoid fraud and ensure compliance to the Consumer Protection Act, 2008.
  13. The cell phone number of a participant is key to that participant’s entry(ies), and this number needs to be a number that is contactable during office hours. Winners will be contacted only on the cellphone number they used to enter the competition. No single person can enter the competition using multiple cellphone numbers. This is to avoid additional fraud being conducted by multiple SIM card owners and to protect fairness to legitimate participants.
  14. Participants may enter the competition as many times as they choose over the promotional period to increase their chances of winning, provided that participants purchase one of the products set out in paragraph 7 each time and complete the competition entry process.
  15. Due to network restrictions, the USSD session will timeout after 120 seconds. If a participant successfully enters the barcode found on the product packaging before the session times out, their entry will be considered valid.
  16. Potential winners may be requested to provide proof of purchase for the NESPRAY product purchased during the competition period, with a matching barcode to the one used when entering the competition.
  17. A random audited draw to determine the prize winners will be conducted on 18 April 2017 at the Nestlé offices in Bryanston.

  18. How to claim your prize
  19. At the time when a potential prize winner is identified, the potential prize winner will receive a call from a representative of Nestlé or a partner agency of Nestlé on the number used to enter the competition. Upon receipt of the call the potential prize winner may be required to provide his / her email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s licence to a representative from Nestlé. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility and may be required to provide proof of purchase. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. A potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  20. If Nestlé, the organisers of the competition and/or the promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  21. Winners are only eligible to win one prize in a NESPRAY competition within a 12 month period following the date the winner was first contacted in respect of their previous win.
  22. The eligible winners will have their prizes delivered to them by a representative of Nestlé or a partner agency of Nestlé based on the information they will have shared via the above mentioned telephonic conversation.

  23. General
  24. The judges’ decision is final, and no correspondence will be entered into.
  25. Nestlé may require the winners to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should any winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.

Nestlé MILO Summer Promotion  

By participating in this competition, entrants agree to the rules set out below.

  1. This competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this competition:
    • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited (“Nestlé”) and the organisers of the Competition.
    • People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    • Persons under the age of 18 years.
  2. The competition shall commence on 16 January 2017 and will end at midnight on 28 February 2017. No entries received after 28 February 2017 will be considered.
  3. Mechanics
    To participate in this competition, entrants must adhere to the following:
    • Retailer Mechanic:
      • Buy ANY MILO 125g, 250g or 500g product.

      • Entry costs 20c/20secs as per USSD entry. Free minutes do not apply.
    • Potential winners will be selected from a random draw.
    • Participants may enter the competition as many times as they wish over the promotional period, provided that participants purchase the participating products each time, subject to the following conditions:
      • All entries from disqualified participants’ cellphone numbers will be rejected
      • Only one prize per household and per person
    • The judges' decision is final, and no correspondence will be entered into.
    • No substitution or cash redemption of non-cash prizes is permitted. Prizes are not transferable.
    • Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for competition entry purposes. If it is discovered that participants have entered of a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter. This is to avoid fraud and to ensure compliance to the CPA.
    • Therefore each entrant is expected to be the owner of that phone and no singular person can enter off of another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
    • The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
    • Each entrant is expected to have purchased the brand and be able to produce a valid till slip if requested by Nestle.
  4. The Prize:
    Participants in this competition stand a chance to win:
    • 42 x R2000 Sportsmans Warehouse Vouchers:
      • The winners will be selected randomly and notified telephone call confirming that they have won a voucher. The potential winners will be given 48 hours to produce their proof of purchase (till slip). If the potential winner cannot produce a valid till slip they will forfeit the prize.
      • Only one prize per household
    • There are also 2100 instant airtime prizes to be won:
      • Winners of the Airtime Prizes will receive an instant notification of the value of the airtime they have won on entering cellular phone number. Airtime Prizes may only be redeemed by PRE-PAID account holders only. Winners with contract accounts can transfer the Airtime Prize to any other Pre-Paid number of their choice.
      • Airtime is available for the following Networks – Vodacom / MTN / Cell C / Virgin Mobile and 8ta.
      • An SMS with the airtime voucher will be sent to the cellular phone number used to enter the competition
      • Airtime vouchers are valid for 90 days
    • There are 680 cash prizes to be won:
      • The following process will be followed to redeem cash prizes: the winners will be notified instantaneously via 2 x SMS's – one from TMARC confirming the fact they have won; one from ABSA within 48 hours. The TMARC SMS will confirm the amount and an Authorisation PIN of 6 digits. The ABSA SMS will confirm the 10 digit Withdrawal Access number as well as the amount. Winners go to any ABSA ATM, push CASHSEND Option and follow the prompts. Both the Authorisation PIN and the Withdrawal Access number are required to complete the transaction. Winners who win more than R3000.00 will have the money deposited directly into the account of their choosing
      • Once TMARC and ABSA have confirmed the dispatch of codes to the winning number and confirmed the redemption of the cash from the ABSA ATM, the consumer will have no further claim against the Promoter or the Agency regarding the Prize. The slip is not to be written on or tampered with in anyway.
    • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé.     • Winners will be determined by random draw using a computer based system and no human intervention will be involved when drawing the winners. Only legitimate unique codes redeemed will be added to the prize draws which will take place throughout the promotion. Grand Prize Travel draws will take place on the 1st of November, 1st of December and 1st of January and will be overseen by an auditor and Nestle staff members.
    • Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new unique code, subject to the following conditions:
      • All entries from disqualified participants’ mobile numbers will be rejected
      • Only one prize per household and per person
      • No computer-based entries will be accepted

This is to avoid fraud and to ensure compliance to the CPA.
    • The mobile number is key to all entries, if the entrant has won on a mobile number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  6. The Prize:
    Participants in this Competition stand a chance to win:
    Three (3) Travel Rewards
    • 3x travel getaways to be won valued at thirty thousand rand (R30 000) each.
    • The three (3) winners of the Grand Prizes (Travel Vouchers) can choose when to take their trips provided this is booked through the travel agent nominated by the Promoter and booked within a year of being announced winners after which, the prize shall be deemed to have been forfeited.
    • The Grand Prize winners must be one of the travellers.
    • The booking must be made through the travel agent nominated by the Promoter.
    • Any amount spent in excess of the voucher and spending money will be for the Grand Prize winners accounts. No cash will be handed over to any winner.

The TMARC SMS will confirm the amount and contain an Authorisation PIN comprising 6 digits. The ABSA SMS will confirm the 10 digit Withdrawal Access number as well as the amount. Winners go to any ABSA ATM, push CASHSEND Option and follow the prompts. Both the Authorisation PIN and the Withdrawal Access number are required to complete the transaction.
      • Once TMARC and ABSA have confirmed the dispatch of codes to the winning number and confirmed the redemption of the cash from the ABSA ATM, the consumer will have no further claim against the Promoter or the Agency regarding the Prize. If the consumer did not personally withdraw the money, the consumer must open a case to investigate further.
      • Cash Send vouchers are valid for 90 days. If not redeemed within that period, they shall deemed to have been forfeited.
    • The following process will be followed to redeem cash prizes:
      • At the time that a potential Grand Prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
      • If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and, at the discretion of the Promoters, a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  8. General
    • The judges’ decision is final, and no correspondence will be entered into.
    • The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

Nestlé KLIM 2016 Competition  

By participating in this competition, entrants agree to these Rules.


  1. By entering into the KLIM 2016 COMPETITION, entrants agree to the rules set out below.
  2. Eligible participants stand a chance to win a share of R200 000 in prizes, including 10 000 airtime prizes to the value of R5 each, one cash prize to the value of R100 000 for the winner and one cash prize to be allocated to a community to the value of R50 000.
  3. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  4. Participants or entrants younger than 18 years must have the consent of their parents or legal guardian. The prizes will only be released to the winners’ parent or guardian.
  5. The Competition will commence on 01 October 2016 and end on 31 December 2016, both days inclusive. No entries received after midnight on 31 December 2016 will be considered.
  6. To participate in the Competition, each participant must: Purchase any pack of KLIM. Dial *120*5546# and follow the prompts for qualifying questions which will include entering a unique code found on the packaging of the purchased KLIM product, an ID number (or part thereof) and answers to simple questions about the participant or his/ her family. The participant will then be successfully entered into the competition. Do not SMS to this number.
    • The product mentioned above may be purchased at any store in South Africa. Promotional packs can be easily identified as they bear the competition mechanics on the label.
    • USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning.
    • Due to network restrictions, the USSD session will timeout after 120 seconds. If a consumer successfully enters the barcode before the session times out, their entry will be considered valid.
    • Winners may be requested to provide proof of purchase for the KLIM product purchased during the competition period, with a matching barcode to the one used when entering the competition.
  7. A random audited draw to determine the prize winner will be conducted on 06 January 2017 at the Nestle offices in Bryanston.
  8. The prize winner will be notified telephonically on the number used to enter the competition. Upon receipt of the call the potential prize winner may be required to provide his / her email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s licence to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility and may be required to provide proof of purchase. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. Potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited . In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  9. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  10. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter. This is to avoid fraud and ensure compliance to the CPA.
  11. Each entrant is expected to be the owner of that phone and no singular person can enter off another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
  12. The cell phone number is key to all entries, if the entrant has won on a cell phone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  13. Winners are only eligible to win one prize within a 12 month period following the date the winner was first contacted.
