CAMPUS ACTIVATION TERMS AND CONDITIONS

  1. All persons ("Universities") entering the NESCAFE ‘Start the Movement’ Campaign 2015 ("Competition") agree that the rules as set out in these terms and conditions ("Terms and Conditions") are binding on them.
  2. This Competition is open to students attending University of Witwatersrand, University of Johannesburg and Tshwane University of Technology only.
  3. The Competition will run from the 23rd of March 2015 to the 15th of April 2015, after which date the Competition will automatically lapse and no further entries will be accepted.
  4. The "Promoters" are Nestlé (South Africa) Proprietary Limited ("Nestlé") and Publicists, a division of MMS Communications South Africa Proprietary Limited (“Publicis”).
  5. To enter the Competition, students are required to form the longest NESCAFE chain of students across South Africa.
  6. Winners will receive the following prizes:
    i Students will be invited to join the NESCAFÉ chain, and NESCAFÉ will donate R5 to the University’s charity of choice for every student that joins the NESCAFE chain with a maximum of R10 000.00 to be earned for the charity.
    ii NESCAFÉ will donate a further bonus of R15 000.00 to the campus which has the longest chain of students nationally.
    iii In the event that there is a tie, the R15 000.00 bonus fee will be split amongst the campuses which share the longest chain.
    iv Winners will be determined by the number of students linked together using the NESCAFÉ device during a specific hour.
  7. Winners will be announced on the 17th of April 2015.
  8. Participants stand a chance to win the abovementioned prizes (the “Prize”) subject to the following conditions:
    i. the Promoters decision is final and no correspondence will be accommodated on any matter relating to the awarding of the Prize, the Prize content or any other related matter;
    ii. any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws; and
    iii. the winner must be willing to sign all indemnities and meet all requirements to redeem the Prize.
  9. The Prize is non-transferable.
  10. The Promoters reserve the right to substitute the Prize with another of greater or equal value.
    EXCLUSIONS AND OTHER IMPORTANT TERMS
  11. These Terms and Conditions contain certain provisions which appear in similar text style to this clause and which:
    i may limit the risk or liability of the Promoters or a third party;
    ii may create risk or liability for the participant;
    iii may compel the participant to indemnify the Promoters or a third party; or
    iv serves as an acknowledgement, by the participant, of a fact.
  12. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Panellist or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  13. The participant acknowledges that by submitting his or her entry to the Competition he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.
  14. All participants to this Competition participate entirely at their own risk. By reading and accepting these Terms and Conditions, the participant gives consent to these risks and hereby indemnifies and holds harmless Student Village, Nestlé and Publicis; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.
  15. The Promoters reserve the right to amend these Terms and Conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
  16. By entering the Competition in accordance with its terms, participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
  17. The names of the winners will be published on the Promoters' websites subject to the winners consent.
  18. Winners may be requested to take part in the Promoters' publicity campaigns or to allow their names to be used by the Promoters for promotional purposes. Winners are, however, entitled to decline such request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the promoter.
  19. The Promoters shall conduct the Competition, and the Promoters’ decision on any matter related thereto, including the selection of winners is final and no correspondence will be accommodated in respect thereof.
  20. The Promoters reserve the right to vary these Terms and Conditions by providing notice of such change on the Nestlé website (www.nestle.co.za). Any queries in this regard, and a copy of these Terms and Conditions can be found at the above website or by calling 086 009 6116 during office hours (Monday to Friday 08h30 – 16h30), throughout the period of the Competition.
  21. The Promoters reserve the right to circulate the participants’ personal information for purposes of this Competition and the participants, by electing to participate in this Competition hereby irrevocably and unconditionally consents to the distribution of its personal information for the purposes contemplated herein.
  22. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

    NIDO 3+ Stimulean promotional competition rules

    1. This promotional competition is organised by Makro (Masstores (Pty) Limited, trading as Makro SA (registration number: 1991/006805/07)) and Nestle (South Africa) (Pty) Limited, registration number (1916/001498/07) (‘the promoter/s’).
    2. The competition commences on 18 March 2015 and ends on 1 April 2014.
    3. For the purpose of this competition “customer” or “you” means the natural person, whose name, contact telephone number and South African Identity number are reflected on the Makro SAP Customer Relationship Management system ("SAP CRM 7 system") at the time of the draw and whose details are attached to the Makro card used to purchase the product of the participating brand (Nestle Nido 3+ 1.8 Kg) from Makro.
    4. All commercial customers must take note of the fact that the prize will be awarded to the natural person as stipulated in these rules and that the prize will not be awarded to any legal entity. It is therefore the customer’s obligation to ensure that the correct people’s details are recorded on the SAP CRM 7 system to represent the legal entity.
    5. Entry into the competition is automatic, using your details and the actual purchasing data on the Makro SAP CRM 7 & BI systems and you will be entered provided that:
      • 5.1 you are a natural persons over the age of 18;
      • 5.2 you are in possession of your valid South African ID book;
      • 5.3 your complete, accurate and up to date name, contact telephone number and South African identity number are captured and appear on the Makro SAP CRM 7 system;
      • 5.4 you identification can be verified through their South African identity book;
      • 5.5 you are not a director, member, partner, employee, agent or consultant to Makro or Nestle, or any marketing service provider in respect of the promotional competition or any other person who directly or indirectly controls or is controlled by the promoter/s or suppliers of goods or services in connection with this competition, or the spouse, life partner, parent, child, brother, sister, business partner or associate of such a person;
      • 5.6 it is not unlawful to supply the prize to you in terms of any legislation or public regulation and Makro reserves the right to require prove that it will not be unlawful to supply a prize (for example to request the winner of a TV to provide his TV license to Makro before they can hand over the prize).
    6. Your entry into the competition means that you agree and understand that you will stand a chance to win a prize only and that there is no guarantee that you will be receiving any prize.
    7. You will be entered into the draw when you purchase Nido3+ 1.8kg during promotional period.
    8. There will be 3 winners of Apple Mini iPads.
    9. The winner/s will be randomly selected from eligible entrants for the relevant period, one week after the closing date of the competition. An independent third party will select the winner(s).
    10. If the competition entails a prize for each store and there are no entries for a particular store, a second winner will be selected from the store with the most entries.
    11. Although we have taken care to make sure that the prize/s is/are of a good quality, we do not give any warranties about the prize/s and you agree to accept the prize/s “as is”. Subject to applicable law, you also indemnify us against any damages that anyone may suffer as a result of the prize/s or this competition, including consequential and economic loss.
    12. The purchase price, excluding VAT and excluding the price of any returns of qualifying products as reflected in the Makro SAP BI system will be utilised to determine the consumer’s expenditure for purposes of entering the competition.
    13. The consumer’s entry will be withdrawn if any goods purchased in connection with the competition be returned by the consumer.
    14. Subject to these rules, the person/s whose Makro card number is drawn and whose details appear on the SAP CRM 7 system against that card number, will be the winner/s of the prize, provided that the person/s was/ were eligible to enter into the competition in terms of clause 5.
    15. It is your responsibility to ensure that your personal contact details captured on the SAP CRM 7 system are complete, accurate and up to date.
    16. The winner/s of the prize/s will be notified by Makro on the contact details on the SAP CRM 7 system recorded against the selected card number within 2 weeks of the competition closing date. Once the winner/s has/have been contacted, their details will be published on the Makro website. If the contact number on the SAP CRM 7 system does not exist or does not belong to the chosen winner/s, a new winner will be redrawn immediately under the same conditions. If the winner/s contact number/s is/are repeatedly engaged, just ring/s or go/es to voicemail, Makro may in its discretion re-draw a new winner.
    17. The winner/s of the prize/s must collect their prize/s from a Makro store, at a time arranged with the Makro representative, within one month of being notified, failing which they will forfeit the prizes, and in which event, Makro reserves the right to re-draw a new winner .
    18. The value of the prize includes VAT, and the goods will be given to the winner at the ruling price which is available to any customer on the day that they are rung up at the till.
    19. In order to be eligible to win a prize, customers must not have issued dishonoured cheques, or have overdue payments due to Makro at the time of the draw.
    20. Any costs or expenses incurred in respect of items not specifically included in the prize/s are for the winner’s own account. Makro and it’s associates if applicable, will not be responsible for any other expenses which the winner/s may incur as a result of their acceptance and/ or use of a prize, whether foreseen or not.
    21. The prize/s is/are not transferrable and may not be deferred, changed or exchanged for cash or any other item.
    22. To the extent that any taxes, duties, levies or other charges may be levied on a prize by the State or any other competent government or regulatory body, the winner/s will be liable therefore, and Makro will not increase the value of the prize/s to compensate for such charges.
    23. The winner/s name, card number and town/city will be published on the Makro website and other media. Makro may also decide to publish the winner’s image or require that the winner participate. The winner/s may also be required to have their image published and/or to participate in marketing activities, but the winner may refuse both of these from happening.
    24. Makro reserves the right to vary, postpone, suspend, or cancel the competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which Makro reasonably deems necessary.
    25. In the event of a dispute, the decision of the competition judges is final and binding and no correspondence will be entered into.
    26. If the winner/s fail/s to comply with any of these rules or the terms of acceptance of the prizes, or if they refuse to sign the Makro winner/s declaration or the Makro winner/s prize acceptance form, this will be construed as a rejection of the prize and then, without prejudice to any other remedy which Makro and its associates may have, the winner will be automatically disqualified and will forfeit the prize.

    6. Participants may enter the competition as many times as they wish over the promotional period, provided that participants purchase the participating products each time, subject to the following conditions:

The winner of the prize must be one of the travellers on the holiday.
      8.3. If the holiday prize is not redeemed by the 31 December 2015 it will be forfeited.
    9. There are also R500 daily cash prizes to be won:
      9.1. The following process will be followed to redeem cash prizes: the winners will be notified instantaneously via 2 x SMS's – one from TMARC confirming the fact they have won; one from ABSA within 48 hours. The TMARC SMS will confirm the amount and an Authorisation PIN of 6 digits. The ABSA SMS will confirm the 10 digit Withdrawal Access number as well as the amount. Winners go to any ABSA ATM, push CASHSEND Option and follow the prompts. Both the Authorisation PIN and the Withdrawal Access number are required to complete the transaction.

    14. The judges' decision is final, and no correspondence will be entered into.
    15. No substitution or cash redemption of non-cash prizes is permitted. Prizes are not transferable.
    16. It is expected that people will enter on a phone that is owned and registered to that person. No other person can use another person’s phone for competition entry purposes. This is to avoid fraud and possible litigation between the phone owner and the entrant.

    By participating in the NESCAFÉ® Dolce Gusto® Database giveaway, entrants agree to the rules set out below

    This competition is limited to residents of South Africa, and with the exception of the following people:
    1.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) (Pty) Limited and organisers of the Competition.
    1.2. people who are not legal residents and/or legal citizens of the Republic of South Africa;

    1. By entering into the NESTLE NESPRAY Win a SAMSUNG S4 Mini PROMOTION, entrants agree to the rules
      set out below.
    2. This competition is open to all residents or citizens of Namibia, Swaziland, Lesotho or Botswana over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering).     7. The prize winners will be notified telephonically.     By participating in the Nestlé KitKat Competition, entrants agree to the rules set out below:
    1. By entering the Nestle Kit Kat Competition, entrants agree to the rules set out below.
    2.     7. One hundred and one (101) winners will be selected in total:
      7.1. One hundred winners will be drawn between the 10th of February and the 30th of April 2015, and each winner will receive R2 000 cash prize.       7.3. The Grand prize winner is only allowed to use the Travel Agent given by Nestlé, and may not use their own agency.
      7.4 Should anything happen to the winner and/or his or her other party members on their trip, Nestlé will not be held responsible, as the winner accepts the trip at their own risk.
      7.5. If the Grand Prize winner wishes to extend their trip, this will be at his or her own cost and not of Nestlé. 7.6. The Grand Prize winner will be contacted telephonically between 21 May 2015 and 4 June 2015. Should the winner not respond to a telephone call within 48hours with all details that need to be submitted, the person will forfeit their winnings and the prize will go to a runner up.       7.8. The Grand Prize winner will need to submit proof of identity in the form of an identity document/ passport/ driver’s licence and till slip as proof of purchase before they redeem the prize.
      7.9. The Grand prize cannot be exchanged for cash.
    8. The promoter is not liable for the failure of any technical element relating to this competition that may result in an entry not being successfully submitted.
    9. The following process will be followed to redeem the Grand Prize: the prize winner will be notified telephonically. Upon receipt of the call, the winner will be required to provide his/her email address (if available) and his/her ID number to a representative from Nestlé (South Africa) (Pty) Ltd.     NESPRAY WIN A SHARE OF R1 000 000 PROMOTION TERMS AND CONDITIONS

    1. By entering into the NESPRAY WIN A SHARE OF R1 000 000 PROMOTION, entrants agree to the rules set out below.
    2. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
    3. Participants or entrants younger than 18 years must have the consent of their parents or legal guardian. The prizes will only be released to the winners’ parent or guardian.
    4. The Competition will commence on 15 January 2015 and end on 15 April 2015. No entries received after midnight on 15 April 2015 will be considered.

Dial *120*304050# to enter the last four digits of a participating barcode and follow the prompts for qualifying questions which may include an ID number (or part thereof) and answers to simple questions about NESPRAY. The participant will then be entered into the competition. Do not SMS to this number.
      5.1. The product mentioned above may be purchased at any store in South Africa.
      5.2. USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning. Entrants are only eligible to win ONE of the 50 cash prizes.
      5.3. Winners may be requested to provide proof of purchase.
    6. The draw will take place on 30 April 2015 at the Nestlé Head Office in Bryanston.
