Competition Rules

By entering into the Nestlé Bar One® and Kit Kat® Aero®, Tex®, Smarties® Competition, entrants agree to the rules set out below.

This competition is limited to residents of South Africa, with the exception of the following people:
2.1 directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) (Pty) Limited and organisers of the Competition.
2.2 people who are not legal residents and legal citizens of the Republic of South Africa;
2.3 spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above; and
2.4. persons under the age of 12 years.

Winning entrants can win:
• One of 20 000, airtime vouchers valued at R5-00 each; or
• One of 100 000 airtime vouchers valued at R 10-00 each; or
• One of 18 000 airtime vouchers valued at R 20-00 each; or
•One of 1 000 airtime vouchers valued at R 40-00 each.

The competition starts : 1 June 2013 and ends on 31 August 2013. No entries received after 31 August 2013 will be considered.

Prize winners will be notified telephonically. The first 100 winners will be randomly drawn at the end of June, the second 100
winners end of July and the third 100 winners on 11 September 2013.

Winners will be announced on www.nestle.co.za after 11 September 2013.

Winners may be required (at no fee) to be identified and have their photographs published in print media, or to appear on radio and/ or television. However winners shall at all times be entitled to decline the above request. All publicity and other materials will be the sole property of the Nestlé.

All entrants must hold a valid South African identity document.

In order to claim the prize in the Competition, Winners may be required to submit a till slip which reflects the purchase made during the Competition.

All valid entries submitted will be eligible to win a prize.

At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé (South Africa) (Pty) Limited at which point he/she may be required to provide his/her ID and/or driver’s license to the Nestlé (South Africa) (Pty) Limited representative. The potential prize winner will also be required to provide his / her banking details in order for the prize money to be transferred into his / her account. At the time of the telephone call, the potential prize winner may also be required to answer several questions regarding his/her eligibility regarding compliance with these rules. Potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner - up finalist will be deemed the potential prize winner, subject to the terms and conditions herein.

If Nestlé South Africa, the organisers of the competition and the Promoters are unable to reach any of the potential prize Winners within 48 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such Winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

The judges’ decision is final, and no correspondence will be entered into.

No substitution or cash redemption of prizes is permitted.

When delivery is agreed, it is the responsibility of the Winner to avail themselves to sign for the prize. No one other than the prize Winner will be allowed to sign for the prize. The Winner will need to produce valid identification.

Should the Winner not be available at the times of delivery, a second attempt will be made to arrange and deliver the prize. Should the Winner not be available after the second attempt, the prize will be forfeited and an alternative Winner will be drawn.

Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules , he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.

Checkers Hyper/Nestlé - Competition Rules
- This promotional competition is organised by Shoprite Checkers (Pty) Limited and Nestlé (Pty) Ltd (collectively “Promoters”).
- The promotional competition is open to permanent residents and citizens of South Africa except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoters and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoters, their advertising agencies, advisers, dealers, suppliers and/or associated companies (“Disqualified Persons”).
- By entering the promotional competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this competition and the rules (within the confines of the Consumer Protection Act, 68 of 2008 (‘the CPA’)) and any prizes (which have not yet been subject to a draw), or any aspect thereof and it will be published on the website. Any such amended terms and conditions published in any media, or on the Promoters’ websites will form part of the terms and conditions of the Competition, to which terms the participants agree to be bound.
- The promotional competition commences on 13 May 2013 and ends on 16 June 2013 both days inclusive (the “Competition Period”).
- Participants stand a chance to win a share of R150 000.00 (One Hundred and Fifty Thousand Rand) cash in amounts of R25.00 (“Prizes”) to be won nationwide (the “Prizes”).
- To stand a chance of winning one of the Prizes, participants must purchase any of the following (two) 2 products: Ricoffy 250 and 750grams, Cremora 1 Kilogram, Hot Chocolate 500gram, Milo 500grams, and Nescaffé Classic 200 gram (“the Participating Products”) from any participating Checkers Hyper store (“Stores”).
- During the Competition Period, whilst at the Store till points paying for the Participating Products a computer system will randomly select a potential winning till slip (“Till Slip”) and the potential winners will be instantly notified on their Store Till Slip whether they won and can claim their Prize immediately at the point of the Cashier / Till point.
- The winning Till Slip will be retained by the Store cashier once the winner has been awarded the Prize.
- Participants may enter this promotional competition as many times as they wish provided they purchase the Participating Products from the Stores each time.
- Till Slips that are unclear, illegible or contain errors or from Disqualified Persons will be declared invalid.
- Should any dispute arise in relation to the interpretation of these competition rules, the Promoter’s decision shall be final and no correspondence shall be entered into
- Important Notice: All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this promotional competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the Prize.
- The Prize is not transferable. No substitution, cash redemption or assignment of the prize is permitted, but the organizers of the Competition reserve the right to substitute the prize with one of comparable value. - Terms and Conditions
- All persons entering the Pick n Pay smart shopper Competition ("the promotional competition") ("the entrants") agree that the competition rules as set out in these terms and conditions are binding on them. A copy of these terms and conditions is available at www.pnp.co.za.
- Important Notice
- These terms and conditions and competition rules contain certain terms and conditions which appear in similar text style to this clause and which:
- may limit the risk or liability of the promoter or a third party; and/or
- may create risk or liability for the entrant; and/or
- may compel the entrant to indemnify the promoter or a third party; and/or
- serves as an acknowledgement, by the entrant, of a fact.
- the entrant cannot be a juristic entity and must be an individual;
- The entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.
- Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the entrant or the promoter in terms of the Consumer Protection Act, 68 of 2008 ("the CPA").
- The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and the he/she understands and agrees to the terms and conditions.
- All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless Nestlé (south Africa) (Pty) Ltd, Pick n Pay Stores Limited and all entities in the Pick n Pay group; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
- Rules of the Competition
- This promotional competition opens on 24 May 2013 and closes at midnight on 30 June 2013. No late entries will be received thereafter.
- The prize:
- One Hundred (100) winners will each receive One hundred and fifty thousand (150 000) smart shopper points.
- Purchase any two (2) of the participating products and stand a chance to win your share of fifteen million (15 000 000) smart shopper points;
- Nestle Ricoffy 750g, Nestle Nescafe Classic 200g, Nestle Milo 500g, Nestle Hot Chocolate 500g;
- Prizes are not transferable and may not be exchanged for cash. However, the organisers of the competition reserve the right to substitute the prize with one of comparable value for any reason. Prizes will under no circumstances be handed over to a third party and will only be handed or transferred directly to the verified prize winner.
- In order to qualify as an entrant for this promotional competition:
- the entrant must be a legal citizen of the Republic of South Africa;
- the entrant must provide correct and full personal details, as required; and
- the entrant must be 18 years old or older.
- the entrant cannot be a juristic entity and must be an individual;
- The competition is open to all registered Pick n Pay smart shoppers
- The promoter, Pick n Pay Retailers (Proprietary) Limited and any entity in the Pick n Pay Group or Nestlé (South Africa) (Pty), their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.
- To enter the promotional competition, the entrant must:
- Purchase any two (2) Nestle Hot Beverages participating products and swipe their Pick n Pay smart shopper Card at the Pick n Pay till-point during the competition period to be automatically entered.
- Multiple entries are permitted but the prize will be limited to one per entrant.
- Selection of Winners
- 100 (One Hundred) winners will be randomly selected from all the entries. This will take place from the 3rd to the 5th July 2013.
- Potential Winners will be contacted telephonically within two weeks of the draw. Pick n Pay reserves the right to disqualify a potential winner if he/she does not respond to the telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. In the event that the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately. At the time of the telephone call, the potential prize winner may be required to answer several questions about his/her eligibility. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the Runner-Up Finalist. A potential prize winner is not an actual winner until his/her submissions are validated and his/her documents are completed and submitted to Pick n Pay. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
- Pick n Pay reserves the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay or Nestlé (South Africa) (Pty) Ltd or their advertising agencies, advisors, suppliers and nominated agents.
- General
- By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
- The names of the prize winners will be published on www.picknpay.co.za & www.nestle.co.za subject to the winners consent.
- Winners may be requested to take part in the promoter's publicity campaigns or to allow their names and likenesses to be used by the promoter for promotional purposes. Winners are, however, entitled to decline such a request.
- The promoter shall conduct the competition, and the promoter's decision on any matter related to the competition, including the selection of prize winners is final and no correspondence will be entered into.
- Nestlé, its promotional and advertising agents, merchandisers and organisers shall not be responsible for any subsequent decline of acceptance of prizes for any reason.
- The judges' decision will be final and binding and no correspondence will be entered into.

- By entering into the Nestlé Milo® Actv8 competition, entrants agree to the rules set out below
- SMSs charged at R1.50 each and no free airtime entries apply
- Competition runs from 06 April 2013 to 30 September 2013. No entries received after 30 September 2013 will be considered
- You may enter as many times as you wish
- Only entries with full details: child’s name; valid unique 13-digit bar code and the word ‘Milo’ will be eligible, and only as submitted by SMS to the correct line (33960)
- The competition is open to parents with children between the ages of 6-12
- This competition is limited to residents of South Africa, and with the exception of the following people:
