By participating in this competition, entrants agree to these rules.
  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (the “Promoters”)
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
  3. This Competition is limited to legal residents and/or citizens of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above.
    • 2.4. Persons under the age of 18 years.
  4. The Competition shall commence on 1 April 2018 and will end on 20 May 2018. No entries received after 20 May 2018 will be considered.
  5. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase any of the Nestlé Legends Minis products listed below during the promotional period and dial *120*64647*last4digitsofbarcode# and follow the prompts to stand a chance to win their share of R500,000 in cash prizes.

    • 4.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 4.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase a participating product each time and complete the competition entry, subject to the following conditions:
      • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 4.4.2. Only one prize per household and per person will be permitted;
      • 4.4.3. No computer-based entries will be accepted;
      • 4.4.4. Any mobile number that enters an incorrect unique code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional Competition (“Blocked Participants”)
    • 4.5. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    • 4.6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the participant(s) will be requested to refund the prizes to promoters.
    • 4.7. The cellphone number is key to all entries. If the participant has won on a cellphone number, they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  6. The Prize:
    Participants in this Competition stand a chance to win one (1) of Fifty (50) cash prizes of R10,000 each. Winners will be determined by random draws on the following dates at Nestlé’s offices in Bryanston:
    • 9 April 2018: (6 cash prizes to be drawn);
    • 16 April 2018 (7 cash prizes to be drawn);
    • 23 April 2018 (7 cash prizes to be drawn);
    • 30 April 2018 (8 cash prizes to be drawn);
    • 7 May 2018 (8 cash prizes to be drawn);
    • 14 May 2018 (7 cash prizes to be drawn);
    • 21 May 2018 (7 cash prizes to be drawn);
  7. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters’ representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. The potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up chosen.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. The winnings will be transferred to an eligible winner’s bank account via EFT provided they send a certified copy of their bank statement proving the bank account is in the name of that eligible winner.
  8. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require each winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.13. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.14. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

By participating in this competition, entrants agree to these rules.
  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with ARC, a Division of MMS Communications South Africa (Pty) Ltd (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
  3. This Competition is limited to legal residents and/or legal citizens of South Africa who are parents of children between the ages of 3 to 5 years old. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above.

  4. The Competition shall commence on 26 March 2018 and will end on 8 April 2018. No entries received after 8 April 2018 will be considered.

  5. Mechanics
    To participate in this Competition, Participants must comment on the Facebook competition post on the NIDO South Africa Facebook page by submitting an image of themselves when they were younger and an image of their child at a similar age.

  6. The Prize:
    Participants in this Competition stand a chance to win the following:
    • A photoshoot featuring the parent and their child (only one child will be allowed) valued at R10,000.

  7. How to claim your prize:
    • 6.1. One winner will be selected by a panel consisting of the Nestlé NIDO brand team, a representative from Nestlé legal and Nestlé NIDO production partners. The winner selection will take place within 2 weeks of the competition closing date.
    • 6.2. At the time that a potential prize winner is identified, the potential prize winner will receive a message in their Facebook inbox requesting their cellphone number. After providing their cellphone number to the Promoters’ representative, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility, and he/she will be requested to provide certain documents such as a copy of his/her ID and/or driver’s license to the Promoters’ representative.
    • 6.3. The potential prize winner will have to be a parent with a child between 3 – 5 years of age. Parents with children who have already turned 6 years old or older will not be eligible to win.
    • 6.4. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.5. If the Promoters are unable to reach a potential prize winner after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.6. The eligible winner will be contacted by a representative of the Promoters with regards to the specific details of the photoshoot, i.e. date, place and time of the photoshoot.

  8. General

    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.     • 7.3. Participants, including the parent and child, may be required to be available for a video production and shoot that will be held in Johannesburg. Participants are entitled to decline the above request. Participants that take part in any publicity campaign (including the video production and shoot) will not be entitled to any payment or other remuneration for such publicity campaign or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.4. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.

By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10.     • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. The Prizes
  • Participants entering the competition stand a chance to win 1 of the following prizes:

The Draws
  • Winners for the following prizes will be determined by random draws that will take place at TMARC’s offices in Bryanston:

  • Weekly Cash Prize Draws will take place from Monday 12th March 2018 and will conclude on Tuesday 01st May 2018.

How to claim your prize:
  • At the time that a potential prize winner is identified and contacted he/she will be requested to submit certain documents such as their original and unique proof of purchase (receipt/till slip), dated and timed before their entry date and time , and a copy of his/her ID document to the Nestlé representative upon request. The slip is not to be written on or tampered with in anyway.
  • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Nestlé representative. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and another winner will be selected subject to the terms and conditions herein.
  • The winner will be allowed 72 hours to provide the requested documents as listed above and any other item’s the promoter requests.
  • Once verified the winner is to provide their preferred delivery address in writing (for weekdays only) or bank account details (as applicable). The promoter is not responsible for any unsuccessful delivery due to the incorrect delivery address being provided.
  • Winners are to allow 15 working days for their prize delivery from when their proffered delivery address is confirmed.
  • Any additional expenses arising from accepting and using the prize will be for each winner’s own account once they have signed for their delivery (this includes any insurance and VISA application costs for the products not mentioned above)

General

    • 4.3 Wholesaler Competition – Share of R80 000 (South Africa only)
      • 4.3.1 To participate in this competition, participants must adhere to the following: spend R200 or more one of the participating Nestlé NIDO 3+, CERELAC or NESTUM products at participating retailers in South Africa during the promotional period and upload a picture of their till slip to the following dedicated WhatsApp competition line: 064 914 5835.
      • 4.3.2 The Prize:
        Participants will stand a chance to win their share of R80,000.00 in cash (in this regard, there is a total of 4 cash prizes of R20 000 each to be won).
      • 4.3.3 How to Claim your Prize:
        At the time that a potential prize winner is identified, the potential prize winner will receive a WhatsApp message, which shall contain a pin code and a telephone number which the potential prize winner should call to redeem their prize. During this telephone call, the potential prize winner may be required to present his/her pin code, answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Nestlé representative.

        • 4.4.2 The Prize
          Participants will stand a chance to win airtime to the value of R10.
        • 4.4.3 How to Claim your Prize
        • 4.4.3.1 Participants will be informed whether they are a winner or not by receiving an SMS back asking them to reply back with their selected Airtime provider of their choice.
        • 4.4.3.2 Participants are only able to enter this competition once a month.
        • 4.4.3.3 Participants may only win once during the promotional period.
  6. General
    • 5.1 The judges’ decision is final, and no correspondence will be entered into.
    • 5.2 Nestlé may require the winners to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should a winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited.     • 5.8 Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participants or the promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 5.9 All participants participate entirely at their own risk. By reading and accepting these Rules, the participants give consent to these risks and hereby indemnify and hold harmless the Nestlé and the promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of Nestlé or any of the other promoters.

    • 5.12 Nestlé reserves the right to terminate or extend the competition at any time.     • 5.13 By entering the competition, participants acknowledge that the competition will be managed in accordance with the provisions of the CPA.   6. How to claim your prize:

By participating in this promotion, entrants agree to the rules set out below.

 

  1. By entering into the NESPRAY Q1 2018 BACK 2 SCHOOL CONSUMER COMPETITION RULES, entrants agree to the rules set out below.
  2. Eligible participants stand a chance to win their share of R1,025,000 in prizes. There will be
    • 5000 X R5 airtime vouchers
    • 100 x R10,000 cash prizes
  3. The cash prizes are intended as daily prizes over the campaign period; the first randomly selected finalist with a valid entry will be eligible for the daily cash prize. Airtime prizes will be available to everyone entering the competition via the USSD mechanic.
  4. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestle, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestle, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  5. Participants or entrants younger than 18 years must have the consent of their parents or legal guardian. The prizes will only be released to the winners’ parent or guardian.
  6. The Competition will commence on 26 December 2017 and end 31 March 2018, both days inclusive. No entries received after midnight on 31 March 2018 will be considered.
  7. To participate in the Competition, each participant must:
    Purchase any pack of NESPRAY or NESPRAY Tummy Ease, dial *120*304050# and follow the prompts for qualifying questions which will include entering the last four digits of the barcode found on the product packaging, an ID number (or part thereof) and answers to simple questions about the participant or his/ her family. The participant will then be successfully entered into the competition. Do not SMS to this number.
    • The product mentioned above may be purchased at any store in South Africa.
    • USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning.
    • Due to network restrictions, the USSD session will timeout after 120 seconds. If a consumer successfully enters the barcode before the session times out, their entry will be considered valid.

  8. Random draws will determine the daily prize prize winners.
  9. The prize winner will be notified telephonically on the number used to enter the competition. Upon receipt of the call the potential prize winner may be required to provide his / her email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s licence to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility and may be required to provide proof of purchase. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. This is to avoid fraud and ensure compliance to the CPA.
  12. Each entrant is expected to be the owner of that phone and no singular person can enter off another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
