  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the Rules).
    • 1.2. Participants are encouraged to review the Rules before entering the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (Nestlé) in conjunction with Vetro Media (the Promoters).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this promotion, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
    • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.4. Persons under the age of 18 years.

  3. 3. The Competition shall commence on 20 September 2018 and will end on 30 September 2018. No entries received after 30 September 2018 will be considered.

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants are required to purchase any Nestlé KLIM or COCOA product at any participating store in South Africa. Participants are required to Dial *120*1065# and follow the prompts. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (free minutes do not apply).
    • 4.2. Participants may enter the competition 7 times within a 7-day period over the promotional period, provided that Participants purchase a participating product each time and complete the competition entry mechanism and enter a new barcode, subject to the following conditions:
      • 4.2.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 4.2.2. Only one prize per household and per person per day of the promotion will be permitted i.e. within the same family or immediate family residing in the same abode unless proof of purchase can be obtained.
      • 4.2.3. No computer-based entries will be accepted.
      • 4.2.4. It is reasonably expected that each entry will represent a purchase you have made of the brand and hence an example 3 entries may result in the requirement to produce 3 till slips.
      • 4.2.5. There is a maximum entry limit per participant per week which cannot exceed 7 times within a 7-day period.
      • 4.2.6. For draw based rewards, till slips for each entry may be required.
      • 4.2.7. Any mobile number that enters an incorrect barcode code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional Competition (Blocked Participants).
    • 4.3. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 - 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.

  5. The Prize:
    Participants in this Competition stand a chance to win their share of airtime and/or 1 of 25 cash prizes of R200 each. The winners of the cash prizes will be determined by random draw. The draw for the cash prizes will only take place from 20 to 24 September 2018 and there will be 25 winners drawn in total (5 winners per day).

    Winners of the Airtime prizes will receive an instant notification of the value of the airtime they have won on the entering cellular phone number. Airtime prizes may only be redeemed by PRE-PAID and Top Up account holders only. Airtime is available for the following Networks – Vodacom / MTN / Cell C and 8ta. The airtime voucher code will be automatically loaded on their prepaid cellular phone number used to enter into the competition. All potential winners who entered this competition using a fixed/closed contract line will be required to send through an alternative prepaid number to which the airtime voucher code should be loaded.

  6. How to claim your prize
    • 6.1. At the time that a potential cash prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit a copy of his/her ID and/or driver's license to the Promoters representative. Should a potential prize winner not submit a copy of his/her ID and/or driver's license, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements or fails to submit the required documents to the Promoters, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation. Once the participant's details have been validated, payment of R200 will take place within 7 days. Winners will be paid via the FNB eWallet using the below method.
    • 6.5. Once the participant's details have been validated, payment of R200 will take place within 7 days from the date of successful validation of the details. Winners will be paid via the FNB eWallet using the below method:
      Note: Winning participants must please ensure that they are close to an FNB ATM (less than 30 minutes away) before proceeding with the following steps as the ATM PIN will expire after approximately 30 minutes. A new ATM PIN can be requested after expiry of the first one should you not make it in time.
      • (a) You will receive an SMS advising that money has been sent to your cell phone. You will need to request an ATM PIN by following the below steps.
      • (b) Dial *120*277# to access the eWallet;
      • (c) Select 'Withdraw cash' and then 'Get ATM PIN';
      • (d) You will receive an SMS with an ATM PIN;
      • (e) At the FNB ATM press the green button (enter/ proceed) on the keypad OR select Cardless Services;
      • (f) Select eWallet Services;
      • (g) Key in your cell phone number and select Proceed;
      • (h) Key in the eWallet ATM PIN you requested and received via SMS;
      • (i) Choose the applicable cash amount;
      • (j) Make sure that either your transaction has ended or that you press 'cancel' before leaving the ATM.
  7. General
    • 7.1. The judges' decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found not to have complied with these Rules, he/she will automatically be disqualified, and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. A prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prizes with any other prizes of comparable or greater commercial value for whatever reason.
    • 7.5. Product images depicting the prizes are for illustrative purposes only and may differ from the actual prizes.
    • 7.6. By entering this Competition, you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com OR dial or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé's privacy policy.
    • 7.7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall always be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, each Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters' obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  5. The Prize:
    Winners of the Competition will receive 1 of 10 Nestlé Professional coffee machines for their workplaces for use for either 1 month from date of delivery of the machine to their workplaces or until the coffee products loaded on the machine on date of delivery run out (whichever occurs earlier).

  6. How to claim your prize
    • 6.1. Winners will be selected by random draw throughout the Competition period.
    • 6.2. At the time that a potential prize winner is identified, the potential prize winner will receive an inbox message in their Facebook Account or in their LinkedIn Account (as the case may be) from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents and a copy of his/her ID and/or driver’s license to the Promoters’ representative.

    • 4.2. Forecourts Activations Promotion Mechanics:
      • 4.2.1. To participate in the forecourts activations redemption, Participants must purchase any Nestlé CREMORA FROTHY product from any of the following forecourt stores on the dates specified below:

In the event that the express-manicure stations are fully occupied at the time that the participant wishes to redeem their express-manicure, the participant can return later in the day with their ticket in order to redeem their express-manicure. The express-manicures can only be redeemed on the date the product is purchased, within dates specified above in respect of each forecourt, within mall operating hours and such express-manicures are subject to availability of nail technicians (on a first come, first served basis) at the time that a particular participant wishes to redeem their express manicure.

  5. The Prize:
    • 5.1. Digital Promotion Prizes:
      Participants in the digital promotion stand a chance to win: 1 of 50 Sorbet vouchers worth R1000 each.
    • 5.2. Forecourts Activations Promotion Prizes: Participants in the forecourts activation stand a chance to experience an express manicure to be redeemed within dates specified above in respect of each forecourt, within mall operating hours. In order to qualify for the experience, participants will be required to produce their proof of purchase of the participating product to the Promoters’ representative on site at the relevant forecourt.

  6. Winner validation in respect of the digital promotion:
    • 6.1. Winners of the digital promotion will be selected weekly by random draw.
    • 6.2.   5. How to claim your prize:

    • Thereafter, the participant must write his/her name and contact number on one of the entry forms available in store and place it in the relevant entry form box provided in the relevant store.
    • Participants may enter the competition as many times as they wish over the promotional period, provided that they comply with the mechanics set out in 3.1 and 3.2 each time they wish to enter the competition.
    • The winners will be determined by random draw within two weeks after the date of closure of the competition (this date is subject to change without notice). The draw will take place at each participating store, and will be conducted by a Nestlé representative at each store.
  4. The Prize:

  1. This competition is only open to legal residents and/or legal citizens of South Africa. In addition, the following people shall not be eligible to participate in this competition:
    • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé and the organisers of the competition;
    • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above;
    • People who are not legal residents and/or legal citizens of the Republic of South Africa;
    • Persons under the age of 18 years.
  2. The competition shall commence on 15 September 2018 and will end on 30 October 2018 (the “promotional period”). No entries received after 30 October 2018 will be considered.
  3. Mechanics
    • To participate in this competition, participants must purchase any 1 (one) of the following Nestlé products from any store in South Africa during the promotional period and retain their till slips as proof of purchase:
      • MAGGI LAZENBY 125ml;
      • MAGGI LAZENBY 250ml;
      • MAGGI LAZENBY 500ml;
    • Thereafter, participants must dial *120*7837*last4digitsofbacode# and follow the prompts. Upon completing this process, the participant will receive an automated USSD response that they have been entered into the prize draws. Participants are required to note that USSD entries cost 20c for 20 seconds, and that free SMS’s or minutes do not apply. In addition, participants are required to note that incomplete entries may be billed by their service provider, and that Nestlé shall not be responsible for telecommunication failure on the part of the participant’s service provider.
    • Winners will be determined by random draws throughout the promotional period and potential winners will be contacted telephonically by Nestlé or its representative (and potential winners will be required to complete the process set out below).
  4. The Prize:
    • Participants entering the competition stand a chance to win prizes coordinated through a weekly draw. There will be a total of 100 x Le Creuset vouchers worth R2500 each.
    • Participants may only win one weekly prize of a Le Creuset voucher worth R2500 throughout the promotional period.
    • Only one prize per household will be permitted.
    • Nestlé reserves the right, at its sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
  5. How to claim your prize:
    • At the time that a potential weekly prize winner is identified, the potential prize winner will receive a telephone call from Nestlé or its representatives or agents. During the call the potential prize winner will have to answer a few questions regarding his/her eligibility, and will be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Nestlé representative/agent.
    • If a participant cannot be reached after 3 (three) attempts made within 3 (three) working days of Nestlé or its representatives or agents trying to contact them, the prize will be forfeited and another prize winner/finalist will be selected in accordance with the competition rules via a random draw.
    • The potential weekly prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential weekly prize winner does not meet the eligibility requirements or fails to submit the required documentation within 48 hours of being requested to provide the documents, the prize will be forfeited and a runner up will be deemed the potential weekly prize winner subject to the terms and conditions herein.

  6. General
    • The judges’ decision is final, and no correspondence will be entered into. Nestlé and/or any of its agencies may refuse to award a prize to an entrant if there is suspicion of any irregularities or fraudulent activities.
    • Nestlé may require the winner to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules.   7. Potential Winner Validation
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
    • 7.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein.     • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    • 2. This Competition is limited to residents of South Africa, Lesotho, Swaziland, Namibia and Botswana only. In addition, the following people shall not be eligible to participate in this Competition:

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. The participants need to purchase a participating MAGGI 2 Minute Noodles 5 x 73g Mega Promotional Pack and look for a golden sachet in pack during the promotional period. The participating products for the purposes of this competition are the following MAGGI 5 x 73g packs:
      • 4.1.1. Chicken 5 x 73g;
      • 4.1.2. Beef 5 x 73g;
      • 4.1.3. Cheese 5 x 73g;
      • 4.1.4. Durban Curry 5 x 73g.
    • 4.2. Participants who find a golden sachet in the promotional MAGGI Mega 5 pack will find a winning pin code and the instructions to contact Nestlé’s agency (on the golden sachet) to claim their reward. There are a maximum of 100 golden sachets to be found.
    • 4.3. Participant will be required to contact Nestlé’s agency and quote the winning pin code. Each winning Participant who calls in will be sent a redemption form, which they will be required to complete and send back to the specified email address or fax number along with their proof of purchase, a copy of their valid identity document/ passport, validated bank details and a picture of the winning golden sachet.
    • 4.4. Once all correct required documentation has been received, Nestlé’s agency will organise a direct EFT of the R5000 cash prize into the winning Participant’s bank account. The payment will take place within 15 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency (for transactions within South Africa). For international transactions, payment will take up to 21 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency.

  5. The Prize
    • 5.1 There are 100 cash prizes of R5000 each to be won.
    • 5.2 Should a winning Participant reside outside of South Africa and require the EFT to take place into a foreign bank account, R5000 worth of foreign currency will be transferred into their bank account, and payment will take up to 21 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency. The value received by the winning Participant will be based on the exchange rate on the day of transfer.

  6. How to claim your prize:
    • 6.1. The prize winner has until 02/02/2019 to redeem the cash reward.
    • 6.2. The prize winner will be required to call into the concierge service centre to redeem their reward. The number will be supplied within the golden sachet.
    • 6.3. The Promoters and their agencies have the right to reject any participant suspected of fraudulent behaviour.
    • 6.4. Prizes may only be redeemed by the participant who entered the promotion and the reward is not transferable under any circumstance.
    • 6.5. Calls made into the call centre are charged at standard share call rates.

  7. General
    • 7.1. The Promoters reserve the right, in their sole discretion and to the extent permitted by law, to amend these Rules at any time. The Promoters may notify the Participants of any significant changes, however there is no obligation on the Promoters to do so and it remains the participants’ responsibility to check these Rules regularly on the website (www.nestle.co.za) and/or any other communications medium applicable.
    • 7.2. These Rules constitute an agreement between the Promoters and each Participant.
    • 7.3. To the extent allowed by law, these Rules set out the whole of the agreement between the Participant and the Promoters in regard to the subject matter hereof and there are no other agreements, guarantees or representations, either verbal or in writing, in regard thereto upon which the Participant is relying in concluding this agreement and the Promoters shall not be bound by any express or implied term, representation, warranty, promise or the like not recorded herein. This clause constitutes an acknowledgment of fact by the Participant. The Participant must ensure that the Participant reads the above clause carefully and ensure that this statement is true and correct as this will limit your rights to claim that these statements are not true and correct.
    • 7.4. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and the parties consent to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg, in respect of any proceedings arising out of or in connection with these Rules.
    • 7.5. Any provision in these Rules which is or may become illegal, invalid or unenforceable shall, to the extent of such prohibition or unenforceability, be ineffective and treated as having not been written and severed from the balance of these Rules, without invalidating the remaining provisions of these Rules.
    • 7.6. The Promoters reserve the right to correct any errors and omissions. These Rules will supersede any errors or omissions on any publicly communicated documentation or marketing material.
    • 7.7. The Participant agrees that the Promoters may send any notice or notification arising under and/or contemplated in these Rules by electronic mail or other electronic communication to your contact details provided to the Promoters.
    • 7.8. The Participants who are residents /citizens of South Africa are required to adhere to any South African Tax Laws linked to receiving the prizes. It is your responsibility as a Participant to adhere and do the necessary submission as and when applicable.
    • 7.9. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.10. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.11. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of Nestlé.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the Consumer Protection Act 68 of 2008 (“CPA”). Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Nothing in the Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the CPA.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist. In the event of termination of the Competition for any reason whatsoever, each Participant agrees to waive any rights that the Participant may have in terms of this Competition and acknowledges that the Participants will have no recourse against the Promoters, their agents and/or staff.

  8. Warranties and liability:
    • 8.1. To the extent allowed by law, each Participant agrees that the Promoters shall not be liable to that Participant or any other person or entity whatsoever in respect of any loss or damage:
      • 8.1.1. caused by or arising from any fact or circumstance beyond the reasonable control of the Promoters;
      • 8.1.2. which is consequential or incidental loss or damage;
      • 8.1.3. of whatever nature and howsoever arising from or in connection with your Participation and/or your use/consumption of the prizes;
      • 8.1.4. which is a result of any downtime, outage, interruption in or unavailability of the Call Centre or Website, attributable to any cause whatsoever, including (but not limited to) repairs and maintenance, any breakdown in any service provided by any communications service provider (including line failure) as well as by any external communications networks and/or networks of any internet service providers; and/or
      • 8.1.5. arising from a breach of any security system which may be implemented by the Promoters and/or any service provider to the Promoters.

  9. Indemnity
    • 9.1.1. To the extent allowed by law, the Participant hereby indemnifies and holds the Promoters free from liability for loss or damage of whatever nature and howsoever arising from your Participation and/or your failure to comply with any provision and/or obligation under these Rules. This clause constitutes an assumption of risk and/or liability by the Participant under which the Participant indemnifies the Promoter against certain liabilities and which may result in the Participant being liable for additional costs and liabilities.

  10. Privacy
    • 10.1. The Promoters will record all telephone calls made to and from the Call Centre. In the event that participation in the Competition is concluded via the Call Centre, such telephone calls will be recorded, as contemplated in the CPA, to constitute the record of the transaction concluded.
    • 10.2. Each Participant hereby expressly agrees that the Promoters may:
      • 10.2.1. Collect, receive, record, organize, collate, store, update, modify, retrieve, alter, consult, use, disseminate or obtain any of the personal information set out above;
      • 10.2.2. Use your personal information for the purposes set out above;
      • 10.2.3. Transfer your personal information to third parties in a foreign country where this is required for the facilitation of any transfers of information or where this is required for the purposes of delivery of the prizes.
    • 10.3. A Participant may request that the Promoters correct your personal information, should it come to your attention that the Promoters’ records are incorrect. Should the Participant wish to access your personal information or rectify it, please contact the Call Centre.
    • 10.4. In accordance with the Protection of Personal Information Act No.4 of 2013, the Participant may request the Promoters to review which of your personal information it holds and may request for the Promoters to delete such information, please contact the Call Centre. This clause limits and excludes obligations, liabilities and legal responsibilities which the Promoters will have towards the Participant and also limits and excludes your rights and remedies and places various risks, liabilities, obligations and legal responsibilities on the Participant.

By entering into the NESCAFÉ GOLD HUBBLE GOLD CARD COMPETITION, entrants agree to the rules set out below:
  1. This competition is limited to legal residents and/or legal citizens of South Africa, and specifically those residing in Pretoria, Johannesburg and Cape Town. In addition, the following people shall not be eligible to participate in this competition:

  3. Participants can participate in the competition by making use of the Hubble screens in selective Ubers limited to Pretoria, Johannesburg and Cape Town only during the competition period stated above.

  4. Participants must adhere to the following in order to enter the competition:
    • 4.1. Answer a question about the New Nescafé Gold correctly to participate in the game on the Nescafé Gold Tab on select Hubble Screens.
    • 4.2. Play the Nescafé Gold game: shuffle the tiles to complete the image in the shortest time possible.
    • 4.3. You can then restart if you are not happy with your time or submit your details if you are happy with your time.
    • 4.4. Once a time is submitted no restart may take place.
    • 4.5. You will be required to submit your name and email address.

  5. The top 5 shortest times during the competition period will win 1 of 5 Nescafé Gold Cards valued at R20,000 (twenty thousand rand) each that can then be used to experience events of your choice with 1 (one) friend subject to the following conditions:
    • 5.1. These events will be subject to availability;
    • 5.2. A Nestlé appointed agency will be the partner through which to claim event tickets once the winners have received the Nescafé Gold card.
    • 5.3. Winners will be notified within 14 working days after of the end of the competition.

  6. The potential prize winner is not an actual winner until his/her submission is validated, the verification questions answered to the satisfaction of the promoter and his/her documents are completed and submitted to the promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. Potential winners have 48 hours to submit the relevant documentation before forfeiting the prize.

  7.   13. The promoter, its directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the participants, or accept any liability for: (a) any inability by the participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

  14. The organisers of the competition reserve the right to cancel or postpone the competition at any time.

  15. Nestlé reserves the right to amend the terms and conditions at any time without any notice being given to the participants.

  7. How to claim your prize:
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
    • 7.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up chosen.
    • 7.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their mobile number being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or no answer, such a potential winner will be disqualified and a redraw will be executed.
    • 7.4. Eligible winners will have their prizes delivered, save for the vehicles and instant prizes, should a physical delivery be necessary. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at TMARC and may be collected by the validated winner.
    • General
    • 8.1. The judges’ decision is final, and no correspondence will be entered into.
    • 8.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 8.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 8.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 8.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 8.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 8.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ( "CPA").
    • 8.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 8.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 8.13. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 8.14. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.
