COMPETITION TERMS AND CONDITIONS

By participating in the Nestlé KitKat Competition, entrants agree to the rules set out below:
  1. By entering the Nestle Kit Kat Competition, entrants agree to the rules set out below.
  2. This competition is limited to adults 18 years and older who are legal residents of South Africa at the time of the promotion, with the exception of family members: Children of directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) (Pty) Limited; as well as adults who are not legal residents and/or legal citizens of the Republic of South Africa.
    2.1. NO PERSONS UNDER THE AGE OF 18 IS ALLOWED TO ENTER THIS COMPETITION.
  3. The competition runs from 1 February 2015 until 30 April 2015.
  4. How to enter:
    4.1. Buy any Nestlé Kit Kat product
    4.2. Dial 120*548528*and enter the last 4 digits of your barcode followed by # then press your call button. E.g. 120*548528*1234# press dial/call
    4.3. Entry costs 20c / 20 seconds as per USSD Entry. No free or bundled SMS’s apply
  5. All valid entries submitted will be fit to qualify for a prize.
  6. Daily Winners will be selected by means of a random draw by TMARC and the managing agency. The Grand Prize winner will be drawn by a Nestle representative, Nestle legal team/Auditor, TMARC and the managing agency.
  7. One hundred and one (101) winners will be selected in total:
    7.1. One hundred winners will be drawn between the 10th of February and the 30th of April 2015, and each winner will receive R2 000 cash prize. Cash will be redeemed via ABSA Cash Send at any ABSA ATM Countrywide. Winners will receive an SMS with their Cash Send Pin and 6 digit code. Go to any ABSA ATM, push the Cash Send button and follow prompts to withdraw the Cash.
    7.2. One (1) Grand Prize winner will be selected by means of a random draw, and will win a trip for 2 (two) worth R150 000. The R150 000 prize is inclusive of flights, visas, accommodation and R20 000 spending money. The winner may only go to the following holiday options which have been predetermined by Nestlé:
    • Island Holiday
    • Cruise Holiday
    • Paris Holiday
    7.3. The Grand prize winner is only allowed to use the Travel Agent given by Nestlé, and may not use their own agency.
    7.4 Should anything happen to the winner and/or his or her other party members on their trip, Nestlé will not be held responsible, as the winner accepts the trip at their own risk.
    7.5. If the Grand Prize winner wishes to extend their trip, this will be at his or her own cost and not of Nestlé. 7.6. The Grand Prize winner will be contacted telephonically between 21 May 2015 and 4 June 2015. Should the winner not respond to a telephone call within 48hours with all details that need to be submitted, the person will forfeit their winnings and the prize will go to a runner up. The grand prize winner will be published on the Kit Kat website www.kitkat.co.za, Twitter @KitKatSA and Facebook: KitKatSA on the 30th of June 2015.
    7.8. The Grand Prize winner will need to submit proof of identity in the form of an identity document/ passport/ driver’s licence and till slip as proof of purchase before they redeem the prize.
    7.9. The Grand prize cannot be exchanged for cash.
  8. The promoter is not liable for the failure of any technical element relating to this competition that may result in an entry not being successfully submitted.
  9. The following process will be followed to redeem the Grand Prize: the prize winner will be notified telephonically. Upon receipt of the call, the winner will be required to provide his/her email address (if available) and his/her ID number to a representative from Nestlé (South Africa) (Pty) Ltd. A potential prize winner is not an actual winner until his/her submissions are validated and his/her documents are completed and submitted to Nestlé (South Africa) (Pty) Ltd. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  10. The Grand Prize winner will need to provide a DAY time contact number and produce their South African ID via email to receive their prize.
  11. The outcome of the random draw will be final and no correspondence will be entered into.
  12. The Grand Prize is not transferable. No substitution, cash redemption or assignment of Grand Prize is permitted, but the organisers of the competition reserve the right to substitute the prizes with one of comparable value for any reason. Prizes will under no circumstances be handed over to a third party and will only be handed or transferred directly to the verified prize winner.
  13. All winners will have a period of 12 months to redeem their prizes, from the day the winners have been announced. If the winner fails to redeem their prize after a period of 12 months, the winner will forfeit their prize.
  14. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication.
  15. The winner or participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the promoter.

Nestle Bake With Love Competition

  1. By entering into the NESTLE BAKE WITH LOVE COMPETITION, entrants agree to the rules set out below.
  2. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). However, the following persons are not eligible to enter: directors; members; business partners; employees; sales agents; advertising agency staff; advisors; or consultants of Nestlé, its associated companies, service providers and the immediate family members of these persons (including their spouses, life partners, parents, children, brothers and sisters) and any other person who is controlled directly or indirectly by Nestlé, as well as the associated companies of entities or persons mentioned in this paragraph, including holding companies and subsidiaries, their employees, agents, subsidiaries and consultants.
  3. The Competition will commence on 1 June 2015 and end on 31 July 2015. No entries received after midnight on 31 July 2015 will be considered.
  4. To participate in the Competition, each participant must:
    1. Purchase any 2 (two) of the following Nestlé products:
      1. NESTLE COCOA (62.5g; 125g or 250g tins)
      2. NESTLE SWEETENED CONDENSED MILK
      3. NESTLE GOLD CROSS SWEETENED CONDENSED MILK
      4. NESTLE IDEAL EVAPORATED MILK
      5. NESTLE LOW FAT IDEAL EVAPORATED MILK
      6. NESTLE TREAT CARAMEL
      7. NESTLE DESSERT CREAM (290g or 155g tins)
    2. Purchase any 1 (one) of the following Nestlé products:
      1. NESTLE KLIM (250g sachet; 400g tin; 500g sachet; 900g tin or 1.8kg tin).
    3. The products mentioned above may be purchased at any store in South Africa.
    4. Participants must purchase any two of the above products and SMS the last four digits of a barcode from any one of the purchased products to 34449.
    5. Each SMS costs R1. Free SMS’s do not apply.
  5. The draw will take place on 15 August 2015 at Nestlé’s Head Office in Bryanston.
  6. The first twenty winners randomly selected will each win a Kenwood Mixer(the colour of the mixer could be different to that on the promotional advert) to the value of R1000.
  7. The prize winners will be notified telephonically. Upon receipt of the call the potential prize winner may be required to provide his / her physical address for the prize to be delivered to their home / work place, email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s license to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist. Potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé (South Africa) (Pty) Limited. In the event of non-compliance with these terms and conditions by the potential prize winner, the prize will be forfeited and the runner-up finalist will be deemed the potential prize winner subject to all conditions herein.
  8. Winners will be required to produce their till slip in order to claim their prize. Should the winner not have a till slip, the prize will be forfeited and awarded to the runner up.
  9. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  11. The prize is not transferable. No substitution or assignment of prize is permitted, but the organisers of the Competition reserve the right to substitute the prize with one of comparable value if required.
  12. The judges’ decision is final, and no correspondence will be entered into.
  13. When delivery is agreed, it is the responsibility of the winner to avail themselves to sign for the prize. No one other than the prize winner will be allowed to sign for the prize. The winner will need to produce valid identification.
  14. Should the winner not be available at the time of delivery, a second attempt will be made to arrange and deliver the prize. Should the winner not be available after the second attempt, the prize will be forfeited and an alternative winner will be drawn.
  15. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  16. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com.
  17. Winners may be required to appear on television or radio, in print publications, or online sites to endorse, promote or advertise the goods or services of Nestlé (South Africa) (Pty) Limited. However winners of the Competition shall at all times be entitled to decline the above request.
  18. The Promoters reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all entrants agree to waive any rights that they may have in terms of the Competition and acknowledge that they have no recourse against Nestlé, its advertising agencies, advisors, suppliers and nominated agents.

  1. All persons ("Participants") entering the Nestlé Winter Competition ("Promotional Competition") ") agree that the competition rules as set out in these terms and conditions ("Terms and Conditions") are binding on them.
  2. The Promotional Competition will run from 11th May 2015 to 31st July 2015, after which date the Promotional Competition will automatically lapse and no further entries will be accepted.
  3. The "Promoters" are Nestlé (South Africa) Proprietary Limited ("Nestlé"), and TMARC.
  4.   5. For South African entries, participants must dial *120*2447*last4digitsofbarcode# to enter the competition. Following this, participants will be prompted to enter the last 4 digits of the barcode of the 2nd item purchased (calls cost 20c per 20seconds)
  6. Only correct entries will be entered into the draw (“Products”)
  7. Winners will be selected by a random draw every day from the 11th May until the 31st July.
  8. Winners will be contacted via SMS or telephone from the 11th May to the 31st July (inclusive). The Promoters reserve the right to disqualify a winner if he/she does not respond to the telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted telephonically by TMARC as soon as reasonably practicable and shall be required to respond to TMARC in the manner set out in such correspondence. In the event that the replacement winner fails to respond to TMARC, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will take place immediately. THE PRIZES
  9. Winners will receive one of the following prizes (images in advertising material are used for promotional purposes only and may differ to the final prizes ): i R500 (for entries from South Africa) every hour every day (when 1 day is equivalent to a working hour day of 8 hours) from the 11th May 2015 until the 31st July 2015 ii. You can win one of 10 x R5 000 vouchers at the end of each month for the duration of the campaign (i.e, 31st May 2015, 30th June, 31st July 2015)
  10. Each participant may only enter once a day
  11. Once the participant is deemed a winner, they will receive an SMS from the promoter, confirming that they have received a cash prize.
  12. For South African entry winners, instant cash prizes will be transferred using mobile money transfer
  13. Any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws;
  14. The Promoters reserve the right to substitute the Prize with another of greater or equal value.
  15. The Promoters shall not be held liable for any misrepresentation (written or verbal) or in respect of any warranties made by any person or group other than TMARC.
  16. Winners agree to participate in a photograph opportunity for the sole purpose of NESTLE marketing the results of this Promotional Competition.
  17. The Promoters reserve the right to withdraw this Promotional Competition without notice in the event of force majeure such as war, earthquakes, disasters, calamities, strikes or similar circumstances.
  18. The Promotional Competition is open to all residents of South Africa, Botswana and Namibia aged 18 years or older, This Promotional Competition is not available to the directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of NESTLE, TMARC or agencies and their immediate family members.   19. These Terms and Conditions contain certain provisions which appear in similar text style to this clause and which: i may limit the risk or liability of the Promoters or a third party; ii may create risk or liability for the Participant; iii may compel the Participant to indemnify the Promoters or a third party; or iv serves as an acknowledgement, by the Participant, of a fact.
  20. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  21. The Participant acknowledges that by submitting his or her entry to the Promotional Competition he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.
  22. All Participants to this Promotional Competition participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, and Nestlé; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.
  23. The Promoters reserve the right to amend these Terms and Conditions as well as terminate the Promotional Competition at any time. In the event of such termination, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
  24. By entering the Promotional Competition in accordance with its terms, Participants acknowledge that the Promotional Competition will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address, identity number and proof of purchase) and (ii) signing receipt of the prize upon its delivery.
  25. The names of the winners will be published on the Promoters' websites subject to the winners consent.
  26. Winners may be requested to take part in the Promoters' publicity campaigns or to allow their names to be used by the Promoters for promotional purposes. Winners are, however, entitled to decline such request.
  27. The Promoters shall conduct the Promotional Competition, and the Promoters’ decision on any matter related thereto, including the selection of winners is final and no correspondence will be accommodated in respect thereof.
  28. The Promoters reserve the right to vary these Terms and Conditions by providing notice of such change on the NESTLE website (www.nestle.co.za).   29.   2. The Promotional Competition will run from 11th May 2015 to 31st July 2015, after which date the Promotional Competition will automatically lapse and no further entries will be accepted.
  3. The "Promoters" are Nestlé (South Africa) Proprietary Limited ("Nestlé"), and TMARC.
  4.   7. Winners will be selected by a random draw every day from the 11th May until the 31st July.
  8. Winners will be contacted via SMS or telephone from the 11th May to the 31st July (inclusive). The Promoters reserve the right to disqualify a winner if he/she does not respond to the telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted telephonically by TMARC as soon as reasonably practicable and shall be required to respond to TMARC in the manner set out in such correspondence. Winners will receive one of the following prizes (images in advertising material are used for promotional purposes only and may differ to the final prizes): i N$500 (For entries from Namibia) every hour, every day (where 1 day is equivalent to a working hour day of 8 hours), from the 11th May 2015 until the 31st July 2015. ii 30 x N$5 000 (For entries from Namibia) prizes at the end of each month of the duration of the competition (i.e 31st May 2015, 30th June 2015 and 31st July 2015)
  10. Once the participant is deemed a winner, they will receive an SMS from the promoter, confirming that they have received a cash prize.
  11. Entrants from Namibia will be contacted telephonically to obtain the entrants ID, Banking Details and Proof of Purchase. Once received, and all details are valid, an electronic funds transfer (EFT) of the cash prize will be deposited into the winner’s bank account.
  12. Any failure, non-compliance or shortcoming on the part of the winner, in relation to meeting these Terms and Conditions, may result in the cancellation of the Prize and a new draw taking place. In such an instance the preceding winner will be excluded from future draws;
  13. The Promoters reserve the right to substitute the Prize with another of greater or equal value.

  7. Winners will be selected by a random draw every day from the 11th May until the 31st July.
  8. Winners will be contacted via SMS or telephone from the 11th May to the 31st July (inclusive). The Promoters reserve the right to disqualify a winner if he/she does not respond to the telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted telephonically by TMARC as soon as reasonably practicable and shall be required to respond to TMARC in the manner set out in such correspondence. These Terms and Conditions contain certain provisions which appear in similar text style to this clause and which: i may limit the risk or liability of the Promoters or a third party; ii may create risk or liability for the Participant; iii may compel the Participant to indemnify the Promoters or a third party; or iv serves as an acknowledgement, by the Participant, of a fact.
  19. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
  20. The Participant acknowledges that by submitting his or her entry to the Promotional Competition he/she has been given an appropriate opportunity to first read these Terms and Conditions before entering and that he/she understands and accepts these Terms and Conditions.
  21. All Participants to this Promotional Competition participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, and Nestlé; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the indemnified parties.
  22. The Promoters reserve the right to amend these Terms and Conditions as well as terminate the Promotional Competition at any time. In the event of such termination, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
  23. By entering the Promotional Competition in accordance with its terms, Participants acknowledge that the Promotional Competition will be managed in accordance with the provisions of the CPA. Winners undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address, identity number and proof of purchase) and (ii) signing receipt of the prize upon its delivery.
  24. The names of the winners will be published on the Promoters' websites subject to the winners consent.
  25. Winners may be requested to take part in the Promoters' publicity campaigns or to allow their names to be used by the Promoters for promotional purposes. Winners are, however, entitled to decline such request.
  26. The Promoters shall conduct the Promotional Competition, and the Promoters’ decision on any matter related thereto, including the selection of winners is final and no correspondence will be accommodated in respect thereof.

  1. By entering into the NESPRAY WIN A SHARE OF R1 000 000 PROMOTION, entrants agree to the rules set out below.

This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering). CERELAC COMPETITION Terms & Conditions

  1. By entering into the Cerelac Onesie Competition, entrants agree to the rules set out below.
  2. This competition is limited to residents of South Africa, with the exception of the following people:
    1. directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited (“Nestlé”) and organisers of the Competition;2.2. people who are not legal residents and / or legal citizens of the Republic of South Africa;2.3. spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above; and2.4. Persons under the age of 18 years.
  3. Winning entrants can win:
    * 1 of 100 matching sets of HUGgable onesies for mom and their baby
  4. The competition starts: 1 May 2015 and ends on 30 June 2015. No entries received after 30 June 2015 will be considered.
  5. The winners will be contacted telephonically. Should the winners not respond to the telephone call within 48 hours with all the details that need to be submitted, the person will forfeit their winnings and the prize of the matching onesies will be given to a runner-up.

  15. The list of winners will be published on the Facebook page https://www.facebook.com/www.startstrongstaystrong.co.za a weekly basis starting on the 11th of May 2015. Only winners who have consented to having their names on the website and Facebook will be published.
  16. Winners may be required (at no fee) to be identified and have their photographs published in print media, social media, or to appear on radio and/or television. However winners shall at all times be entitled to decline the above request. All publicity and other materials will be the sole property of Nestlé.
  17. All entrants must hold a valid South African identity document.
  18. All valid entries submitted will be eligible to win a prize.
  19. If Nestlé, the organisers of the competition and the Promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  20. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
  21. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com
