Nestlé 100 Year Campaign Competition Terms and Conditions


The terms and conditions set out below are a condensed version of the full competition terms and conditions located at www.nestle.co.za and participation in this Competition is governed by these terms and conditions together with the full terms and conditions (collectively, the “Rules”). Entrants are encouraged to review the full terms and conditions in addition to the terms and conditions set out below.

This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”), who reserve the right in its sole discretion and to the extent permitted by law, to amend these Rules at any time.

Participation in the competition constitutes acceptance of these Rules and entrants agree to abide by these Rules.

These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any entrant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

By participating in this competition, entrants agree to these Rules.

  1. This competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this competition:
    1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited and the organisers of the Competition.
    2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    4. Persons under the age of 18 years.
  2. The competition shall commence on 16 May 2016 and will end on 31st July 2016. No entries received after the 31st of July 2016 will be considered.
  3. Mechanics
    To participate in this competition entrants must adhere to the following:
    1. Purchase any Nestle participating product (excluding all Infant Formula and Nido 1+ products) send the last 4 digits of the barcode to 33230 (sms charged at R 1.50).
    2. Potential winners will be selected from a random draw and will be notified that they are a potential winner via sms.
  4. The Prize:
    1. Participants in this competition stand a chance to win a share of R 3 million rand in prizes consisting of:
      1. 100 x Samsung A5 smart phones;
      2. 100 x Samsung 32” Series 4 HD LED televisions;
      3. 100 x Protea Hotel Vouchers to the maximum value of R8 000; and
      4. 200 x Titan Nova 26’’ Mountain Bikes.
  5. Nestle reserves the right to change prizes for the duration of the competition.
  6. How to claim your prize:
    1. At the time that a potential prize winner is identified, the potential prize winner will receive an sms, which sms shall contain a pin code and a telephone number which the potential prize winner should call. During this telephone call, the potential prize winner may be required to present his/her pin code, answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Nestlé representative.
    2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    3. If the potential prize winner fails to phone the number provided by 30th September 2016, he/she will forfeit the prize.
    4. Eligible winners will have their prizes, save for the Protea Hotel Voucher, delivered to them by a representative of Nestlé or a partner agency of Nestlé based on the information they will have shared via the above mentioned telephonic conversation.
    5. For Protea Hotel Vouchers, prize winners will receive their Protea Hotel Voucher number electronically (or via any other means deemed suitable by Nestlé). The prize winner, when he or she is ready to make a booking, can contact the Protea Hotel central reservation number. Bookings will only be permitted to be made within 12 months from the date that the voucher number was issued to the prize winner. This voucher is only valid for a single booking even if the total amount of the voucher was not used in this booking. The voucher cannot be used for any subsequent bookings.
    • General
    1. The judges’ decision is final, and no correspondence will be entered into. Nestlé and/or any of its agencies may refuse to award a prize to an entrant if there is suspicion of any irregularities or fraudulent activities.
    2. Nestle may require the winner to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    4. Nestlé reserves the right, at its sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    5. By entering this competition you authorise Nestlé and the promoter, to collect, store and use (not share) personal information of entrants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com OR Dial *130*7445*1#. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    6. The winner or participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the promoter.
    7. The organisers of the competition reserve the right to cancel or postpone the competition at any time.

PARTICIPATION
  1. All persons (“Participants”) entering the Nestle Nido 3+ “Buy and WIN” Promotion (“Promotion”) agree that the Promotion rules, as set out in these Terms and Conditions (“Terms and Conditions”), shall apply and are binding on them.
  2. Volcano IMC, TLC Marketing Worldwide (Pty) Ltd (“TLC”) and Nestlé (South Africa) (Pty) Limited are collectively referred to as the “Promoters” in respect of the Promotion for purposes of these Terms and Conditions.
  3. The following people shall not be eligible to participate in this Promotion:
    1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promotors.
    2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in a. above
    4. Persons under the age of 18 years.
  4. This Promotion commences on 1 April 2016 and shall run until midnight on 15 May 2016 (“Campaign Period”), subject always to any early termination or extension thereof by the Promoters as contemplated in these Terms and Conditions.
  5. These Terms and Conditions override any advertising collateral or material in the event of any conflict.
  6. The Promotion will include an instant gratification reward as well as a grand prize draw.
PRIZES
  1. INSTANT GRATIFICATION REWARD
    1. The first 2700 consumers to successfully participate in the Nestle Nido 3+ “Buy and Win” competition will be entered into the main prize draw as well as be rewarded with a Perfect 10 Pamper Voucher pin to the value of R210 which they may redeem at any Perfect 10 store countrywide.
    2. Consumers may book at a salon of their choice by calling the respective salon and quoting their unique code.
    3. 24 hour cancellation is required should the consumer need to cancel the appointment
    4. Should the customer select a treatment of a lessor value, the booking shall commence however no difference in refunds will be granted. Should a treatment of a higher monetary value be selected, the difference would need to be paid in by the consumer.
    5. The Reward must be utilized by the 31st October 2016, failing which the reward will be forfeited and the Participant shall not have any claim against the Promoters as a result thereof.
    6. The redemption of one voucher per customer and cell nr will be permitted.
  2. GRAND PRIZE DRAW
    1. All entrants who participate in the competition and successfully comply with the Terms and Conditions have the opportunity of winning a cash prize of R30 000.
    2. The grand prize will also include a spa weekend including four treatments for two to the value of R3000.
    3. The grand prize winner will be selected via lucky draw to be held on or before 27 May 2016 and the prize money will transferred to the winner on or before 30 June 2016.
  3. ENTRY
    INSTANT GRATIFICATION
    1. Consumer would need to purchase one Nestlé Nido 3+ 1.8kg tin during the Campaign Period and supply proof of purchase to instore promoter to receive a voucher containing a unique code.
    2. The customer must then take a picture of their till slip and Whatsapp it along with their unique code to 079 173 0705079 173 0705.
    3. The Customer will receive a Whatsapp response saying "Thank you for your entry. Please allow 24/48hrs for validation. For queries please call TLC on 011 676 7702011 676 7702. T's & C's apply"
    4. Once validated the customer will then receive a WhatsApp message with a voucher code for R210. The WhatsApp message will include prompts to go to http://www.perfect10.co.za to find their nearest outlet and to make the booking for their required treatment. The booking will need to be done telephonically.
    GRAND PRIZE DRAW
    1. Consumers would need to purchase a 1.8kg tin of Nestle Nido 3+ during the Campaign Period.
    2. They would need to take a pic of their till slip as proof of payment and WhatsApp it to 079 173 0705079 173 0705 to be entered into the Grand Prize draw.
    3. The grand prize winner will selected via lucky draw on or before 27 May 2016 and contacted telephonically.
  4. GENERAL
    1. Rewards cannot be exchanged for an alternative Reward and TLC’s decision is final and no negotiations or correspondence will be entered into.
    2. TLC reserves the right to replace the offer with one of equal or greater value.
    3. Where the Participant is entitled to redeem a specific Reward, as notified by TLC, the following shall apply in respect of the relevant Reward to be redeemed:

    5. All Rewards partners’ terms and conditions, as provided to the Participant at the time that the relevant Reward is redeemed, shall also apply in respect of such Reward, and the Participant, in redeeming and utilising the Reward, agrees to such terms and conditions.
    6. A validity period is attached to each Reward, as specified herein or within the terms and conditions of the relevant Reward partner (where applicable), as notified to the Participant at the time of redeeming the Reward.
    7. The Rewards may not be allocated if the entry procedures or these Terms and Conditions have not been adhered to, or if the Promoters detect and/or suspect any irregularities or fraudulent practices.
    8. The Promoters will continuously monitor any irregular behaviour, whether it be in entries and/or Participant’s details. Consequently, any violation or attempt and/or suspicion of violation or irregular behaviour and/or non-compliance with these Terms and Conditions will result in immediate disqualification of the Participant.
    9. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    10. The Participant acknowledges that he/she has been given an appropriate opportunity to first read these Terms and Conditions and that he/she understands and accepts these Terms and Conditions.
    11. All Participants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    12. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participant, or accept any liability for: (a) any inability by the Participant to use the Reward in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the Reward; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the Reward.
    13. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any Reward nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    14. The Promoters reserve the right to terminate or extend the Promotion at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    15. By entering the Programme in accordance with its terms, Participants acknowledge that the Programme will be managed in accordance with the provisions of the CPA. Qualifying Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the Reward to the Participant. Should any qualifying Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have rejected the Reward.
    16. The Participants further indemnify the Promotors and participating retailers from any claim should this Promotion be called off or extended for any reason whatsoever. Consequently, all Participants agree to waive any rights that they may have in terms of the Promotion and acknowledge that they have no recourse against the Promotors and such participating retailers.
    17. Without detracting in any way from the Promoters’ rights in terms hereof, if required, as a result of a change in legislation by the South African Government, or if the Promotion is declared unlawful, the Promoters reserve the right to terminate the Promotion immediately and without notice. In the event of such termination all Participants agree to waive any rights they may have accrued in terms of the Promotion and acknowledge that they have no recourse against the Promoters or their promotional agents.
    18. Notwithstanding anything to the contrary contained in these Terms and Conditions, the Promoters reserve the right to amend, modify, change postpone suspend or cancel this Promotion and any Reward (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Promotion for whatsoever reason, all of the Promoters’ obligations in regard to the Promotion as well as in regard to the Rewards shall cease to exist.
    19. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

  1. By entering into The Nestlé “Big Up To The Nestlé Legends”, Bar One®, Kit Kat® Aero®, Tex® and Smarties® Competition (“the Competition”), entrants agree to the rules set out below.
  2. Participating Products:
    • Nestlé KIT KAT 4 Finger Milk 45g

  3. The following people shall not be eligible to participate in the Competition:

  4. The competition starts 1st March 2016 and ends on 31st July 2016. No entries received after 31st July 2016 will be considered.
  5. To enter consumers must purchase any 1 of the 6 participating Nestlé legendary products listed above and dial *120*2462*last4digitsofbarcode# to stand a chance to win 1 of 5 Audi A1’s and your share of R1.5 million in airtime.
  6. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.
    1. Participants may enter the competition as many times as they wish over the promotional period, provided that participants purchase the participating products each time they enter the Competition and complete the Competition entry mechanics, subject to the following conditions:
      1. Only one prize (Grand Prize) per household and per person
      2. No computer-based entries will be accepted
      3. Any cellphone number that enters an incorrect code 5 (five) times in succession will be locked out of the Competition for the entire duration of the Competition (“Blocked Participants”)

  9. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.

    6. Entrants need to purchase any 5 of the participating Nestlé legendary products within the 5 days of the competition as specified above in order to go into the draw to win R5000.
    7. Winners will be contacted the Monday following the above specified dates.
    8. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé at which point he / she will be required to provide his / her ID and / or driver’s license to the Nestlé representative. The potential prize winner will also be required to provide his / her banking details in order for the prize to be paid via EFT into the account. The prize winner must be the owner of the bank account, if another account is chosen, written consent from the account holder and prize winner must be obtained prior to payment.
    9. A copy of a valid till point slip of proof of purchase of the participating products will be required.

    Grand Prize: Stand a chance to win 1 of 5 Audi A1 vehicles.

    GRAND PRIZE: AUDI A1 CAR GIVE-AWAY:
    1. There are 5 prizes of Audi A1 vehicles to be won
    2. Winners will win 1 of 5 Florett Silver Audi A1 1.0 TFSI 70kW Manual Vehicles
    3. The grand prize includes the following:
      1. Administration Fee
      2. License Fee
      3. Registration Fee
      4. On The Road Fee
    4. The Florett Silver Audi A1 1.0 TFSI 70kW Manual Vehicle is non-negotiable and cannot be exchanged for another colour or model
    5. Winners must be over the age of 18 years and have a valid ID and Driver’s License
  11. Each entrant is expected to have purchased a participating product of the Competition and be able to produce a valid till slip of proof of purchase if selected as a winner of 1 of the 5 Audi A1 vehicles.
  12. 1 Audi A1 will be given away at the end of every month for the duration of the Competition. The draws will take place within the following months:
    1. April
    2. May
    3. June
    4. July
    5. August

    If a participants name is drawn, they will be contacted within 2 weeks of the date of the relevant draw and, subject to compliance with the remainder of these terms and conditions, the vehicle will be delivered before the end of the month within which the draw took place. Nestlé will contact a winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.

  13. Winners may be required (at no fee) to be identified and have their photographs published in print media, digital media, or to appear on radio and/or television. However winners shall at all times be entitled to decline the above request. All publicity and other materials will be the sole property of Nestlé.
  14. All valid entries submitted will be eligible (but not guaranteed) to win the instant prize or the grand prize.
  15. Nestlé, the organisers of the Competition and the promoters are not responsible for any risk and / or damages that may occur once the Audi A1 is handed over to the winner. The Audi A1 vehicles do not include car insurance and the winners will be required to arrange their own insurance and will be liable for all risks associated with the vehicle after taking delivery. Winners will be required to sign an indemnity form acknowledging this when the Audi A1 is handed over.
  16. A potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted to Nestlé along with any other information which Nestlé might require. If a potential prize winner does not meet the eligibility requirements which shall be determined in the sole discretion of Nestlé, the prize will be forfeited and a runner-up finalist will be deemed the potential prize winner, subject to the terms and conditions herein.

  17. If Nestlé, the organisers of the Competition and the promoters are unable to reach any of the potential prize winners for the grand prize within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  18. Each of the 5 Audi A1’s will be delivered to the nearest selected Audi Dealership in that region where the winner is located. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner(s) to get to the selected Audi Dealership in that region to collect the Audi A1 vehicle. Winners will be required to bring all relevant documents upon handover of the Audi A1 prize.
  19. The judges’ decision is final, and no correspondence will be entered into.
  20. The prizes are not transferable and non-negotiable and cannot be exchanged for cash. No substitution, cash redemption or assignment of prize is permitted, but the organisers of the Competition reserve the right to substitute the prize with one of comparable value for any reason. The dates allocated for each prize are not negotiable.
  21. Winners may be required to complete and submit an information disclosure agreement to enable Nestlé to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he / she will automatically be disqualified and the prize will be forfeited. Winners will be required to sign acceptance of prizes and indemnity documents.
