By participating in this promotion, entrants agree to the rules set out below.

 

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”) in conjunction with Arc South Africa (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
    By participating in this Competition, Participants agree to the rules set out below.
  2. This Competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    • 2.4. Persons under the age of 18 years.
  3. The Competition shall commence on 14 February 2018 and will end on 28 February 2018. No entries received after 28 February 2018 will be considered.
  4. Mechanics
    To participate in this Competition, Participants must share a recipe on the Nestle Cook With Love website (www.cookwithlove.co.za) by completing every required field on the submission form. The link to the submission form will be provided on the Facebook competition post. The recipe must include a Nestle Culinary Milks product as one of the ingredients, please see list below:
    • Nestle Ideal Evaporated Milk

  5. The Prize:
    Winners of the best recipes will be selected and their recipes will be featured on the Nestle Cook With Love Facebook page.
  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above mentioned telephonic conversation or while registering on the website.
  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.6. By entering this competition you authorise the Promoter and Nestle Cook With Love to collect, store and use the submitted recipe as a Nestle recipe and for use on Nestlé’s marketing communication platforms.
    • 7.7. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate people, or accept any liability for: any illness or injury occurring from making or trying out the recipes shared on the Nestle Cook With Love Facebook page and website.
    • 7.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

    • 4.1 Instant Fashion Voucher competition – (South Africa only)
      • 4.1.1 To participate in this competition, participants must adhere to the following: spend R100 or more on one of the participating Nestlé JOGOLINO, NIDO 3+, CERELAC or NESTUM products at participating retailers in South Africa during the promotional period and upload a picture of their till slip to the following dedicated WhatsApp competition line: 076 295 2412.
      • Participating retailers include Shoprite, Checkers, Pick ‘n Pay, Spar, Dischem, Game and Clicks.
      • 4.1.2 The Prizes:
        Eligible participants can choose from:
        • JET Voucher (Spend R120 and Get R30 off); or
        • Edgars Voucher (Spend R500 and Get R100 off).
      • 4.1.3 How to claim your prize:
        Upon verification of the till slip sent to the WhatsApp line (076 295 2412) you will be able to select either the JET voucher (spend R120 and get R30 off) OR Edgars voucher (spend R500 and get R100 off) that will be sent directly to your cell phone via the WhatsApp line.
      • 4.1.4 Incomplete entries may be billed by your service provider. Nestlé shall not be responsible for telecommunication failure on the part of the participant’s service provider.
    • 4.2 Fashion Voucher Competition – (Lesotho, Swaziland, & Namibia)
      • 4.4.1 To participate in this competition, participants must adhere to the following: purchase one of the participating Nestlé NIDO 3+, CERELAC or NESTUM products during the promotional period and SMS the barcode of the purchased product to 38268 to be verified. Standard network SMS rates apply. Free SMSs or minutes do not apply.
      • 4.2.2 The Prizes:
        Participants will stand a chance to win airtime to the value of R10.
    • 4.2.3 How to claim your Prize:
      Upon verification of the till slip sent to the WhatsApp line, you may stand a chance to receive an Edgars voucher that will be sent directly to you via the WhatsApp line. Incomplete entries may be billed by your service provider. Nestlé shall not be responsible for telecommunication failure on the part of the participant’s service provider.
    • 4.3 Wholesaler Competition – Share of R80 000 (South Africa only)
      • 4.3.1 To participate in this competition, participants must adhere to the following: spend R200 or more one of the participating Nestlé NIDO 3+, CERELAC or NESTUM products at participating retailers in South Africa during the promotional period and upload a picture of their till slip to the following dedicated WhatsApp competition line: 064 914 5835.
      • 4.3.2 The Prize:
        Participants will stand a chance to win their share of R80,000.00 in cash (in this regard, there is a total of 4 cash prizes of R20 000 each to be won).
      • 4.3.3 How to Claim your Prize:
        At the time that a potential prize winner is identified, the potential prize winner will receive a WhatsApp message, which shall contain a pin code and a telephone number which the potential prize winner should call to redeem their prize. During this telephone call, the potential prize winner may be required to present his/her pin code, answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Nestlé representative.
        • 4.3.3.1 The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
        • 4.3.3.2 If Nestlé, the organisers of the competition and/or the promoters are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
      • 4.4 Spaza Shop Competition – Airtime (South Africa only)

        • 4.4.3.1 Participants will be informed whether they are a winner or not by receiving an SMS back asking them to reply back with their selected Airtime provider of their choice.
        • 4.4.3.2 Participants are only able to enter this competition once a month.
        • 4.4.3.3 Participants may only win once during the promotional period.

    • 4.6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter.

  1. By entering into the NESPRAY Q1 2018 BACK 2 SCHOOL CONSUMER COMPETITION RULES, entrants agree to the rules set out below.
  2. Eligible participants stand a chance to win their share of R1,025,000 in prizes. There will be

  3. The cash prizes are intended as daily prizes over the campaign period; the first randomly selected finalist with a valid entry will be eligible for the daily cash prize. Airtime prizes will be available to everyone entering the competition via the USSD mechanic.
  4. This competition is open to all South African residents or South African Citizens over the age of eighteen (18) years (any persons under the age of eighteen (18) must have their parent/guardian’s permission before entering).   7. To participate in the Competition, each participant must:
    Purchase any pack of NESPRAY or NESPRAY Tummy Ease, dial *120*304050# and follow the prompts for qualifying questions which will include entering the last four digits of the barcode found on the product packaging, an ID number (or part thereof) and answers to simple questions about the participant or his/ her family. The participant will then be successfully entered into the competition. Do not SMS to this number.
    • The product mentioned above may be purchased at any store in South Africa.
    • USSD entries cost 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by your service provider. The Promoter shall not be responsible for telecommunication failure on the part of the Participant’s service provider. Participants may enter as many times as they choose to increase their chances of winning.
    • Due to network restrictions, the USSD session will timeout after 120 seconds. If a consumer successfully enters the barcode before the session times out, their entry will be considered valid.

  8. Random draws will determine the daily prize prize winners.
  9. The prize winner will be notified telephonically on the number used to enter the competition. Upon receipt of the call the potential prize winner may be required to provide his / her email address (if available), work telephone number (if available) and a copy of his / her ID book and / or driver’s licence to a representative from Nestlé (South Africa) (Pty) Limited. At the time of the telephone call, the potential prize winner may be required to answer several questions about his / her eligibility and may be required to provide proof of purchase. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and awarded to the runner-up finalist.   1. 1. This competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this competition:

    To participate in this competition, entrants must adhere to the following:
    • 4.1. Buy any 2 of the participating Nestlé Smarties products from any SPAR store.
    • 4.2. Dial from your cellphone *120*642*last4digitsbarcode#. Entry costs 20c / 20 seconds as per USSD Entry.
  5. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for competition entry purposes. If it is discovered that participants have entered of a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter. This is to avoid fraud and to ensure compliance to the CPA.
  6. Therefore each entrant is expected to be the owner of that phone and no singular person can enter off of another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
  7. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  8. Each entrant is expected to have purchased the brand and be able to produce a valid till slip if requested.

  10. How to claim your prize:

  7. How to claim your prize:

  3. The Competition shall commence on 18 December 2017 and will end on 11 February 2018. No entries received after 11 February 2018 will be considered.
  4. Mechanics
    To participate in this competition entrants must adhere to the following:
    • The qualifying products for this promotion include: MAGGI 2-MINUTE noodles (73g) or MAGGI 2-MINUTE noodles MEGA PACK (5x73g) in any flavour, and may be purchased from any retail stockist nationally. Please note that no other Nestle South Africa products are eligible for this promotion, other than those products mentioned above. The qualifying products are subject to availability at time of purchase
    • Consumer purchases any qualifying MAGGI 2-MINUTE noodle product. Consumer dials the USSD code *120*435*and then enters the last 4 digits of the qualifying product barcode followed by #. Consumers will be required to answer 1 qualifying question. Calls charged at 20cents per 20 seconds
    • Winners will be determined by random draw that will be held on 16 February 2018 and winners will be notified telephonically before 23 February 2018
    • Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new unique code, subject to the following conditions:
      • All entries from disqualified participants’ mobile numbers will be rejected
      • Only one prize per household and per person
      • No computer-based entries will be accepted
      • Any mobile number that enters an incorrect unique code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”)
    • Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.

  6. How to claim your prize:
    • At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  7. General
    • The judges’ decision is final, and no correspondence will be entered into.
    • The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.

By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary.
