  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”) in conjunction with the JustPalm (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below
    This Competition is nationwide ONLY in selected Pick n Pay Group Stores and SPAR Group Stores (Excluding Boxer Stores), and all legal residents or citizens of South Africa can participate. The following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above.
    • 2.4. Persons under the age of 18 years.

  3. The Competition shall commence on 17th December 2018 and will end on 31st January 2019. No entries received after 31st January 2019 will be considered.
  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase any 2 participating Nestlé SMARTIES products as listed below and dial *120*3825# to stand a chance to win R200,000 in Tablets and Shopping Vouchers.
    • 4.2. Participating Products:
      • 4.2.1. Nestlé SMARTIES 40g
      • 4.2.2. Nestlé SMARTIES 70g
      • 4.2.3. Nestlé SMARTIES 152g
    • 4.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 4.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new barcode, subject to the following conditions:
      • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected
      • 4.4.2. Only one prize per household and per person
      • 4.4.3. No computer-based entries will be accepted
    • 4.5. Participants must enter on a Mobile phone that is owned and registered to that person. No other person can use another person’s Mobile phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter.
    • 4.6. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
    • 4.7. Participants must enter a valid South African identity number (ID number) and this is key to all entries. No person can use another person’s identity number (ID number) for competition entry purposes. If it is discovered that participants have entered an identity number (ID number) that is not theirs, they will be disqualified, and the entrant will not be eligible for the prize.

  5. The Prize:
    Participants in this Competition stand a chance to win: 1 of 20 SAMSUNG GALAXY TAB A T285 7” 8GB LTE BLACK and 300 of R500 Shopping Cash Vouchers The draws will take place on the following dates:
    • 21st December 2018
    • 28th December 2018

    5.1 Prize visuals on any competition or promotional materials are for illustrative purposes only
    5.2 The Prizes are non-negotiable and cannot be exchanged for another colour or model

  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) from a Pick n Pay store or SPAR store and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 2 (two) working days of their name being drawn or if the potential prize winner fails to submit any requested information or documentation with 48 hours of it being requested, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.


  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or Dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.13. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.14. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  3. The Competition shall commence on 19th November 2018 and will end on 24th December 2018. No entries received after 24th December 2018 will be considered.
  4. Mechanics
    To participate in this Competition, Participants are required to purchase any 2 of the below participating products:
    • Nestlé Sweetened
    • Nestlé Caramel treat
    • Nestle Strawberry flavoured Caramel treat
    • Nestle Cappuccino flavoured Caramel treat
    • Nestlé Mint flavoured caramel treat
    • Nestlé Ideal evaporate milk
    • Nestlé Ideal evaporated medium fat milk
    • Nestlé Cooking & Dessert cream – 290g ONLY
  5. To enter the competition and stand a chance to win 1 of 6 Kitchenaid Mixers weekly and your share of 3 x R10 000 cash prizes, Participants are required purchase any 2 participating products and to upload a clearly legible picture of their till slip via WhatsApp to 076 5117 939. Once the till slip has been uploaded, the system reads the till slip by checking for Nestle Culinary Milks products purchased and the quantities. The automated system will approve all valid uploads. If the automated system cannot validate it, the entry will go for manual validation which will take up to 48hrs.

  6. It is essential that the participating product be bought within the Competition period. Network Data Charges apply.

  7. Participants may enter the competition a maximum of 3 times per week over the Competition period, provided that Participants purchase any 2 participating products each time and upload a picture of a new corresponding till slip, subject to the following conditions:
    • 7.1. All entries from disqualified participants' mobile numbers will be rejected
    • 7.2. Only one prize per household and per person
    • 7.3. No computer-based entries will be accepted
    • 7.4. Any mobile number that enters an incorrect or used till slip five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition ("Blocked Participants")

  8. 8. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 - 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.

  9. The Prize:
    Participants in this Competition stand a chance to win 1 of 6 Kitchenaid Mixers weekly and a share of 3 x R10 000 cash prizes.
    Winners will be determined by random draws that will be conducted at the Nestlé Offices.

    The draws for the Kitchenaid Mixers will be held over the following weeks:
    • 1st Draw – The week of the 26st November 2018
    • 2nd Draw – The week of the 03rd December 2018
    • 3rd Draw – The week of the 10th December 2018
    • 4th Draw – The week of the 17th December 2018
    • 5th & 6th Draw – The week of the 07th January 2019

    The draw for the 3 x R10 000 cash prizes will be held on the week of the 07th January 2019.

  10. How to claim your prize:

    • A. 1 of 6 Kitchenaid Mixers:
      At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver's license and their physically address for the delivery of their prize to the Promoters representative.

    • B. 3 x R10 000 Cash Prize:
      -At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver's license and proof of their banking details for the payment of their cash prize to the Promoters representative.

      -Once all required documents are received and verified by the representative of the Promotors, payment will be processed within 14 working days into the potential prize winners bank account.
  11. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  12. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  13. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they would have shared via the above-mentioned telephonic conversation.

  14. General
    • 14.1 The judges' decision is final, and no correspondence will be entered into.
    • 14.2 The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.
    • 14.3 Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified, and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 14.4 The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner

  5. The Prize:
    • Shoppers / Consumers / Participants stand a chance to win a share of R50 000 (fifty thousand Rand) in instant airtime or weekly giveaways which consist of 1 of 14 (one of fourteen) Samsung Microwave Ovens to the value of R2000 (two thousand Rand). A total of 2 Microwave Ovens will be drawn to 2 winners each week.
    • Trader Participants stand a chance to win a share of R50 000 (Fifty Thousand Rand) in cash. A total of 1 winner will be drawn weekly starting on the 3rd week of the campaign (week starting 5 November 2018) for the 5 weeks remaining. Each weekly winner will be awarded R10 000 (ten thousand Rand). For the avoidance of doubt, there will be a total of 5 weekly winners.

  6. How to claim your prize:
    • 6.1. Two weekly shopper / consumer winners will be selected at random in the presence of the Nestlé brand team and Nestlé legal team. This draw will take place weekly throughout the duration of the campaign. Daily instant airtime giveaway winners will be selected at random facilitated by TMARC.
    • 6.2. One Trader winner for the weekly cash prize will be selected at random in the presence of the Nestlé brand team and Nestlé legal team. This draw will take place weekly starting on the 5 November 2018 for the duration of the campaign.
    • 6.3. At the time that a potential prize winner is identified, the potential prize winner will receive an SMS message in their cell phone number from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents and a copy of his/her ID and/or driver’s license to the Promoters’ representative.
    • 6.4. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.5. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.6. Eligible winners will have their prizes delivered to them by a representative of the Promoters based on the information they will have shared via the telephone call.

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.
    • 7.3. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.4. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason. 7.6. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.

All publicity and other materials will be the sole property of the Promoters.
    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA.   1. Introduction
    • Participation in this Competition is governed by these terms and conditions (the Rules).
    • Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • This competition is operated by Nestlé (South Africa) (Proprietary) Limited (Nestlé) in conjunction with Vetro Media (collectively the Promoters).
    • Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
    • This Competition is limited to legal residents and/or legal citizens of South Africa, and specifically those residing in Kwazulu Natal. In addition, the following people shall not be eligible to participate in this Competition:
      • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
      • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
      • People who are not legal residents and/or legal citizens of the Republic of South Africa.
      • Persons under the age of 18 years.
    • The Competition shall commence on 15th October 2018 and will end on 15th November 2018. No entries received after 15th November 2018 will be considered.
  3. Mechanics
    • To participate in this Competition, Participants must adhere to the following: Participants are required to purchase any KLIM 500g Sachet Value pack at participating stores in the Kwazulu Natal province. To enter the competition and to stand a chance to win 1 of 125 Makro Vouchers worth R200 each participant are required to Dial *120*1065# and follow the prompts. Each entry is charged 20c/20sec.
    • Winners will be determined by random draw that will be held daily each day of the competition period (three winners will be drawn per day).
    • Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating product each time and complete the competition entry and enter a new unique code, subject to the following conditions:
      • There is a maximum entry limit per participant per week which cannot exceed 3 times within a 7day period.
      • All entries from disqualified participants' mobile numbers will be rejected.
      • Only one prize per household and per person will be permitted.
      • No computer-based entries will be accepted.

    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters;

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase any 2 (two) X 250 g tins of Nestlé Cocoa from any Pick n Pay store nationwide during the promotional period, take a clear photo of their till slip and WhatsApp the photo to 060 557 4210. Participants will be notified weekly if they are a voucher winner and after the Competition period if they are the grand prize winner.
    • 4.2. The cost for entering the Competition is part of the Participant’s cellular data bundle, at the rate at which the Participant’s service provider will charge for sending a WhatsApp message with a photo. No other network fees (e.g. SMS, MMS) will apply.
    • 4.3. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the 2 (two) packs of the participating product each time and follow the competition entry process, subject to the following conditions:
      • 4.3.1. All entries from disqualified participants’ cell phone numbers will be rejected;
      • 4.3.2. Only one prize per person will be permitted;
      • 4.3.3. No computer-based entries will be accepted;
      • 4.3.4. Any cell phone number that submits a photo via WhatsApp of the same till slip 5 (five) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).

    • 4.5. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that Participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to the Promoter.
    • 4.6. The cellphone number is key to all entries, if the Participant has won on a particular cellphone number, then they cannot use another number in order to be contacted further. The number with which each Participant enters the Competition needs to be a number that is contactable during office hours.
    • 4.7. Participants must enter a valid South African identity number (ID number) and this is key to all entries. No person can use another person’s identity number (ID number) for competition entry purposes. If it is discovered that participants have entered an identity number (ID number) that is not theirs, they will be disqualified, and the entrant will not be eligible for the prize.

  5. The Prize:
    • 5.1. Participants stand a chance to win a grand prize of 1 (one) Foodie Getaway to Cape Town for 2 (two) people valued at a total of R 40 000.00 (forty thousand Rand). In addition, participants stand a chance to win 1 (one) of 5 (five) weekly Yuppiechef vouchers, valued at R 1000.00 (one thousand Rand) each.
    • 5.2. Winners will be determined by random draw and Participants will be notified weekly via WhatsApp if they are a winner of the weekly draw. The grand prize winner will be determined by random draw from all valid entries and will be notified after the Competition period.
    • 5.3. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé at which point he / she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as his / her ID and / or driver’s license to the Nestlé representative. The potential prize winner will also be required to provide his / her email address for the prize, in the form of a digital voucher, to be emailed to them. The prize winner must be the owner of the email account.
    • 5.4. The prize winner will also be required to provide a copy of a valid till slip as proof of purchase of the 2 (two) participating product packs purchased within the promotional period.
    • 5.5. Potential prize winners will have 48 hours to produce the relevant documentation failing which the Participant shall be deemed to have forfeited the prize and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 5.6. A potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters.   5. How to claim your prize:

    • Participants may enter the competition as many times as they wish over the promotional period, provided that they comply with the mechanics set out in 3.1 and 3.2 each time they wish to enter the competition.

  1. This competition is only open to legal residents and/or legal citizens of South Africa. In addition, the following people shall not be eligible to participate in this competition:
    • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé and the organisers of the competition;
    • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above;
    • People who are not legal residents and/or legal citizens of the Republic of South Africa;
    • Persons under the age of 18 years.
  2. The competition shall commence on 15 September 2018 and will end on 30 November 2018 (the “promotional period”). No entries received after 30 November 2018 will be considered.
  3. Mechanics
    • To participate in this competition, participants must purchase any 1 (one) of the following Nestlé products from any store in South Africa during the promotional period and retain their till slips as proof of purchase:
      • MAGGI LAZENBY 125ml;
      • MAGGI LAZENBY 250ml;
      • MAGGI LAZENBY 500ml;
    • Thereafter, participants must dial *120*7837*last4digitsofbacode# and follow the prompts. Upon completing this process, the participant will receive an automated USSD response that they have been entered into the prize draws. Participants are required to note that USSD entries cost 20c for 20 seconds, and that free SMS’s or minutes do not apply. In addition, participants are required to note that incomplete entries may be billed by their service provider, and that Nestlé shall not be responsible for telecommunication failure on the part of the participant’s service provider.
    • Winners will be determined by random draws throughout the promotional period and potential winners will be contacted telephonically by Nestlé or its representative (and potential winners will be required to complete the process set out below).
  4. The Prize:
    • Participants entering the competition stand a chance to win prizes coordinated through a weekly draw. There will be a total of 100 x Le Creuset vouchers worth R2500 each.
    • Participants may only win one weekly prize of a Le Creuset voucher worth R2500 throughout the promotional period.
    • Only one prize per household will be permitted.
    • Nestlé reserves the right, at its sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
  5. How to claim your prize:
    • At the time that a potential weekly prize winner is identified, the potential prize winner will receive a telephone call from Nestlé or its representatives or agents. During the call the potential prize winner will have to answer a few questions regarding his/her eligibility, and will be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Nestlé representative/agent.
    • If a participant cannot be reached after 3 (three) attempts made within 3 (three) working days of Nestlé or its representatives or agents trying to contact them, the prize will be forfeited and another prize winner/finalist will be selected in accordance with the competition rules via a random draw.
    • The potential weekly prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential weekly prize winner does not meet the eligibility requirements or fails to submit the required documentation within 48 hours of being requested to provide the documents, the prize will be forfeited and a runner up will be deemed the potential weekly prize winner subject to the terms and conditions herein.
    • Eligible winners will have their Le Creuset vouchers sent to them digitally via SMS within 7 days of completion of the verification process. The vouchers will be redeemable in store or online at www.LeCreuset.co.za. Where a winning participant wishes to purchase a product of greater value than the value of the voucher, such winning participant will be required to pay the difference between the purchase price of the product purchased and the value of their voucher.     • The judges’ decision is final, and no correspondence will be entered into. Nestlé and/or any of its agencies may refuse to award a prize to an entrant if there is suspicion of any irregularities or fraudulent activities.

  3. For Digital purchases, the Competition will commence on 1 August 2018 and will end on 30 September 2018 and for Checker’s in-store purchases, the Competition will commence on 20 August 2018 and will end 30 September 2018. No entries received after 30 September 2018 will be considered.

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:

  5. The Prize:
    • Participants in this Competition stand a chance to win their share of R1.75 MILLION in prizes weekly
    • 5.1. Daily rewards:

  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. Eligible winners will have their prizes delivered to them by a representative of the Promoters based on the information they will have shared via the above mentioned telephonic conversation.
  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “ Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This Competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with Nestlé’s agency (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    • 2. This Competition is limited to residents of South Africa, Lesotho, Swaziland, Namibia and Botswana only. In addition, the following people shall not be eligible to participate in this Competition:
      • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
      • 2.2. Spouse, life partner, parent child, brother, sister, business partner or associate of any of the persons specified above.
      • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa, Lesotho, Swaziland, Namibia or Botswana.

  3. The Competition shall commence on 25 June 2018 at 00:00:01 and will end on 14 October 2018 at 23:59:59.

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. The participants need to purchase a participating MAGGI 2 Minute Noodles 5 x 73g Mega Promotional Pack and look for a golden sachet in pack during the promotional period. The participating products for the purposes of this competition are the following MAGGI 5 x 73g packs:
      • 4.1.1. Chicken 5 x 73g;
      • 4.1.2. Beef 5 x 73g;
      • 4.1.3. Cheese 5 x 73g;
      • 4.1.4. Durban Curry 5 x 73g.
    • 4.2. Participants who find a golden sachet in the promotional MAGGI Mega 5 pack will find a winning pin code and the instructions to contact Nestlé’s agency (on the golden sachet) to claim their reward. There are a maximum of 100 golden sachets to be found.
    • 4.3. Participant will be required to contact Nestlé’s agency and quote the winning pin code. Each winning Participant who calls in will be sent a redemption form, which they will be required to complete and send back to the specified email address or fax number along with their proof of purchase, a copy of their valid identity document/ passport, validated bank details and a picture of the winning golden sachet.
    • 4.4. Once all correct required documentation has been received, Nestlé’s agency will organise a direct EFT of the R5000 cash prize into the winning Participant’s bank account. The payment will take place within 15 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency (for transactions within South Africa). For international transactions, payment will take up to 21 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency.

  5. The Prize
    • 5.1 There are 100 cash prizes of R5000 each to be won.
    • 5.2 Should a winning Participant reside outside of South Africa and require the EFT to take place into a foreign bank account, R5000 worth of foreign currency will be transferred into their bank account, and payment will take up to 21 working days from the date all correct documentation has been submitted by the participant to Nestlé or its agency. The value received by the winning Participant will be based on the exchange rate on the day of transfer.

  6. How to claim your prize:
    • 6.1. The prize winner has until 02/02/2019 to redeem the cash reward.
    • 6.2. The prize winner will be required to call into the concierge service centre to redeem their reward. The number will be supplied within the golden sachet.
    • 6.3. The Promoters and their agencies have the right to reject any participant suspected of fraudulent behaviour.
    • 6.4. Prizes may only be redeemed by the participant who entered the promotion and the reward is not transferable under any circumstance.
    • 6.5. Calls made into the call centre are charged at standard share call rates.
    • 6.6. Data charges, required for any download and/or use of a reward/benefit, are never included. These charges are for the participant’s own account.
    • 6.7. The Promoters reserve the right to substitute any prize for a prize of the same or similar value.

  7. General
    • 7.1. The Promoters reserve the right, in their sole discretion and to the extent permitted by law, to amend these Rules at any time. The Promoters may notify the Participants of any significant changes, however there is no obligation on the Promoters to do so and it remains the participants’ responsibility to check these Rules regularly on the website (www.nestle.co.za) and/or any other communications medium applicable.
    • 7.2. These Rules constitute an agreement between the Promoters and each Participant.
    • 7.3. To the extent allowed by law, these Rules set out the whole of the agreement between the Participant and the Promoters in regard to the subject matter hereof and there are no other agreements, guarantees or representations, either verbal or in writing, in regard thereto upon which the Participant is relying in concluding this agreement and the Promoters shall not be bound by any express or implied term, representation, warranty, promise or the like not recorded herein. This clause constitutes an acknowledgment of fact by the Participant. The Participant must ensure that the Participant reads the above clause carefully and ensure that this statement is true and correct as this will limit your rights to claim that these statements are not true and correct.
    • 7.4. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and the parties consent to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg, in respect of any proceedings arising out of or in connection with these Rules.
    • 7.5. Any provision in these Rules which is or may become illegal, invalid or unenforceable shall, to the extent of such prohibition or unenforceability, be ineffective and treated as having not been written and severed from the balance of these Rules, without invalidating the remaining provisions of these Rules.
    • 7.6. The Promoters reserve the right to correct any errors and omissions. These Rules will supersede any errors or omissions on any publicly communicated documentation or marketing material.
    • 7.7. The Participant agrees that the Promoters may send any notice or notification arising under and/or contemplated in these Rules by electronic mail or other electronic communication to your contact details provided to the Promoters.
    • 7.8. The Participants who are residents /citizens of South Africa are required to adhere to any South African Tax Laws linked to receiving the prizes. It is your responsibility as a Participant to adhere and do the necessary submission as and when applicable.
    • 7.9. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited.   8. Warranties and liability:
    • 8.1. To the extent allowed by law, each Participant agrees that the Promoters shall not be liable to that Participant or any other person or entity whatsoever in respect of any loss or damage:
      • 8.1.1. caused by or arising from any fact or circumstance beyond the reasonable control of the Promoters;
      • 8.1.2. which is consequential or incidental loss or damage;
      • 8.1.3. of whatever nature and howsoever arising from or in connection with your Participation and/or your use/consumption of the prizes;
      • 8.1.4. which is a result of any downtime, outage, interruption in or unavailability of the Call Centre or Website, attributable to any cause whatsoever, including (but not limited to) repairs and maintenance, any breakdown in any service provided by any communications service provider (including line failure) as well as by any external communications networks and/or networks of any internet service providers; and/or
      • 8.1.5. arising from a breach of any security system which may be implemented by the Promoters and/or any service provider to the Promoters.

  9. Indemnity
    • 9.1.1. To the extent allowed by law, the Participant hereby indemnifies and holds the Promoters free from liability for loss or damage of whatever nature and howsoever arising from your Participation and/or your failure to comply with any provision and/or obligation under these Rules. This clause constitutes an assumption of risk and/or liability by the Participant under which the Participant indemnifies the Promoter against certain liabilities and which may result in the Participant being liable for additional costs and liabilities.

  10. Privacy
    • 10.1. The Promoters will record all telephone calls made to and from the Call Centre. In the event that participation in the Competition is concluded via the Call Centre, such telephone calls will be recorded, as contemplated in the CPA, to constitute the record of the transaction concluded.
    • 10.2. Each Participant hereby expressly agrees that the Promoters may:
      • 10.2.1. Collect, receive, record, organize, collate, store, update, modify, retrieve, alter, consult, use, disseminate or obtain any of the personal information set out above;
      • 10.2.2. Use your personal information for the purposes set out above;
      • 10.2.3. Transfer your personal information to third parties in a foreign country where this is required for the facilitation of any transfers of information or where this is required for the purposes of delivery of the prizes.
    • 10.3. A Participant may request that the Promoters correct your personal information, should it come to your attention that the Promoters’ records are incorrect. Should the Participant wish to access your personal information or rectify it, please contact the Call Centre.
    • 10.4. In accordance with the Protection of Personal Information Act No.4 of 2013, the Participant may request the Promoters to review which of your personal information it holds and may request for the Promoters to delete such information, please contact the Call Centre. This clause limits and excludes obligations, liabilities and legal responsibilities which the Promoters will have towards the Participant and also limits and excludes your rights and remedies and places various risks, liabilities, obligations and legal responsibilities on the Participant.
