  1. Introduction
    • 1.1 The promoters (hereinafter the “Promoters’) to this competition are:
      • 1.1.1 PICK N PAY RETAILERS PTY LTD (hereinafter “Pick n Pay”) registration number: 1973/004739/07, a company incorporated in the Republic of South Africa and having its registered address at 101 Rosmead Avenue, Kenilworth, 7708; and
      • 1.1.2 NESTLÉ (SOUTH AFRICA) (PTY) LTD (hereinafter “Nestlé”), registration number: 1916/001498/07) a company incorporated in the Republic of South Africa and having its registered address at Anslow Office Park, 8 Anslow Crescent, Bryanston, Johannesburg 2021, South Africa
    • 1.2 Each participant (hereinafter the "Entrant" or collectively the “Entrants”) entering the Pick n Pay and Nestlé Hot Chocolate Smart Shopper Competition (hereinafter the "Promotional Competition" or the “Competition”) agrees that the Competition rules as set out in these terms and conditions are binding. A copy of these terms and conditions is available at www.picknpay.co.za

  2. Important Notice
    • 2.1 These terms and conditions and Competition rules contain certain terms and conditions which appear in similar text style to this clause and which:
      • 2.1.1 may limit the risk or liability of the Promoters or a third party; and/or
      • 2.1.2 may create risk or liability for the Entrant; and/or
      • 2.1.3 may compel the Entrant to indemnify the Promoters or a third party; and/or
      • 2.1.4 serves as an acknowledgement of a fact by the Entrant.
    • 2.2 The Entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.
    • 2.3 The Entrant cannot be a legal entity and must be an individual/natural person.
    • 2.4 Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Entrant or the promoters in terms of the Consumer Protection Act, 68 of 2008 (the “CPA”).
    • 2.5 The Entrant acknowledges that by submitting his or her entry to the Competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.
    • 2.6 All Entrants to this Promotional Competition participate entirely at their own risk. By reading and accepting these terms and conditions, the Entrant gives consent to these risks and hereby indemnifies and holds harmless both Promoters and all entities or affiliates of any of the Promoters’ respective group of companies, their directors, employees and agents (the “Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Indemnified Parties.

  3. RULES OF THE COMPETITION
    • 3.1 This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
      • 3.1.1 Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
      • 3.1.2 Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
      • 3.1.3 People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 3.2 This Promotional Competition opens on 01 June 2019 and closes on 31 July 2019.
    • 3.3 The prize:
      • 3.3.1 A trip to Maldives for one (1) winner and a travel partner to the maximum value of sixty thousand rand (R60 000);
      • 3.3.2 The winner and his/her chosen travel partner will be required to travel between 31 July and 1 December 2019.
      • 3.3.3 There will only be one (1) winner for the Competition.
    • 3.4 The prize includes:
      • 3.4.1 Return economy class flights for two (2) passengers from Johannesburg, South Africa to Malé, Maldives;
      • 3.4.2 Seven (7) nights’ hotel accommodation in the 3 Star Fihalhohi Island Resort in a Classic Double Room, including breakfast lunch, dinner and selected drinks daily;
      • 3.4.3 Ground transfers between airport and hotel upon arrival in and departure from Malé;
      • 3.4.4 Island hopping with daily itinerary for the winner and his/her travel partner;
      • 3.4.5 Travel insurance.
    • 3.5 The prize excludes:
      • 3.5.1 Health requirements where necessary;
      • 3.5.2 Optional excursions;
      • 3.5.3 All items of personal nature;
      • 3.5.4 Gratuities;
      • 3.5.5 Meals and beverages other than specified;
      • 3.5.6 Cost of passport and visa applications and visa (if applicable);
      • 3.5.7 And any other items not noted in the inclusions.
    • 3.6 The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.
    • 3.7 The winner and his/her travel partner will be required to pay the applicable City Tax charge (at a rate of EUR 1,50 /person/night as at the publishing date of these rules) per person per night which is payable at the hotel directly
    • 3.8 The prize is not transferable and may not be exchanged for cash or other prizes.
    • 3.9 Online shopping purchases from Pick n Pay are excluded from the Competition. 3.10 The prize will be procured before the end date of the Competition (31 July 2019) by Nestlé.
    • 3.11 In order to qualify as an Entrant for this Promotional Competition, the Entrant:
      • 3.11.1 must be a legal resident of the Republic of South Africa;
      • 3.11.2 must provide correct and full personal details, as required;
      • 3.11.3 must be in possession of a valid passport;
      • 3.11.4 must be 18 years old or older;
      • 3.11.5 cannot be a legal entity and must be a natural person; and
      • 3.11.6 must be a registered Pick n Pay Smart Shopper.
    • 3.12 To enter the Promotional Competition, the Entrant must:
      • 3.12.1 Purchase any 2 x Nestlé Hot Chocolate packs during the promotion period and swipe their Smart Shopper card for automatic entry.
      • 3.12.2 The Entrants may enter the Promotional Competition as many times as they wish, provided they complete the Competition entry process set out in 3.11.1 above each time.
    • 3.13 The winner and his/her travel partner must each be in possession of a valid passport, which must:
      • 3.13.1 be valid for a minimum of six (6) months from the return date of the trip the Maldives; and
      • 3.13.2 have no less than two full blank pages available in the passport.
    • 3.14 The winner and his/her travel partner must be permitted to travel to the specified destination by the relevant authorities.
      • 3.14.1 The Promoters shall in no way assist or be responsible or liable to the winner and/or his/her travel partner if any one of their visa applications is denied by the competent authority.
    • 3.15 The winner shall forfeit the prize (and shall not be entitled to any compensation of any nature whatsoever) in the event that for any reason whatsoever, the winner is prevented or unable to travel to the specified destination or on the specified dates and/or fails to meet the VISA application criteria.
  4. SELECTION OF THE WINNER
    • 4.1 The winner will be selected within four weeks of the Competition closure date (this date is subject to change without notice at the sole discretion of the Promoters).
    • 4.2 Entrants to whom prizes will be awarded will be selected through a random draw.
    • 4.3 The winner will be contacted via email or telephonically within four weeks of the Competition closure date (this date is subject to change without notice). Pick n Pay and Nestlé reserve the right to disqualify the winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the Competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. In the event that the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that replacement winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will take place immediately.
    • 4.4 Pick n Pay and Nestlé reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, Nestlé, their advertising agencies, advisors, suppliers and nominated agents.

  5. GENERAL
    • 5.1 By entering the Competition in accordance with its terms, each Entrant is entering a Promotional Competition for the purposes of the CPA and the Promotional Competition will be conducted in accordance with the relevant provisions of the CPA. Should any Entrant win the prize in the Competition, the Entrant undertakes to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
    • 5.2 The names of the prize winner will be published on the Pick n Pay and Nestlé websites, subject to the winner’s consent.
    • 5.3 The winner and his/her travel partner may be requested to take part in the Promoters’ publicity campaigns or to allow their names and likenesses to be used by the Promoters for any promotional purposes. The winner and/or his/her travel partner however, is entitled to decline such request.
    • 5.4 The Promoters shall conduct the Competition, and the Promoters’ decision on any matter related to the Competition, including the selection of the prize winner is final and no correspondence will be entered into.

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
      1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
      1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (Pty) Ltd (the “Promoters”).
      1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
    • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa.

  3. The Competition will run nationally from 01st June 2019 and end at midnight on the 31st July 2019.

  4. Mobile Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase a participating NESTLÉ MILO product listed below and dial *120*4247# and follow the prompts to stand a chance to win promotional prizes. Prompts will include, but are not limited to, requesting the participant to enter the last 4 digits of the participating product barcode. In addition, Participants will be required to provide a valid till slip to be eligible to win prizes.

    • 4.3. USSD sessions are charged from your airtime or billing balance and cost 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 4.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase a participating product each time and complete the competition entry process, subject to the following conditions:
      • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 4.4.2. Only one prize per household and per person will be permitted.
      • 4.4.3. No computer-based entries will be accepted.
      • 4.4.4. It is reasonably expected that each entry will represent a purchase you have made of a Participating Product, e.g. 3 entries will result in the requirement to produce 3 till slips.
      • 4.4.5. For draw based rewards, till slips for each entry will be required.
      • 4.4.6. Any mobile number that enters an incorrect barcode code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
    • 4.5. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    • 4.6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the Participant will be requested to refund the prizes to the Promoters.
    • 4.7. The cellphone number is key to all entries, if the Participant has won on a particular cellphone number, they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.

  5. The Prizes & Draws:
    The Prizes & Draws: Prizes for this Competition are the following:

      • 5.2.1. There are 100 of these scooters available as prizes for this Competition. These scooters are available to validated Participants on a chance to win basis.
    • 5.3. None of the above-mentioned prizes are transferable for cash.

  6. Potential Winner Validation
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her identity document and/or driver’s license to the Promoters representative.
    • 6.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s/till slip is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as a final winner. The final winners may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up being chosen.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their mobile number being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or no answer, such a potential winner will be disqualified and a redraw will be executed.
    • 6.4. Eligible winners will have their prizes delivered. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at TMARC and may be collected by the validated winner.
    • 6.5. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a Participant forfeiting the prize. 6.6. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prizes with any other prizes of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. Product images depicting the prizes are for illustrative purposes only and may differ from the actual prizes.
    • 7.7. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity campaigns will not be entitled to any payment or other remuneration for such publicity campaigns or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, each Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of either of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

    • 4.4. Winners will be determined by random draw that will be held on a weekly basis during the campaign period (1 May – 31 July 2019).     • 4.5. Participants may enter the competition a maximum of three times over the promotional period, provided that Participants purchase a participating product each time and complete the competition entry and enter a new code/upload a till slip as proof of purchase, subject to the following conditions:

  5. The Prize:
    Participants in this Competition stand a chance to win their share of amazing weekly prizes.
    • 5.1. Weekly Prizes:

      • 5.1.3. The prizes are:
        • 5.1.3.1. Non-transferable; and
        • 5.1.3.2. Cannot be exchanged for cash.
    • 5.2. Main Prize
      • 5.2.1. 1 x Mercedes-Benz C200 wrapped in Gold colour (C200).
      • 5.2.2. C200 includes the following:
        • a. Administration Fee;
        • b. License Fee; and
        • c. On The Road Fee.
    • 5.2.3. The C200 will be allocated to the winner randomly and such allocation is non-negotiable and cannot be exchanged for another colour or model.
    • 5.2.4. the winner of the C200 must be 18 years of age or older and have a valid ID and Driver’s licence.
    • 5.2.5. The Promoters are not responsible for any risk and / or damages that may occur once the C200 is handed over to the winner. The C200 does not include car insurance and the winner will be required to arrange their own insurance and will be liable for all risks associated with the C200 after taking delivery. The winner will be required to sign an indemnity form acknowledging this when the C200 is handed over.
    • 5.2.6. The Promoters will not partake in any sort of deals if the winner decides to sell the C200 once it has been handed over to the winner. The winner takes full responsibility for the selling of the C200 and the risks associated with the sale.
    • 5.2.7. The C200 will be delivered to a selected Mercedes Benz Dealership. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner to get to the selected Mercedes Benz Dealership to collect the C200. The winner will be required to bring all relevant documents upon handover of the C200.
    • 5.2.8. The C200 will be delivered within two months of the date which the draw took place. Nestlé will contact the winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
    • 5.2.9. The winner must collect the C200 within 2 weeks from the C200 being delivered to the relevant Mercedes Benz Dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.

  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. Eligible winners will have their prizes delivered to them by a representative of the Promoters based on the information they will have shared via the above mentioned telephonic conversation.

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with JustPalm (Proprietary) Limited (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:

    • 5.4. Winners will be required to bring all relevant documents upon handover of the vehicle.
        • The vehicle will be delivered before the end of the month within which the draw took place. Nestlé will contact a winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
        • Winners must collect the vehicle within 2 weeks from the vehicle being delivered to the relevant dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
    • 6.3. Participants in the retail version of the campaign stand a chance to win one of the following grand prizes;
      • 1 of 8 x Shotleft travel prizes (Not transferrable for cash). Each Shotleft travel prize will comprise of a weekend getaway to any destination in South Africa for a family or group of 5 people (subject to a limit of R50 000 per trip). Each trip will include return economy flights, accommodation and selected meals. The prize excludes optional excursions (unless specified otherwise), all items of personal nature, gratuities, meals and beverages other than specified, and any other items not noted in the inclusions. All spending money is for the winner’s own account and no cash will be handed over to the winner. All travel will need to be completed by 30 November 2019 (the “travel period”). The prize winner may select any date of travel during the travel period. All travel is subject to availability at the time of booking.     • 6.4. The draws for the grand prizes of the wholesale Competition will take place on the following dates:

Once the winners of the Samsonite luggage sets and Shotleft travel prizes have been verified, these winners will each have an opportunity to select 2 people that they would like to win bus travel vouchers of R1500 each (“nominated participants”). The nominated participants will be contacted and they will be required to purchase participating products as contemplated in 4.1 above and provide the Promoters with a copy of their till slips. Following a successful verification process, the nominated participants will be awarded their prizes.

  7. How to claim your prize:
    • 7.1.   1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).

  6. How to claim your prize:

    • 6.7. Participants must use their vouchers within 2 years of date of receipt of their electronic vouchers, failing which they will forfeit the vouchers.


  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. A prize will not be handed/awarded to a third party, but only to a verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prizes with any other prizes of comparable or greater commercial value for whatever reason.
    • 7.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.

If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.5. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.6. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a participant forfeiting the prize.
    • 6.7. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified, and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. Product images depicting the prizes are for illustrative purposes only and may differ from the actual prizes.
    • 7.7. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumerservices@za.nestle.com . Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.
