By participating in this competition, entrants agree to the terms and conditions set out below.
  1. Introduction
    • 1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 3. This competition is operated by Nestlé (South Africa) Proprietary Limited (“Nestlé”) in conjunction with Paton Tupper (the “Promoters”).
    • 4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    • 2. This Competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
      • 0. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
      • 1. People who are not legal residents and/or legal citizens of the Republic of South Africa.
      • 2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above.
  3. The Competition shall commence on 01 June 2018 and will end on 31 July 2018. No entries received after 31 July 2018 will be considered.

  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 0. Participants must purchase any 2 (two) packs of Nestlé Hot Chocolate 500 g, take a clear photo of their till slip and WhatsApp the photo to 083 644 2926. Participants will be notified weekly if they are a winner.
    • 1. The cost for entering the Competition is part of the Participant’s cellular data bundle, at the rate at which the Participant’s service provider will charge for sending a WhatsApp message with a photo. No other network fees (e.g. SMS, MMS) will apply.
    • 2. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the 2 (two) packs of the participating product each time. All Participants are subject to the following conditions:
      • 1. All entries from disqualified participants’ cell phone numbers will be rejected;
      • 2. Only one prize per person will be permitted;
      • 3. No computer-based entries will be accepted;
      • 4. Any cell phone number that submits a photo via WhatsApp of the same till slip 5 (five) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
    • 3. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    • 4. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that Participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to the Promoter.
    • 5. The cellphone number is key to all entries, if the Participant has won on a particular cellphone number, then they cannot use another number in order to be contacted further. The number with which each Participant enters the Competition needs to be a number that is contactable during office hours.

  5. The Prizes
    • 0. Participants stand a chance to win 1 (one) of 85 (eighty-five) Spree shopping vouchers, valued at a combined total of R 100 000.00 (one hundred thousand Rand). Individual vouchers available to be won are made up of 5 (five) x R 10 000.00 (ten thousand Rand) vouchers, 25 (twenty-five) x R 1 000.00 (one thousand Rand) vouchers and 50 (fifty) x R 500 (five hundred Rand) vouchers.
    • 1. Winners will be determined by random draw and Participants will be notified weekly via WhatsApp if they are a winner.
    • 2. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé at which point he / she will be required to provide his / her ID and / or driver’s license to the Nestlé representative. The potential prize winner will also be required to provide his / her email address for the prize, in the form of a digital voucher, to be emailed to them. The prize winner must be the owner of the email account.
    • 3. The prize winner will also be required to provide a copy of a valid till slip as proof of purchase of the 2 (two) participating product packs within the promotional period.
    • 4. Potential prize winners will have 48 hours to produce the relevant documentation failing which the Participant shall be deemed to have forfeited the prize and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

  6. General
    • 0. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 2 (two) working days of their name being drawn or if the potential prize winner fails to submit any requested information or documentation with 48 hours of it being requested, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 1. Eligible winners will have their prizes emailed to their verified email accounts by the Promoters based on the information they will have shared via the above mentioned telephonic conversation.
    • 2. The judges’ decision is final, and no correspondence will be entered into.
    • 3. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 4. The prizes are not transferable, and no substitution prizes are permitted. A prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 6. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com OR Dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by any winner to use their prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 13. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Terms and Conditions
    • 1.1 The promoters to this competition are Pick n Pay Retailers Pty Ltd (“Pick n Pay”) (registration number: 1973/004739/07) a company incorporated in the Republic of South Africa and having its registered address at 101 Rosmead Avenue, Kenilworth, 7708 and Nestlé (South Africa) (Pty) Ltd (“Nestlé”) (registration number: 1916/001498/07) a company incorporated in the Republic of South Africa and having its registered address at Anslow Office Park, 8 Anslow Crescent, Bryanston, Johannesburg 2021, South Africa.
    • 1.2 All persons entering the Pick n Pay and Nestlé Hot Chocolate Smart Shopper Competition ("the promotional competition", alternatively “the competition”) ("the entrants") agree that the competition rules as set out in these terms and conditions are binding on them. A copy of these terms and conditions is available at www.picknpay.co.za.

  2. Important notice
    • 2.1 These terms and conditions and competition rules contain certain terms and conditions which appear in similar text style to this clause and which:
      • 2.1.1 may limit the risk or liability of the promoter or a third party; and/or
      • 2.1.2 may create risk or liability for the entrant; and/or
      • 2.1.3 may compel the entrant to indemnify the promoter or a third party; and/or
      • 2.1.4 serves as an acknowledgement of a fact by the entrant.
    • 2.2 The entrant's attention is drawn to these terms and conditions because they are important and should be carefully noted.
    • 2.3 The entrant cannot be a juristic person and must be an individual.

    • 2.5 The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to the terms and conditions.
    • 2.6 All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the promoters and Pick n Pay and all entitles in the Pick n Pay group and Nestlé, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.

  3. Rules of the competition
    • 3.1 This promotional competition opens on 21 May 2018 and closes on 5 August 2018.
    • 3.2 The prize:
      • 3.2.1 A trip to Greece for one (1) winner and a travel partner to the value of approximately fifty thousand rand (R50 000);
      • 3.2.2 Winner and travel partner will be required to travel between 30 September 2018 and 9 October 2018;
      • 3.2.3 One (1) winner in total.
    • 3.3 The prize includes:
      • 3.3.1 Return economy class flights for two (2) from Johannesburg to Athens, Greece;
      • 3.3.2 Seven (7) nights hotel accommodation in Athens, Mykonos and Santorini Greece including daily breakfast;
      • 3.3.3 Ground transfers and shuttle service in Greece;
      • 3.3.4 Island hopping with daily itinerary to be shared with the winner;
      • 3.3.5 Travel insurance.
    • 3.4 The Prize excludes:
      • 3.4.1 Health requirements where necessary;
      • 3.4.2 Optional excursions;
      • 3.4.3 All items of personal nature;
      • 3.4.4 Gratuities;
      • 3.4.5 Meals and beverages other than specified
      • 3.4.6 The full cost of Visa applications (if applicable);
      • 3.4.7 And any other items not noted in the inclusions.
    • 3.5 The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of promoters.
    • 3.6 The winner and travel partner will be required to pay City Tax charge of EUR 1,50 per person per night which is payable at the hotel(s) directly
    • 3.7 Prizes are not transferable and may not be exchanged for cash or other prizes.
    • 3.8 The competition excludes Pick n Pay online shopping purchases.
    • 3.9 Prizes will be procured before the end date of the competition (1 July 2018) by Nestlé.
    • 3.10 In order to qualify as an entrant for this promotional competition, the entrant:
      • 3.10.1 must live in the Republic of South Africa;
      • 3.10.2 must provide correct and full personal details, as required;
      • 3.10.3 must be in possession of a valid passport
      • 3.10.4 must be 18 years old or older; 3.10.5 cannot be a juristic entity and must be an individual; and
      • 3.10.6 must be a registered Pick n Pay Smart Shopper.
      • 3.10.7 The promoters, Pick n Pay, any entity in the Pick n Pay Group or Company and Nestlé, their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.
    • 3.11 To enter the promotional competition, the entrant must:
      • 3.11.1 Purchase any 2 x 500g Nestlé Hot Chocolates during the promotion period and swipe their Smart Shopper card for automatic entry.
      • 3.11.2 Participants may enter the promotional competition as many times as they wish, provided they complete the competition entry process set out in 3.11.1 above each time.
    • 3.12 The winner and travel partner must each be in possession of a valid passport for at least six months after the date of return to South Africa and have no less than two full blank pages available in the passport. The winner and travel partners must be permitted to travel to the specified destination by the relevant authorities.
    • 3.13 The winner shall forfeit the prize in the event that for any reason whatsoever, the winner is prevented or unable to travel to the specified destination or on the specified dates and/or fails to meet the VISA application criteria.

  4. Selection of winners
    • 4.1 Winners will be selected within four weeks of the competition closure date (this date is subject to change without notice).
    • 4.2 Entrants to whom prizes will be awarded will be selected through a random draw.
    • 4.3 Winners will be contacted via email or telephonically within four weeks of the competition closure date (this date is subject to change without notice). Pick n Pay and Nestlé reserve the right to disqualify a winner if he/she does not respond to the email or telephone call within one week of winner selection and randomly select a replacement winner from the competition entries. In such circumstances, the replacement winner shall be contacted via email or telephonically by Pick n Pay as soon as reasonably practicable and shall be required to respond to Pick n Pay in the manner set out in such correspondence. In the event that the replacement winner fails to respond to Pick n Pay as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were the original winner. If the selected winner does not have any contact details a redraw will need to take place immediately.
    • 4.4 Pick n Pay and Nestlé reserve the right to amend the terms and conditions as well as terminate the Competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against Pick n Pay, Nestlé, their advertising agencies, advisors, suppliers and nominated agents.

  5. General
    • 5.1 By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required in order to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
    • 5.2 The names of the prize winners will be published on the Pick n Pay and Nestlé websites, subject to the winners’ consent.
    • 5.3 Winners may be requested to take part in the promoters’ publicity campaigns or to allow their names and likenesses to be used by the promoters for promotional purposes. Winners are, however, entitled to decline such request.
    • 5.4 The promoters shall conduct the competition, and the Promoters’ decision on any matter related to the competition, including the selection of prize winners is final and no correspondence will be entered into.

By entering into the NESCAFÉ GOLD HUBBLE GOLD CARD COMPETITION, entrants agree to the rules set out below:
  1. This competition is limited to legal residents and/or legal citizens of South Africa, and specifically those residing in Pretoria, Johannesburg and Cape Town. In addition, the following people shall not be eligible to participate in this competition:
    • 1.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Nestlé (South Africa) Proprietary Limited (“Nestlé”) and the organisers of the competition.
    • 1.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 1.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    • 1.4. Persons under the age of 18 years.

  2. The competition shall commence at on 21 May 2018 and will end on 31 August 2018. No entries received after 31 August 2018 will be considered.

  3. Participants can participate in the competition by making use of the Hubble screens in selective Ubers limited to Pretoria, Johannesburg and Cape Town only during the competition period stated above.

  4. Participants must adhere to the following in order to enter the competition:
    • 4.1. Answer a question about the New Nescafé Gold correctly to participate in the game on the Nescafé Gold Tab on select Hubble Screens.
    • 4.2. Play the Nescafé Gold game: shuffle the tiles to complete the image in the shortest time possible.
    • 4.3. You can then restart if you are not happy with your time or submit your details if you are happy with your time.
    • 4.4. Once a time is submitted no restart may take place.
    • 4.5. You will be required to submit your name and email address.

  5. The top 5 shortest times during the competition period will win 1 of 5 Nescafé Gold Cards valued at R20,000 (twenty thousand rand) each that can then be used to experience events of your choice with 1 (one) friend subject to the following conditions:
    • 5.1. These events will be subject to availability;
    • 5.2. A Nestlé appointed agency will be the partner through which to claim event tickets once the winners have received the Nescafé Gold card.
    • 5.3. Winners will be notified within 14 working days after of the end of the competition.

  6. The potential prize winner is not an actual winner until his/her submission is validated, the verification questions answered to the satisfaction of the promoter and his/her documents are completed and submitted to the promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. Potential winners have 48 hours to submit the relevant documentation before forfeiting the prize.

  7.   14. The organisers of the competition reserve the right to cancel or postpone the competition at any time.

  15. Nestlé reserves the right to amend the terms and conditions at any time without any notice being given to the participants.

  16. No participant shall have any recourse or claim against Nestlé as a result of: (a) any amendment to these terms and conditions; or (b) Nestlé’s cancellation, termination, suspension or postponement of the competition.

  18. Reward
    • 12.1 The prize-winners will receive a Nescafé Gold Card from Nestlé, which includes a contact number for the dedicated Concierge Service within 14 working days post competition closure.
    • 12.2 Prize-winners must contact the Concierge Service and quote the Card Number for redemption of their prize.
    • 12.3 The prize-winner has one 1 [one] year from receiving their Nestlé Gold Card to redeem or the prize will be forfeited.
    • 12.4 Upon redemption, the prize-winner has one 1 [one] year to use their prize or the prize will be forfeited.
    • 12.5 All Nescafé Gold Events Premium VIP Events experiences are limited and booked through Computicket and Ticket Pro via Concierge Service.
    • 12.6 The Concierge Service will assist the prize-winner with the booking process and provide which VIP Event Experiences are on offer.
    • 12.7 Multiple experiences can be booked with all bookings totalling a maximum of R20 000.
    • 12.8 All experiences can only be booked for the prize winner and 1 (one) friend.
    • 12.9 Transport to and from the venue/s is not included in this reward, and is for the winner’s own account. 12.10 Unless otherwise specified, the prize-winner will be required to call into the Concierge Service centre to redeem their reward.
    • 12.11 Only the owner of the Nescafé Gold Card that entered the promotion will be able to redeem the prize.
    • 12.12 The prize can only be on experiences booked through the appointed agency on the details provided.
    • 12.13 The Promoter and its agencies have the right to reject any prize-winner suspected of fraudulent behaviour.
    • 12.14 Photocopied, illegible or defaced Nescafé Gold Cards will not be accepted.
    • 12.15 Prizes may only be redeemed by the prize-winner who entered the competition and the prize is not transferable, for sale or re-sale, or redeemable for cash under any circumstance.
    • 12.16 Calls made into the Concierge Service are charged at standard share call rates.
    • 12.17 Data charges, required for any download and/or use of a reward/benefit, are never included. These charges are for the participant’s own account.
    • 12.18 The prize and/or voucher is not exchangeable for cash or for sale.
    • 12.19 The Nescafé Gold Card can only be used once.
    • 12.20 The prize-winner acknowledges that any activity carries a higher risk of death or injury and indemnifies the Promoter in full.
    • 12.21 Should the there be a problem with the physical prize on delivery, the prize winner will be required to contact the manufacturer of the product.
    • 12.22 The Promoter reserves the right to substitute any Reward for a Reward of the same or similar value.
    • 12.23 The Reward Voucher cannot be used in conjunction with any other promotional offers.

By participating in this competition, entrants agree to these rules.
    Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  1. By participating in this Competition, Participants agree to the rules set out below.
  2. This Competition is limited to residents of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 1.1 above.
    • 2.4. Persons under the age of 18 years.
  3. The Competition shall commence on 01st May 2018 and will end on 31st August 2018. No entries received after 31st August 2018 will be considered.
  4. Retail Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase a Nestle Ricoffy product and a Nestle Cremora product listed below and dial *120*2447# and follow the prompts to stand a chance to win promotional prizes. Prompts will include, but are not limited to, requesting the participant to enter the last 4 digits of the Ricoffy product barcode and the last 4 digits of the Cremora product.
  5. Wholesale Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 5.1. Participants must purchase a Nestle Ricoffy participating product and a Nestle Cremora participating product listed below and dial *120*546# and follow the prompts to stand a chance to win promotional prizes. Prompts will include, but are not limited to, requesting the participant to enter the last 4 digits of the Ricoffy product barcode and the last 4 digits of the Cremora product.

    • 5.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 5.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new Barcode code, subject to the following conditions:
      • 5.4.1. All entries from disqualified participants’ mobile numbers will be rejected
      • 5.4.2. Only one prize per household and per person per day of the promotion i.e. within the same family or immediate family residing in the same abode unless proof of purchase can be obtained.
      • 5.4.3. No computer-based entries will be accepted
      • 5.4.4. It is reasonably expected that each entry will represent a purchase you have made of the brand and hence an example 3 entries may result in the requirement to produce 3 till slips.
      • 5.4.5. For draw based rewards, till slips for each entry may be required.
      • 5.4.6. Any mobile number that enters an incorrect barcode code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”)
    • 5.5. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    • 5.6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter.
    • 5.7. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
  6. The Prize:
    • 6.1. Both versions of the promotion i.e. Retail and Wholesale give participants the chance to win a share of;

    • Participants in the wholesale version of the campaign stand a chance to win;

        • The grand prize includes the following:

        • All other costs associated with the use of the vehicle are excluded.
        • not transferrable for Cash. Colour, make and model are to be determined by the brand and cannot be amended by the winner/s.
        • Winners must be over 18 and in possession of a valid South African Driver’s license.
        • The vehicle does not include car insurance and the winners will be required to arrange their own insurance and will be liable for all risks associated with the vehicle after taking delivery. Winners will be required to sign an indemnity form acknowledging this when the vehicle is handed over.
        • The vehicle will be delivered to the nearest selected Dealership in that region where the winner is located. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner(s) to get to the selected Dealership in that region to collect the vehicle. Winners will be required to bring all relevant documents upon handover of the vehicle.
        • The vehicle will be delivered before the end of the month within which the draw took place. Nestlé will contact a winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
        • Winners must collect the vehicle within 2 weeks from the vehicle being delivered to the relevant dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters
      • 6.3. Participants in the retail version of the campaign stand a chance to win;
        • 1 of 5 x R50,000 worth of kitchen appliances (Not transferrable for cash)

  7. How to claim your prize:
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
    • 7.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up chosen.
    • 7.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their mobile number being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or no answer, such a potential winner will be disqualified and a redraw will be executed.
    • 7.4. Eligible winners will have their prizes delivered, save for the vehicles and instant prizes, should a physical delivery be necessary. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at TMARC and may be collected by the validated winner.
    • General
    • 8.1. The judges’ decision is final, and no correspondence will be entered into.
    • 8.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 8.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 8.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 8.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 8.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 8.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 8.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 8.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 8.13. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 8.14. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner(s) to get to the selected Nissan Dealership in that region to collect the Nissan vehicle. Winners will be required to bring all relevant documents upon handover of the Nissan prize.
    • 6.10. The vehicle will be delivered before the end of the month within which the draw took place. Nestlé will contact a winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
    • 6.11. Winners must collect the vehicle within 2 weeks from the vehicle being delivered to the relevant Nissan dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
  8. How to claim your prize:
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative. Potential winners may also be required to provide a till slip proving purchase.
    • 7.2. Consumers that are contacted and requested to provide details are not winners but are rather shortlisted as potential winner/s.
    • 7.3. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 7.4. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 2 (two) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 7.5. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above mentioned telephonic conversation.
  9. General
    • 8.1. The judges’ decision is final, and no correspondence will be entered into.
    • 8.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited.     • 8.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.

By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 8.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary.   7. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3.   8. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, cannot be exchanged for a different colour or model, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
