  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (Pty) Ltd (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
    • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.4. Persons under the age of 18 years.

  3. The Competition will run nationally from 25 March 2019 and end at midnight on the 30 April 2019.

  4. Entrants who purchase participating products and are able to prove that they have made the purchase via a valid till slip are eligible to win;
    • 4.1. 1 of 8 SMEG Mixers

  5. Mobile Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 5.1. Participants must purchase a participating Nestlé Cocoa product listed below and dial *120*3875# and follow the prompts to stand a chance to win promotional prizes. Prompts will include, but are not limited to, requesting the participant to enter the last 4 digits of the participating product barcode.
    • 5.2. Participating Products:
      • NESTLE Cocoa 4(6x62.5g)
      • NESTLE Cocoa 4(6x125g)
      • NESTLE Cocoa 2(6x250g)
    • 5.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 5.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase a participating product each time and complete the competition entry, subject to the following conditions:
      • 5.4.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 5.4.2. Only one prize per household and per person.
      • 5.4.3. No computer-based entries will be accepted.
      • 5.4.4. It is reasonably expected that each entry will represent a purchase you have made of a Participating Product, eg. 3 entries will result in the requirement to produce 3 till slips.
      • 5.4.5. For draw based rewards, till slips for each entry may be required.
      • 5.4.6. Any mobile number that enters an incorrect barcode code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
    • 5.6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to the Promoters.
    • 5.7. The cellphone number is key to all entries, if the participant has won on a particular cellphone number, they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.

  6. The Prizes & Draws:
    Prizes for this promotion are the following:

  7. Potential Winner Validation
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
    • 7.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up being chosen.
    • 7.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their mobile number being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or no answer, such a potential winner will be disqualified and a redraw will be executed.
    • 7.4. Eligible winners will have their prizes delivered, should a physical delivery be necessary. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at TMARC and may be collected by the validated winner.
    • 7.5. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a participant forfeiting the prize.
    • 7.6. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.
  8. General
    • 8.1. The judges’ decision is final, and no correspondence will be entered into.
    • 8.2. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 8.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 8.4. The Promoters reserve the right, at their sole discretion, to substitute the prizes with any other prizes of comparable or greater commercial value for whatever reason.
    • 8.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 8.6. Product images depicting the prizes are for illustrative purposes only and may differ from the actual prizes.
    • 8.7. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 8.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 8.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 8.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 8.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.14. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 8.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 8.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

    • 4.7. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prize(s) to the Promoters.

  6. How to claim your prize:
    • 6.1. Potential winners may also be required to provide a till slip proving purchase.
    • 6.2. Consumers that are contacted and requested to provide details are not winners but are rather shortlisted as potential winner/s.
    • 6.3. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.5. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.6. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a participant forfeiting the prize.
    • 6.7. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.

  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified, and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.

    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

  5. The Prizes:

By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 6.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 6.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 6.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 6.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 6.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 6.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Introduction
    • Participation in this Competition is governed by these terms and conditions (the Rules).
    • Participants are encouraged to review the Rules before entering the competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • This competition is operated by Nestlé (South Africa) (Proprietary) Limited (Nestlé) in conjunction with JustPalm Wireless Internet Solution (PTY)Ltd (the Promoters).
    • Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below.
    • This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.

  3. Mechanics
    To participate in this Competition, Participants are required to purchase any 2 of the below participating products:

    To enter the competition Participants are required purchase any 2 participating products and to upload a clearly legible picture of their till slip via WhatsApp to  079 999 0729. Once the till slip has been uploaded, the system reads the till slip by checking for Nestle Culinary Milks products purchased and the quantities. The automated system will approve all valid uploads. If the automated system cannot validate it, the entry will go for manual validation which will take up to 48hrs.

    It is essential that the participating product be bought within the Competition period. Network Data Charges apply.

    Participants may enter the competition a maximum of 3 times per week over the Competition period, provided that Participants purchase any 2 participating products each time and upload a picture of a new corresponding till slip, subject to the following conditions:

    • a) All entries from disqualified participants' mobile numbers will be rejected
    • b) Only one prize per household and per person
    • c) No computer-based entries will be accepted
    • d) Any mobile number that enters an incorrect or used till slip five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition ("Blocked Participants")

    Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 - 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.

  4. The Prize:
    • 4.1 Weekly Prizes
      Stand a chance to win 1 of 6 Kitchenaid Mixers weekly worth R10,000 each.
    • 4.2 Grand Prize
      Stand a chance to win 1 trip for 2 to Paris. The prize includes:
      • a. flights (return economy class);
      • b. accommodation;
      • c. and specified meals;
      • d. travel insurance;
      • e. taxes and porterage.
      The prize excludes:
      • a. passport and Visa requirements where necessary;
      • b. health requirements where necessary;
      • c. optional excursions (unless specified otherwise);
      • d. all items of personal nature;
      • e. gratuities, and meals and beverages other than specified;
      • f. spending money is for the winner’s own account and no cash will be handed over to the winner.

      The prize is redeemable for a period of 1 year after the prize is awarded to the eligible winner (the “travel period”). The prize winner may select any date of travel during the travel period (except dates falling within the blackout/high season from December to January). Trips cannot be booked over the aforesaid blackout/high season period. All travel is subject to availability at the time of booking.

      Winners will be determined by random draws that will be conducted at the Nestlé Offices.

In addition, the prize winner and travel partner must have valid South African passports and will be required to meet the relevant VISA application criteria. The prize winner will be responsible for obtaining the necessary VISA and other travel documentation at their own expense. The prize winner will be required to sign a waiver of liability and indemnity before claiming his/her prize.
    • 4.5 In the event that a prize winner does not have a valid South African passport and/or fails to meet the VISA application criteria, then the prize winner will forfeit the prize.

    • 5.3 Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified, and/or the prize will be forfeited.   6. The Prize:
    Shopper / Consumer Participants stand a chance to win a share of R300 000 (three hundred thousand Rand) in grocery vouchers. Grocery vouchers will only be redeemable at any of the Shoprite group stores (35 vouchers), Pick n Pay (20 vouchers) and Clicks South Africa (5 vouchers). These vouchers will be distributed at random. These vouchers are not permissible to purchase any infant formula or complementary food (infant cereals) or as stipulated in the R991 regulations.
    A total of 60 grocery vouchers to the value of R5 000 (five thousand Rand) each will be drawn in the duration of the competition. 20 Lucky winners will be drawn at the end of each month of the competition on the following dates 5 March 2019, 5 April 2019 & 6 May 2019.
    Trader Participants stand a chance to win a 2018 Nissan NP200 1.68V Base (UA1) only (NP200). A total of 1 winner will be drawn on the 17 May 2019. For the avoidance of doubt, there will be a total of 1 winner for the NP200 giveaway.
    The NP200 includes the following:
    • Administration Fee
    • License Fee
    • On The Road Fee
    The NP200 will be allocated to the winner randomly and such allocation is non-negotiable and cannot be exchanged for another colour or model.
    The winner of the NP200 must be over the age of 18 years and have a valid ID and Driver’s License.
    The Promoters are not responsible for any risk and / or damages that may occur once the NP200 is handed over to the winner. The NP200 does not include car insurance and the winner will be required to arrange their own insurance and will be liable for all risks associated with the NP200 after taking delivery. The winner will be required to sign an indemnity form acknowledging this when the NP200 is handed over.
    The Promoters will not be partake in any sort of deals if the winner decides to sell the NP200 once it has been handed over to the winner. The winner takes full responsibility for the selling of the NP200 and the risks associated with the sale.
    The NP200 will be delivered to the nearest selected Nissan Dealership or a selected store in that region where the winner is located. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner to get to the selected Nissan Dealership or selected store in that region to collect the NP200. The winner will be required to bring all relevant documents upon handover of the NP200.
    The NP200 will be delivered within two months of the date which the draw took place. Nestlé will contact the winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
    The winner must collect the NP200 within 2 weeks from the NP200 being delivered to the relevant Nissan dealership or the selected wholesaler and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
  7. How to claim your prize:
    • 60 lucky winners will be drawn at random in the presence of the Nestlé brand team and Nestlé legal team. These draws will take place on 5 March 2019 & 5 April 2019 & 6 May 2019.
    • One Trader winner for 2018 Nissan NP200 1.68V Base (UA1) will be selected at random in the presence of the Nestlé brand team and Nestlé legal team. This draw will take on the 6 May 2019.
    • At the time that a potential prize winner is identified, the potential prize winner will receive an SMS message in their cell phone number from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents and a copy of his/her ID and/or driver’s license to the Promoters’ representative.
    • The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.

  1. Introduction
    1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with TMARC (Pty) Ltd (the “Promoters”).
    4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

      By participating in this Competition, Participants agree to the rules set out below.

    5. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
    6. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes.   7. Potential Winner Validation (Vouchers and Fit Bits)

At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.

       

    2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein.   1. Interpretation
    • 1.1. In these Competition Rules, unless the context clearly indicates a contrary intention, the following words will have the following meanings and cognate expressions will have corresponding meanings:
      • 1.1.1. “the Act” means the Consumer Protection Act 68 of 2008;
      • 1.1.2. "Business Day" means a day other than a Saturday or a Sunday or a day which from time to time is a proclaimed public holiday in the Republic of South Africa;
      • 1.1.3. “Competition Rules” means the rules contained herein, as required by Section 36 of the Act;
      • 1.1.4. “Participant” means any natural person who qualifies in terms of clause 4.1 hereof and who enters into the Promotional Competition in terms of clause 5 hereof;
      • 1.1.5. “POPI” means the Protection of Personal Information Act, No 4 of 2013;
      • 1.1.6. “Promoter” means Nestle South Africa (Pty) Ltd and Justpalm;
      • 1.1.7. “Promotional Competition” means the competition to which these rules pertain as run by the Promoter during the Promotion Period;
      • 1.1.8. “Promotion Period” means the period starting on 26 December 2018 and closing on 28 February 2019, at 00h00. No late entries will be accepted;
      • 1.1.9. “Prize” means as further described in clause 9.
      • 1.1.10. “Winner” means the Participant who is successful in the Promotional Competition and is notified as such by the Promoter in terms of clause 6.
  2. Introduction
    • 2.1. The Promoter is offering a Promotional Competition in terms of which the Participants can enter the Promotional Competition in order to win the Prize.
    • 2.2. The Promoter hereby imposes the following Competition Rules in terms of Section 36 of the Consumer Protection Act.
  3. The Consumer Protection Act
    • 3.1. The Competition Rules contain certain terms and conditions which may:-
      • 3.1.1. limit the risk or liability of the Promoter, or any relevant third party; and/or
      • 3.1.2. create risk or liability for the Participant; and/or
      • 3.1.3. compel the Participant to indemnify the Promoter or a relevant third party; and/or
      • 3.1.4. Serve as an acknowledgement, by the Participant, of certain facts.
  4. The Participant
    • 4.1. The Participant must be;
      • 4.1.1. a natural person and may not be a juristic person;
      • 4.1.2. 18 years or older; and
        A permanent resident or citizen of the Republic of South Africa.
    • 4.2. The Participant, by entering into the Promotional Competition, expressly acknowledges that he/she has been given an appropriate opportunity to first read the Competition Rules before entering the Promotional Competition and that he/she understands and thereby agrees to the Competition Rules.
    • 4.3. It is a material term of the Promotional Competition that all Participants’ to this Promotional Competition participate entirely at their own risk.
    • 4.4. No director, employee, agent or consultant of the Promoter, or their spouses, life partners, business partners or immediate family members, or the supplier of goods and services in connection with this competition may participate in this competition.
  5. How to enter
    To participate in this Competition, Participants must adhere to the following:
    • 5.1. Participants must purchase any participating Nestlé NESPRAY product and WhatsApp “Nespray”” on 076 897 0709. Follow the prompts in order to upload your till slip as proof of purchase to stand a chance to win R10, 000 cash prizes.
    • 5.2. The promoter is not liable for the failure of any technical element relating to this promotional competition that may result in an entry not being successfully submitted. Entries which are unclear, illegible or contain errors will be declared invalid .
    • 5.3 Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and uploaded a newTillslip, subject to the following conditions:
      • 5.3.1 All entries from disqualified participants’ mobile numbers will be rejected
      • 5.3.2 Only one prize per person
      • 5.3.3 No computer-based entries will be accepted
    • 5.4 Participants must enter on a Mobile phone that is owned and registered to that person. No other person can use another person’s Mobile phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter.
    • 5.5 The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
    • 5.6 Participants must enter a valid South African identity number (ID number) and this is key to all entries. No person can use another person’s identity number (ID number) for competition entry purposes. If it is discovered that participants have entered an identity number (ID number) that is not theirs, they will be disqualified, and the entrant will not be eligible for the prize.
  6. The Prize
    • 6.1. Participants in the promotion stand a chance to win 1 of 65 cash prizes of R10 000.
    • 6.2. The draws will take place on the following dates:

In the event that any of the winners cannot be successfully contacted following all reasonable attempts to do so and/or the contacted winners fail to provide their South African details, the Promoter reserves the right to draw another Winner in substitution.
    • 6.5. Any prize not taken up for any reason within one week of notification will be forfeited.
  7. The Winner
    • 7.1. By participating in the Promotional Competition, the Winner hereby accepts that the Winner will be asked to take part in further publicity relating to the Promotional Competition, the Promoter may incorporate the Winner in publicity campaigns or allow their names and likenesses to be used for promotional purposes aligned with the Promoter’s business, including but not limited to posting photos to the Promoter’s website, Facebook and other social media pages.
    • 7.2. The Winners may be required to sign a waiver of liability and indemnity before claiming their prizes.
    • 7.3. All Winners will be required to provide their names, ID numbers, South African bank details and contact details and to sign an acknowledgement of receipt of the Prize.
    • 7.4. The Participants consent, by taking part in the competition to the Promoter using the personal information collected through the competition to adjudicate the competition and for future marketing purposes by the Promoter themselves.
    • 7.5. Where Participants/ Winners consent to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter.
    • 7.6. The Participants consent/Winner by taking part in the competition to the Promoter to give a testimonial that will be used on social media
    • 7.7. By participating in the Promotional Competition, the Winner hereby accepts to take part in the NESPRAY Live streaming game show that will take place every Friday on the NESPRAY Facebook page.
  8. The Rules
    • 8.1. The following rules apply to the Promotional Competition:-
      • 8.1.1. the Participants must provide correct and up-to-date personal details as required by the Promoter with each referral sent to the Promoter and allow the Promoter to process such information in terms of POPI;
      • 8.1.2. The Promoter reserves the right to amend these Competition Rules by bringing it to the Participants attention within a reasonable period of time and may terminate the Promotional Competition at any time. In such event, where the Promotional Competition is terminated or suspended, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors;
      • 8.1.3. In the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Participants to follow the rules) in their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants from this Promotional Competition.
      • 8.1.4. Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of these Rules by a Participant and/or their parents/guardians, determined in the Promoter’s sole discretion, may result in disqualification from the Promotional Competition and ineligibility to win any prize.
  9. Indemnification
    • 9.1. By entering into the Promotional Competition, the Participant expressly agrees to the following indemnifications:
      • 9.1.1. the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Promotional Competition and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
      • 9.1.2. The Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to claiming the Prize.
  10. Prize Qualification Rules
    • 10.1. Participation in the Promotional Competition constitutes acceptance of the Competition Rules.
    • 10.2. By entering the Promotional Competition Participants consent to their details being used for marketing campaigns by the Promoter.
    • 10.3. The Winner will be notified by telephone. If winners are uncontactable (due to incorrect contact details) after 10 days of attempting to contact them, their prize will be forfeited.
    • 10.4. A Prize may not be handed over to a winner when it is prohibited by law for the winner to use the prize. The Winner must prove their eligibility to use the prize. Once the Winner has been notified and the prize has been handed over, the Winner must sign an acknowledgement of receiving the Prize.
    • 10.5. The Participant must inform their employer of his/her participation in the Competition and must obtain consent to participate, if this is required, the Promoter accepts no responsibility in this regard should the Participant have failed to obtain the necessary consent, resulting in their inability to redeem the Prize.
    • 10.6. The Winner must provide valid proof of identity (a green bar-coded ID book, passport or drivers licence).

    • 10.16 Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 10.17 All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 10.18 The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

    • 10.21 By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 10.22. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. The prize excludes passport and Visa requirements where necessary, health requirements where necessary, optional excursions (unless specified otherwise), all items of personal nature, gratuities, meals and beverages other than specified, and any other items not noted in the inclusions. All spending money is for the winner’s own account and no cash will be handed over to the winner. The prize is redeemable for a period of 1 year after the prize is awarded to the eligible winner (the “travel period”). This Promotional Competition (“Competition”) is organized by Nestle South Africa (Proprietary) Limited and its agencies (“Promoter”).

  1. The Competition is open to permanent residents and citizens of South Africa over the age of 18 (eighteen) years in possession of a valid South African Identity Document and valid South African driver’s license, except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by Nestle South Africa (Proprietary) limited - their agencies, advisers, dealers, suppliers, its affiliates and/or associated companies (“Disqualified Persons”).
  2. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the Prizes being awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
  3. By entering the Competition, all participants and the winner agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any Prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
  4. The Competition commences on 17 December 2018 to 31 December 2018 both days inclusive.

  7. Due to network restrictions, USSD sessions time-out after 120 (one hundred and twenty) seconds (“USSD time-out”). If a Participant successfully enters their Code before the USSD time- out, their Entry will be considered valid.
  8. The Prize winners will be determined by random automatic selection draw on the following draw date by no later than the 31st of January 2019.
  9. Participants may enter the Competition as many times as they wish over the Competition period, provided that participants complete the Competition entry steps set out in Rule 6 above.

  11. CASH PRIZE
    • Participants stand a chance of winning one Prize per household.
    • To claim the Prize, the winner must produce their valid South African ID, drivers license or residents permit. Till slip dated within the campaign period stated in rule 4 and showing the two purchases of the participating products in rule 6 and complete a finalist form. Blurred or obscured copies will result in disqualification. The requested documents need to be sent within 24 hours if not done the finalist will be disqualified and the promoter will move onto the next possible finalist.
    • In addition to any other the verification requirements set out in these Rules, the Promoter may require the Prize winner to complete and submit an information disclosure agreement and indemnification, within 24 hours of being confirmed a winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008 (“CPA”). Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.
    • The Promoter will call the possible finalist on the cellphone number used to enter the Competition. The possible finalist will be called once a day for 3 (three) days and if the Promoter is not able to contact the possible finalist during this time, the Promoter will move onto the next possible winner.
    • If the possible finalist passes the verification process and submits the required documents set out in 10.2 above, they will be declared a winner by the Promoter. The validity of such documentation is at the Promoter’s discretion.
    • Should the Winner not be in possession of a valid South African Driver’s license/identity document or valid residence permit, that Winner will be disqualified, and the Promoter will choose another Winner from the finalists.
    • The above-mentioned Prize cannot be exchanged for transferred.
    • The prize will be delivered via FNB e-wallet to the mobile number used to participate in the promotion within 5 working days from being announced a winner.
      • Cash prizes will be returned to the Promoter if the winner has not registered for FNB within 14 (fourteen) days of being informed that they have won. Should the winner not be contactable within 48 hours of the cash prize being returned, the winner will forfeit the prize and a new winner will be chosen.
      • Cash prize winners are required to register for an access FNB e-wallet by dialing *120*277# at their own expense, if they are not already registered.
    • The Prize is awarded at the discretion of the promoter. The promoter reserves the right, at its own discretion, to substitute the Prize with any other Prize of comparable commercial value or an appropriate replacement value in the place of the Prize.
  12. The Promoter may require the winner to be identified and photographed and the photographs published in printed media, or to appear on radio and television, when accepting their Prize and/or after having received their Prize. The winner will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.
  13. Prize images on the Point of Sale material are used to represent the Prizes for promotional illustrative purposes only, and might differ from the actual Prize awarded.
  14. Entries that are unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or from Disqualified Persons will be declared invalid.
  15. The promoter reserves the right to carry out reasonable due diligence to confirm eligibility and help ensure that the use of any such person in advertising or publicity of the promotion will not bring the Promoter or any of the promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the promotion as determined by the promoter in its sole discretion.
    • The promoter reserves the right to withdraw the prizes and/or disqualify any participant or winner that may bring the brands into disrepute.

  18. By entering the competition, participants acknowledge that the competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
  19. Nestle South Africa (Proprietary) Limited reserves the right to cancel, terminate or suspend the competition and select a winner from the among all eligible entries received prior to the cancellation, termination or suspension.
  20. By entering the competition all participants agree to be bound by the rules, regulations and requirements set out in the promotional material. This competition is subject to South African law, and is not offered outside South Africa.

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestle South Africa (Proprietary) Limited (“Nestlé”) in conjunction with the JustPalm (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.

  2. By participating in this Competition, Participants agree to the rules set out below
    This Competition is nationwide ONLY in selected Pick n Pay Group Stores and SPAR Group Stores (Excluding Boxer Stores), and all legal residents or citizens of South Africa can participate. The following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.3. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in 2.1 above.
    • 2.4. Persons under the age of 18 years.

  3. The Competition shall commence on 17th December 2018 and will end on 31st January 2019. No entries received after 31st January 2019 will be considered.
  4. Mechanics
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants must purchase any 2 participating Nestlé SMARTIES products as listed below and dial *120*3825# to stand a chance to win R200,000 in Tablets and Shopping Vouchers.
    • 4.2. Participating Products:
      • 4.2.1. Nestlé SMARTIES 40g
      • 4.2.2. Nestlé SMARTIES 70g
      • 4.2.3. Nestlé SMARTIES 152g
    • 4.3. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the call when complete in order to stop the call.
    • 4.4. Participants may enter the competition as many times as they wish over the promotional period, provided that Participants purchase the participating products each time and complete the competition entry and enter a new barcode, subject to the following conditions:
      • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected
      • 4.4.2. Only one prize per household and per person
      • 4.4.3. No computer-based entries will be accepted
    • 4.5. Participants must enter on a Mobile phone that is owned and registered to that person. No other person can use another person’s Mobile phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter.
    • 4.6. The cellphone number is key to all entries, if the entrant has won on a cellphone number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
    • 4.7. Participants must enter a valid South African identity number (ID number) and this is key to all entries. No person can use another person’s identity number (ID number) for competition entry purposes. If it is discovered that participants have entered an identity number (ID number) that is not theirs, they will be disqualified, and the entrant will not be eligible for the prize.

  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) from a Pick n Pay store or SPAR store and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 2 (two) working days of their name being drawn or if the potential prize winner fails to submit any requested information or documentation with 48 hours of it being requested, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.


  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing consumer.services@za.nestle.com or Dial 086 0096 116. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.6. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.7. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.9. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.13. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.14. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.
